The agenda will be posted at least seventy-two (72) hours in advance of each regular meeting and the public will be allowed to comment on agenda items before the Zoning Administrator, as well as items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Zoning Administrator may limit public comments to a reasonable amount of time, generally three (3) minutes per person. Recommended Action 1.Approve and File IV.PUBLIC HEARING ITEMS Lido House Temporary Tent Limited Term Permit No. XP2021-035 (PA2021-267) Site Location: 3300 Newport Boulevard 2. Project Summary A limited term permit to allow one 1,656-square-foot temporary tent structure at the rooftop deck venue area (Topside) at the Lido House Hotel for up to a one-year term. The tent structure is intended to provide protection from light rain and wind for a limited period within the colder weather months. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15311 under Class 11 (Accessory Structures) of the State CEQA (California Environmental Quality Act) Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Limited Term Permit No. XP2021-035. Avila’s El Ranchito Temporary Patio Limited Term Permit No. XP2021-036 and Coastal Development Permit No. CD2021-071 (PA2021-273) Site Location: 2800 Newport Boulevard 3. Project Summary A request for a limited term permit and coastal development permit to authorize a maximum 1,000-square-foot expanded outdoor dining patio for up to a one-year term that was previously authorized through Emergency Temporary Use Permit No. UP2020-008 and Emergency Coastal Development Permit No. CD2020-025 (PA2020-077). Recommended Action January 13, 2022 Page 3 Zoning Administrator Meeting 1.Continue the item to the January 27, 2022 Zoning Administrator Meeting. Newport Fusion Sushi Temporary Outdoor Expansion Limited Term Permit No. XP2021-018 (PA2021-200) Site Location: 21135 Newport Coast Drive 4. Project Summary A request for a limited term permit to allow a 550 square feet maximum expanded dining area for up to a one-year term. The expanded dining area was previously authorized through Emergency Temporary Use Permit No. UP2020-181 (PA2020-337). Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 under Class 1 (Existing Facilities) and Section 15303 under Class 3 (New Construction or Conversion of Small Structures), respectively, of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment, and the exceptions to the Class 3 Exemption do not apply; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Limited Term Permit No. XP2021-018. Stein Residence Coastal Development Permit No. CD2021-064 (PA2021-249) Site Location: 6501 and 6503 Seashore Drive 5. Project Summary A request for a coastal development permit to demolish an existing duplex and construct a new 4,273-square-foot duplex with two attached 385-square-foot, two-car garages. The structure would be three stories and reach a height of approximately 29 feet. The project also includes additional appurtenances such as site walls, fences, patios, landscaping, and drainage devices. All improvements will occur within the confines of the private property. The design complies with all development standards including height, setbacks, and floor area limit, and no deviations are requested. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment and the exceptions to this exemption do not apply; and January 13, 2022 Page 4 Zoning Administrator Meeting 3.Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit No. CD2021-064. V.PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers’ time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
