Brown, City Clerk TITLE: Resolution No. 2021-118: Requesting that the Board of Supervisors for the County of Orange Include John Wayne Airport in the Same Supervisorial District as the City of Newport Beach ABSTRACT: The Orange County Board of Supervisors (Board) is in the process of redrawing the boundaries of the County of Orange's five supervisorial districts and is currently accepting public comments on the proposed 2021 Orange County Redistricting maps. This presents the opportunity for the City of Newport Beach (City) to express its desire to have John Wayne Airport (JWA) included in the same supervisorial district as Newport Beach. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2021-118, A Resolution of the City Council of the City of Newport Beach, California, Requesting that the Board of Supervisors for the County of Orange Include John Wayne Airport in the Same Supervisorial District as the City of Newport Beach. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: Every 10 years, supervisorial districts must be redrawn so that each district is substantially equal in population. This process, called redistricting, is important in ensuring that each board member represents about the same number of constituents. In Orange County, the Board of Supervisors is responsible for drawing supervisorial districts. The County of Orange (County) redistricting process must be completed by December 15, 2021. 1-1 Resolution No. 2021-118: Requesting that the Board of Supervisors for the County of Orange Include John Wayne Airport in the Same Supervisorial District as the City of Newport Beach November 16, 2021 Page 2 Below is the current map of the current supervisorial districts. The Board is currently in the process of reviewing the proposed 2021 Orange County Redistricting maps. Some of the proposed map versions have the City and JWA in the same district and others do not. The impacts related to JWA are, and will continue to be, a significant threat to the quality of life of the residents of Newport Beach, especially since many residential communities are located under or near the departure paths for commercial and general aviation aircraft operating out of JWA. Newport Beach has traditionally been included in the supervisorial district that includes JWA, and this has helped the City and County to work together to address the impacts of JWA on the city. Mayor Brad Avery and Council Members Noah Blom, Diane Dixon, and Duffy Duffield requested a special meeting on November 16, 2021 so the City Council can consider requesting that the Board of Supervisors continue to include JWA in the same supervisorial district as the City. Should the City Council desire to make this request to the Board of Supervisors, Resolution No. 2021-118 (Attachment A) has been prepared for City Council approval. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. 1-2 u a o.Te ociunn�i w uxi The Board is currently in the process of reviewing the proposed 2021 Orange County Redistricting maps. ATTACHMENT: /GUM1,02 F -IM ZM.7[1[i[.7i7 rOMIi►AiREF-6a 1-3 ATTACHMENT A RESOLUTION NO. 2021-118 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, REQUESTING THAT THE BOARD OF SUPERVISORS FOR THE COUNTY OF ORANGE INCLUDE JOHN WAYNE AIRPORT IN THE SAME SUPERVISORIAL DISTRICT AS THE CITY OF NEWPORT BEACH WHEREAS, every ten years, the County of Orange ("County") uses new census data to redraw supervisorial districts so that each board member represents about the same number of constituents, WHEREAS, the Orange County Board of Supervisors ("Supervisors") is responsible for drawing supervisorial districts for the County; WHEREAS, redistricting determines which neighborhoods and communities are grouped together into each district; WHEREAS, the impacts related to John Wayne Airport ("JWA") are now, and will continue to be, a significant threat to the quality of life of the residents of the City of Newport Beach ("City"); WHEREAS, many residential communities within the City are located under or near the departure path of commercial and general aviation aircraft operating out of JWA; WHEREAS, for over 30 years, the City, and community groups concerned about adverse airport impacts, have developed, and implemented strategies to control those impacts; WHEREAS, JWA has traditionally been included in the supervisorial district that includes the City, which has helped the City and County work together to address the impacts of JWA on the City; and WHEREAS, including JWA within the same supervisorial district is in the best interests of the City and its residents. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby request that the Board of Supervisors for the County of Orange include John Wayne Airport in the same supervisorial district as the City of Newport Beach. 1-4 Resolution No. 2021 - Page 2 of 2 Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
