Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Andy Tran, Senior Civil Engineer, atran@newportbeachca.gov PHONE: 949-644-3315 TITLE: Street Pavement Repair Program (Project No. 22R03) — Award of Contract No. 8792-1 ABSTRACT: The City of Newport Beach (City) staff has received construction bids for the Street Pavement Repair Program project and requests the City Council's approval to award the construction contract to PALP Inc., dba Excel Paving Company. This project will remove and replace areas of deteriorated asphalt pavement at the following locations: Sherrington Place, Sea Gull Lane, St. Andrews Road, 15th Street, and The Arcade. These improvements are needed in preparation for the upcoming annual neighborhood slurry seal program, which will be in the same vicinity. RECOMMENDATION: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (maintenance of existing public facilities involving negligible or no expansion of use), of the CEQA Guidelines, because this project has no potential to have a significant effect on the environment; b) Approve the project plans and specifications; c) Award Contract No. 8792-1 to PALP Inc., dba Excel Paving Company for the total bid price of $429,748, and authorize the Mayor and City Clerk to execute the contract; and d) Establish a contingency of $108,000 (approximately 25 percent of total bid) to cover the cost of unforeseen work not included in the original contract. 6-1 Street Pavement Repair Program (Project No. 22R03) — Award of Contract No. 8792-1 February 8, 2022 Page 2 DISCUSSION: At 10 a.m. on January 18, 2022, the City Clerk opened and read the bids for this project: The City received seven bids for this project. The low bidder, Excel Paving Company, possesses a California State Contractor's License Classification "A", as required by the project specifications. A review of references for Excel Paving Company shows satisfactory completion of similar contracts for the City and other municipalities. Additionally, Excel Paving Company was the low bidder for the Street Pavement Repair Program project in FY 2020-21. The low bid was 17.2 percent below the Engineer's Estimate of $519,000. The disparity between the bid and the Engineer's Estimate was primarily attributed to the cost of asphalt concrete. The favorable bid price for this item was significantly less than the estimated unit price. All bids were close and competitive. The proposed project includes reconstructing portions of deteriorated asphalt concrete pavement, removing portions of deteriorated concrete street pavement and replacing the pavement with asphalt concrete, lowering and raising manholes, replacing utility boxes and lids, replacing and resetting survey monument boxes, and installing new traffic striping. Since the completion of the design phase for this project, some additional areas of deteriorated pavement have been identified as needing repair. As the bid price for asphalt concrete was very favorable, staff would like to take advantage of the low asphalt concrete bid price. With that, staff recommends establishing $108,000 for contingency purposes (approximately 25 percent of total bid) to address unforeseen conditions, as well as address some additional areas of deteriorated pavement. Pursuant to the Contract Specifications, the contractor will have 45 consecutive working days to complete the work.
