TITLE: Newport Beach Police Station Upstairs Restroom Remodel (Project
No. 22F02) — Award of Contract No. 7900-2
ABSTRACT:
Staff has received construction bids for the Newport Beach Police Station Upstairs
Restroom Remodel project and requests the City Council's approval to award the
construction contract to Urban Professional Builders, Inc. (UPB Inc.). The project consists
of remodeling two men's restrooms on the second floor of the Police Department
Headquarters building. Fixtures, partitions, tile, and ceiling will all be replaced. The
asbestos and lead in the area will also be abated as part of the project and the restroom
will be brought into conformity with accessibility standards as required by the Americans
with Disabilities Act (ADA).
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301(a) (interior and exterior alterations involving such things as
interior partitions, plumbing, and electrical conveyances) of the CEQA Guidelines,
because this project has no potential to have a significant effect on the environment;
b) Approve the project plans and specifications;
c) Award Contract No. 7900-2 to Urban Professional Builders, Inc. for the total bid price
of $209,000, and authorize the Mayor and City Clerk to execute the contract; and
d) Establish and encumber a contingency of $31,350 (15 percent of the total bid) to cover
the cost of unforeseen work not included in the original contract.
DISCUSSION:
The two upstairs men's restrooms at the Police Department Headquarters building were
identified in discussions with the department's facility maintenance personnel as needing
significant renovation. The restroom fixtures, tile, and certain portions of the plumbing are
corroded and at the end of their useful life. An architect was engaged and plans were
prepared for the renovation of these restroom facilities.

At 10 a.m. on March 15, 2022, the City Clerk opened and read the following bids for this
project:
The apparent low bidder for this project, Urban Professional Builders, Inc., submitted a
bid approximately 30 percent higher than the Engineer's Estimate of $161,000. Staff
analyzed the bid and the estimate and have concluded that the difference relates to the
high levels of inflation currently working through the construction market and staff
underestimated the cost for lead and asbestos remediation. UPB Inc. submitted all the
necessary forms and possesses a Classification "B" License as required by the project
specifications. A check of the contractor's references indicates satisfactory completion of
similar projects for other public agencies.
Work necessary to complete this contract consists of obtaining building permits, passing
personnel background checks, removing and disposing of existing improvements, abating
lead and asbestos, and installing new fixtures, partitions, tile, ceiling, and other incidental
items at the Police Department Headquarters building located at 870 Santa Barbara
Drive. UPB Inc. will have 30 consecutive working days to complete the work once given
the notice to proceed. Initial work is expected to begin in July 2022.
The project plans and specifications will be available for review at the April 26, 2022 City
Council meeting or upon request.
FISCAL IMPACT:
The Fiscal Year 2021-22 adopted Capital Improvement Program budget includes
sufficient funding for this project. The following funds will be expensed:

The Facilities Maintenance Master Plan (FMMP) account funds capital improvements and
the maintenance of City of Newport Beach buildings. Projects expensed to this account
are generally beyond typical maintenance items in terms of cost and complexity. Staff
recommends establishing a slightly higher than typical contingency of $31,350
(15 percent of total bid) for addressing any unforeseen conditions associated with
construction.
