A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF NEWPORT BEACH RECOMMENDING TO THE
CITY COUNCIL THE APPROVAL OF LOCAL COASTAL
PROGRAM AMENDMENT NO. 45 AMENDING THE LOCAL
COASTAL PROGRAM LAND USE PLAN MAP OF THE CITY OF
NEWPORT BEACH SO AS TO ALTER THE BOUNDARY BETWEEN
THE "RETAIL AND SERVICE COMMERCIAL" USE AND
THE " SINGLE- FAMILYDETACHED" RESIDENTIAL USE.
(LCP Amendment No. 45)
WHEREAS, the Coastal Act of 1976 requires the City of Newport to prepare a Local
Coastal Program; and
WHEREAS, as part of the development and implementation of the Coastal Act, a Local
Coastal Program Land Use Plan has been prepared; and
WHEREAS, said Land Use Plan sets forth objectives and supporting policies which serve
as a guide for future development in coastal areas of the City of Newport Beach; and
WHEREAS, the Planning Commission has held a duly noticed public hearing to consider a
certain amendment to the Land Use Plan Map of the Newport Beach Local Coastal Program; and
WHEREAS, in conjunction with the consideration of the above referenced amendment to
the Land Use Plan Map of the Local Coastal Program, it has been determined to be Categorically
Exempt from the provisions of the California Environmental Quality Act (CEQA) under Class 5
(Minor Alteration in Land Use), inasmuch as the proposed boundary changes are consistent with
the exchange of land made in conjunction with the approval of Resubdivision No. 1019 and also
requires an adjustment of the zoning district boundary.
NOW, THEREFORE BE IT RESOLVED, by Planning Commission of the City of
Newport Beach that Local Coastal Program Amendment No. 45 to the Land Use Plan Map, is
recommended to the City Council for approval as follows:
That the properties located at 3901 East Coast Highway and 352 Hazel Drive, more
particularly described as Parcels No. 1, 2 and 3 of Parcel Map No. 95 -178
( Resubdivision No. 1019), located on the northeasterly corner of East Coast
Highway and Hazel Drive, the boundary is to altered between the "RETAIL AND
SERVICE COMMERCIAL" use and the "SINGLE- FAMILY DETACHED"
residential use.
