AGREEMENT
LANDSCAPE SERVICES AT MARINAPARK - EDDIE OSAKO
On this/ZZLday of, 1975, the CITY OF
NEWPORT BEACH, a municipal corporation, hereinafter referred
to as "City" and EDDIE OSAKO, 2383 Orange Avenue, Costa Mesa,
California, mutually agree as follows,
1) For the consideration of $1,050.00 per month, pay-
able by the City to Eddie Osako, as provided below, Eddie Osako
shall perform the following services in and about Marinapark,
located at 1770 West Balboa Boulevard, Newport Beach, California-
a. Cut, edge, and vacuum all grass areas once
weekly.
b. Weed out all grass areas and weed and cultivate
flower beds as needed.
C. Trim, prune, and shape as necessary all shrubs,
bushes, and trees, excluding palm trees.
d. Establish an effective weed abatement program in
all areas.
e. Wash down all walk areas once a week.
f. Fertilize all grass areas and flower beds not less
than once every 120 days.
g. Repair and maintain all sprinklers located within
Marinapark.
h. Supply and spray all areas, including shrubs and
trees, with insecticides and pesticides, as needed.
i. Re -seed any barren areas and plant flower bed areas,
all plants will be supplied by the City.
j. In the event the work hereunder cannot be done on
a day when said work is required to be done because of
weather conditions, or the work is scheduled to be done
on a legal holiday, the weekly gardening shall be done the
immediately preceding or following day.
k. Eddie Osako will supply all top soil, fertilizer,

feeds, herbicides, insecticides and pesticides as necessary
under this Agreement.
2) All work done hereunder by Eddie Osako shall be done
in a substantial and workmanlike manner and shall be done in a
manner acceptable to the Marinapark Manager
3) Eddie Osako will provide evidence of Workmen's Compensa-
tion Insurance covering all employees of Eddie Osako performing work
hereunder.
4) Eddie Osako will supply to the City evidence of public
liability insurance in the minimum amount of $100,000.00 each.person,
$300,000.00 each occurrence for bodily injury and $50,000.00 property
damage. The City of Newport Beach shall be named an additional
insured on said insurance policies, and said policies shall further
provide that the insurance provided thereunder will be primary
insurance and not contributing with any other insurance available
to the City of Newport Beach.
5) At the end of each month, during the term hereof. Eddie
Osako shall present a bill to the City and the City shall pay the
monthly consideration as set forth hereinbefore not later than the
15th day after the receipt of said bill.
6) This Agreement may be terminated by either party upon
giving the other party two weeks written notice of intent to
terminate.
7) The terms of this Agreement shall become effective
May 1, 1975.
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be made and executed the day and year first above
written.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY
OF NEWPORT BEACH AND EDDIE OSAKO FOR LANDSCAPE
SEP.VICES 'AT MARINAPARK
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and Eddie Osako for landscape services
at Marinapark; and
WHEP.AS, the City Council.has considered the terms
and conditions of said agreement, and found them to be fair.
and equitable and in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the 'City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the.same on behalf of the City of
Newport Beach.
