Newport Harbor Elks Lodge Parking Agreement
In 1958, the City and Newport Harbor Elks Lodge executed a parking
agreement authorizing the City to lease a portion of the Elks' property at Via
Oporto and Central to establish metered public parking as well as to allow
egress from the City lot (see Attachment I). The lease provided that the City
pay 12% of the meter revenues to the Elks Lodge or $120 per year, whichever
was greater. Last year, payment to the Elks from parking meter revenues was
$1,722. The lease also permitted the Elks Lodge exclusive use of the entire
parking lot for six, twenty -four hour days per year for special event parking.
When the lease terminated in 1983, the parties agreed to continue the lease
on a month-to -month basis, with the same provisions.
Recently, the Elks Lodge requested a ten year lease with modified provisions.
Because parking for their members is difficult, the Elks have agreed to
eliminate the City's annual lease payment in exchange for exclusive control
of the City parking lot from 6:00 p.m. to 6:00 a.m. daily. The City would post
signs noticing the parking restrictions, but the Elks would be responsible for
monitoring and enforcing the evening parking restrictions.
On most evenings, the parking lot would be used for Elks' member parking.
However, under the proposed lease the Elks would have the authority to rent
the parking lot to private parties and the City would receive 50%b of the net
proceeds. The lease still allows for exclusive use of the parking lot for six days
per year, but also authorizes a waiver of the City Special Event permit
application fee for a maximum six special events annually.
• The proposed lease is for ten years, with three 5 -year options to renew the
agreement. If the lease is approved as proposed, the net cost savings to the
City is approximately $1,400 per year. However, there is the potential of
additional City revenues if the lot is leased to private parties by the Elks.
$ COMMENDATION
It is recommended the City Council approve the new lease agreement
between the City of Newport Beach and Newport Harbor Elks Lodge #1767.
