Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Andy Tran, Senior Civil Engineer, atran@newportbeachca.gov PHONE: 949-644-3315 TITLE: Resolution No. 2021-125: Authorizing the Project List Submittal for Coronavirus Response and Relief Supplemental Appropriations Act of 2021 Funding Through the Orange County Transportation Authority 2021 Pavement Management Relief Funding Program ABSTRACT: The federal Coronavirus Response and Relief Supplemental Appropriations Act of 2021 (CRRSAA) appropriated $10 billion for Highway Infrastructure Programs. The Orange County Transportation Authority (OCTA) is responsible for distributing CRRSAA funds through the 2021 Pavement Management Relief Funding (PMRF) program. To participate in this funding program, local agencies are required to adopt a resolution certifying a project list, which identifies all projects that will use CRRSAA funds. Staff would like to submit a funding application for CRRSAA funds for the Von Karman Pavement Rehabilitation project. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2021-125, A Resolution of the City Council of the City of Newport Beach, California, Certifying that the City of Newport Beach has Authorized the Project List Submittal for Coronavirus Response and Relief Supplemental Appropriations Act of 2021 Funding Through the Orange County Transportation Authority 2021 Pavement Management Relief Funding Program. DISCUSSION: The federal CRRSAA appropriated $10 billion for Highway Infrastructure Programs. OCTA is responsible for distributing CRRSAA funds to local agencies through the PMRF program. This funding program will provide $10.931 million to 35 Orange County local agencies. 12-1 Resolution No. 2021-125: Authorizing the Project List Submittal for Coronavirus Response and Relief Supplemental Appropriations Act of 2021 Funding Through the Orange County Transportation Authority 2021 Pavement Management Relief Funding Program November 30, 2021 Page 2 Funds are apportioned based on population with a guaranteed minimum of $200,000 for each local agency. The City of Newport Beach (City) has been allocated $252,095 under the PMRF program. The CRRSAA funds are intended to offset revenue losses due to the coronavirus pandemic. The PMRF program is intended to help local agencies with routine maintenance and rehabilitation of highway infrastructures. Consistent with the California Transportation Commission (CTC) and the California Department of Transportation (Caltrans) Local Assistance guidelines, the PMRF program guidelines only allow CRRSAA funds to be used for street pavement preservation, preventive maintenance, rehabilitation and reconstruction exclusively. Since this program involves federal funds, local agencies must follow all requirements as established by the CTC, Caltrans, and the Federal Highway Administration (FHWA). To participate in the PMRF program, local agencies are required to adopt a resolution to certify a project list, which identifies all projects that will use CRRSAA funds. The resolution must be included with the funding application. Staff is proposing to use CRRSAA funds on the Von Karman Pavement Rehabilitation project in Fiscal Year 2022-23. As identified in the City's Pavement Management Program, Von Karman Avenue from MacArthur Boulevard to Campus Drive has a Pavement Condition Index of 61 (out of a possible 100) and is scheduled for rehabilitation in the near future. This four -lane primary arterial also meets all PMRF program requirements. The preliminary construction cost estimate is approximately $600,000. Staff will recommend including this project in the Fiscal Year 2022-23 Capital Improvement Program. FISCAL IMPACT: Subsequent to the adoption of Resolution No. 2021-125, the City will receive $252,095 of funding from CRRSAA. Staff will recommend allocating this funding in the Fiscal Year 2022- 23 Capital Improvement Program to the Von Karman Avenue Pavement Rehabilitation project. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. 12-2 Resolution No. 2021-125: Authorizing the Project List Submittal for Coronavirus Response and Relief Supplemental Appropriations Act of 2021 Funding Through the Orange County Transportation Authority 2021 Pavement Management Relief Funding Program November 30, 2021 Page 3 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Resolution No. 2021-125 12-3 ATTACHMENT A RESOLUTION NO. 2021-125 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, CERTIFYING THAT THE CITY OF NEWPORT BEACH HAS AUTHORIZED THE PROJECT LIST SUBMITTAL FOR CORONAVIRUS RESPONSE AND RELIEF SUPPLEMENTAL APPROPRIATIONS ACT OF 2021 FUNDING THROUGH THE ORANGE COUNTY TRANSPORTATION AUTHORITY 2021 PAVEMENT MANAGEMENT RELIEF FUNDING PROGRAM WHEREAS, the City of Newport Beach ("City") is being provided $252,095 in federal Coronavirus Response and Relief Supplemental Appropriations Act of 2021 ("CRRSAA") funding through the 2021 Pavement Management Relief Funding ("PMRF") Program; WHEREAS, the City is eligible to receive federal funding through the California Department of Transportation; WHEREAS, the Orange County Transportation Authority ("OCTA") is responsible for the distribution of the CRRSAA funding; WHEREAS, OCTA has developed guidelines for administering and distributing CRRSAA funds to eligible local agencies through the 2021 PMRF Program; and WHEREAS, the City is the lead agency for the project identified below, and will comply with all applicable local, state, and federal provisions including, but not limited to, the Federal Transportation Improvement Program, California Environmental Quality Act, National Environmental Policy Act, Americans with Disabilities Act, and Buy America. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby authorize the submittal of the following project nomination to OCTA for CRRSAA funding: Von Karman Avenue Pavement Rehabilitation project for $252,095 in CRRSAA funding. Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. 12-4 Resolution No. 2021 - Page 2 of 2 Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
