TITLE: Correct Recently Approved Street Sweeping Days in Resolution
No. 2022-7; and Adopt Resolution No. 2022-12
ABSTRACT:
On January 11, 2022, the Utilities Department brought forward Resolution No. 2022-7,
changing many street sweeping days in conjunction with the new trash and recycling
collection routes changes. The resolution contained a scrivener's error related to the
changes on the Balboa Peninsula, specifically, the street sweeping day change for the
south side of East Balboa Avenue from A Street to G Street. It was incorrectly listed as
changing from Tuesdays to Wednesdays. It should be listed as changing from Tuesdays
to Mondays.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2022-12, A Resolution of the City Council of the City of Newport
Beach, California, Establishing "No Parking" Restrictions on Designated Streets on
Specific Days and Times to Improve Street Sweeping Effectiveness and Rescinding
Resolution No. 2022-7.
DISCUSSION:
With the changes to the trash and recycling collection routes, staff found it necessary to
change the street sweeping days for portions of the Balboa Peninsula and Corona del
Mar. Those changes were approved by the City Council on January 11, 2022, and went
into effect on February 1, 2022. During the process of implementing the new street
sweeping days, an error was discovered on the Peninsula, on the south side of East
Balboa Avenue from A Street to G Street, affecting approximately six blocks. It was a
scrivener's error made by the Utilities Department during the creation of the maps which
was then transposed onto the Resolution. The street sweeping change was listed as
changing from Tuesdays to Wednesdays. Rather, it should be listed as changing from
Tuesdays to Mondays.

The correct schedule change was included in the postcard notice sent to all affected
property owners. The City is also communicating the changes by utilizing an enforcement
grace period (i.e. providing warnings), informing adjacent residents as part of the trash
collection changes, changing the street sweeping signage, placing changeable message
boards in the neighborhood, posting updates and notices on the City website, emailing to
the affected community and home owner associations, and issuing general, citywide
messaging and social media posts.
There is a citywide master resolution which contains all of the posted street sweeping
segments. The preferred method is to rescind the entire previous resolution, modify the
selected street segment, and adopt a new resolution with all City street segments. Staff
is recommending rescinding Resolution No. 2022-7 and adopting a new resolution for
changes to street sweeping days for East Balboa Avenue on the Peninsula. Attachment
A shows the geographic area of the proposed parking restriction changes.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, ESTABLISHING
"NO PARKING" RESTRICTIONS ON DESIGNATED
STREETS ON SPECIFIC DAYS AND TIMES TO
IMPROVE STREET SWEEPING EFFECTIVENESS AND
RESCINDING RESOLUTIONS NO. 2022-7 AND 2020-
87
WHEREAS, Section 12.44.150 (Prohibited Parking) of the Newport Beach Municipal
Code ("NBMC") provides that the City Council shall by resolution designate streets or
portions of streets on which the parking or standing of vehicles is to be prohibited;
WHEREAS, the City Council shall designate in the resolution the days of the week
and the exact hours during which such prohibition shall be in effect; and
WHEREAS, the City Council has determined that it is reasonable and in the public
interest to prohibit parking of vehicles at certain times and in certain areas of the City in order
to effectively operate the City street sweeping program.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council hereby prohibits the parking of vehicles between the
hours of 8:30 A.M. to 12:30 P.M. on the following days and in the following areas:

Section 10: In accordance with Section 12.44.150(8) (Prohibited Parking —Signs)
of the NBMC, the City Traffic Engineer shall erect all necessary signs to provide notice
of said parking restrictions.
Section 11: All prior versions of "No Parking" restrictions on designated
streets on specific days and times to improve street sweeping effectiveness are hereby
repealed, including Resolutions No. 2022-7 and 2020-87.
Section 12: The recitals provided in this resolution are true and correct and
are incorporated into the substantive portion of this resolution.

Section 13: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall
not affect the validity or constitutionality of the remaining portions of this resolution.
The City Council hereby declares that it would have passed this resolution, and each
section, subsection, sentence, clause or phrase hereof, irrespective of the fact that
any one or more sections, subsections, sentences, clauses or phrases be declared
invalid or unconstitutional.
Section 14: The City Council finds the adoption of this resolution is not subject
to the California Environmental Quality Act ("CEQA") pursuant to Sections
15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect
physical change in the environment) and 15060(c)(3) (the activity is not a project as
defined in Section 15378) of the CEQA Guidelines, California Code of Regulations,
Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical
change to the environment, directly or indirectly.
Section 15: This resolution shall take effect immediately upon its adoption by
the City Council, and the City Clerk shall certify the vote adopting this resolution.
