I. CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Jaime Murillo, Zoning Administrator Liz Westmoreland, Associate Planner Patrick Achis, Assistant Planner II. REQUEST FOR CONTINUANCES Jaime Murillo, Zoning Administrator, reported that staff requested Item Number 3 be continued to the January 27, 2022, Zoning Administrator Meeting. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF DECEMBER 16, 2021 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 2 Lido House Temporary Tent Limited Term Permit No. XP2021-035 (PA2021-267) Site Location: 3300 Newport Boulevard Council District 1 Liz Westmoreland, Associate Planner, provided a brief project description stating that the project is limited term permit for a rooftop tent at the Topside venue at Lido House hotel that would allow the tent to be up for four cumulative months over a one-year period. The project includes no intensification of use and the tent complies with the height limitations of Title 21 of the Newport Beach Municipal Code. The Applicant has requested a change to draft condition of approval number 5 to begin the one-year term in March 2022. Further, draft conditions of approval number 5 and number 29 have been revised as follows Condition of approval number 5: The 1,656-square-foot temporary tent structure is permitted onsite for four (4) cumulative months during the time period of March 1, 2022 through February 28, 2023. A tent structure on the rooftop decks any time other than the dates specified is prohibited, unless an extension is granted by the Zoning Administrator in accordance with NBMC 20.54.060 for an additional 4 (cumulative) months for the time period between March 1, 2023 through February 29, 2024 Condition of approval number 29: Notwithstanding any extensions of amendments to this limited term permit, the proposed tent is limited to 180 days (6 months) during a calendar year. Applicant Tony Wrzosek, stated that he would like conditions to allow some flexibility in timing to allow the tent, once received, to be installed as a test only to ensure it is installed correctly. The Zoning Administrator suggested a condition of approval to allow a test installation of the tent and revised the dates of condition of approval number 5. The Applicant stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 01/13/2022 Page 2 of 3 Action: Approved as Amended ITEM NO. 3 Avila’s El Ranchito Temporary Patio Limited Term Permit No. XP2021-036 and Coastal Development Permit No. CD2021-071 (PA2021-273) Site Location: 2800 Newport Boulevard Council District 1 Action: Continued to the January 27, 2022, Zoning Administrator Meeting ITEM NO. 4 Newport Fusion Sushi Temporary Outdoor Expansion Limited Term Permit No. XP2021-018 (PA2021-200) Site Location: 21135 Newport Coast Drive Council District 6 Patrick Achis, Assistant Planner, provided a brief project description stating that this is a request for a limited term permit to allow a 550-square-foot temporary outdoor dining area for up to a one year. He described the location of the area and asserted there are no parking or circulation issues with the temporary structures in place. Phil Vise of the Irvine Company confirmed there are no other temporary outdoor dining patios desired for this shopping center. He stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. The Zoning Administrator approved the project as submitted. Action: Approved ITEM NO. 5 Stein Residence Coastal Development Permit No. CD2021-064 (PA2021-249) Site Location: 6501 and 6503 Seashore Drive Council District 1 Patrick Achis, Assistant Planner, provided a brief project description stating that this is a request to demolish an existing duplex and construct a new duplex with attached parking for four cars. He noted the project includes other improvements to the site, including accessory structures, and that all improvements would occur on private property. He stated that the project is consistent with all design standards and the land use designations, and that it would not impact access or visual resources in the coastal zone. The Zoning Administrator clarified that this property was part of a recent Code Amendment that changed the required setbacks. Applicant Eric Aust, on behalf of the owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. The Zoning Administrator approved the project as submitted.
