A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF NEWPORT BEACH APPROVING OFF -SITE
PARKING AGREEMENT NO. 2001 -001 FOR PROPERTIES
LOCATED AT 312 BUENA VISTA BLVD. & 604 W. BAY
AVE. (PA2001 -146).
The Planning Commission of the City of Newport Beach does hereby find, resolve and order as
follows:
Section 1. An application was duly filed by the applicant, Pat Collins with respect to
property located at 312 Buena Vista Blvd. & 604 W. Bay Ave. (PA2001 -146) and legally
described as Lot 128, 129, 130 & 162 of the "Subdivision of Block A, East Newport," requesting
approval of Off -Site Parking Agreement No. 2001 -001 to provide parking for a single fair.".}
residence at an off -site location. Both the properties involved in the project are zoned R -1
(Single - Family Residential).
Section 2. A public hearing was duly held on September 20, 2001 and October 4,
2001, at 6:30 P.M. in the City Hall Council Chambers, 3300 Newport Boulevard, Newport
Beach, California. A notice of time, place and purpose of the aforesaid meeting was duly given.
Evidence, both written and oral, was duly presented to and considered by the Planning
Commission at the aforesaid meeting.
Section 3. The Planning Commission finds as follows:
a) That the proposed project is consistent with the General Plan as it involves two
single - family dwellings each located on a separate lot, which are permitted uses within the Single -
Family Detached residential designation.
b) The project, including the anticipated addition to 312 Buena Vista, the
redevelopment of 604 W. Bay Avenue and the off -site parking agreement qualifies for a
categorically exemption pursuant to Section 1530' ) (Class 3, New Construction or Conversion of
Small Structures) of the California Environmental Quality Act Implementing Guidelines.
C) Due to the location and proximity of the off -site parking area to the recipient
residence, the off -site parking will prove useful to the residence use of 312 Buena Vista Avenue.
Two new off - street parking spaces will be provided, which improves area parking.
d) Due to the minimal amount of traffic generated by a single detached home and the
proximity of the use and off -site parking, no increased traffic hazard will result with the approval of
the requested off -site parking agreement.
e) A condition of approval requiring the recordation of an off -site parking agreement.
to the satisfaction of the City Attorney, will ensure that the off -site parking spaces will be available
on 604 W. Bay Avenue for the benefit of 312 Buena Vista at all times as long as 312 Buena Vista is
deficient in parking.

Section 4. Based on the aforementioned findings, the Planning Commission hereby
approves Off -Site Parking Agreement No. 2001 -001, subject to the Conditions set forth in Exhibit
"A" attached.
Section 5. This action shall become final and effective fourteen days after the adoption
of this Resolution unless within such time an appeal is filed with the City Clerk or this action is call
for review by the City Council in accordance with the provisions of Title 20, Planning and Zoning,
of the Newport Beach Municipal Code.

EXHIBIT "A"
CONDITIONS OF APPROVAL
Off -Site Parking Agreement No. 2001 -001
1. Two parking spaces shall be provided on 604 W. Bay Ave. for the exclusive benefit of 312
Buena Vista Blvd. The two spaces on 604 W. Bay Avenue, shall be covered, accessible and
available to the occupant at all times free of charge. These spaces shall be available prior to
the issuance of any building permit for an addition to 312 Buena Vista Blvd.
2. The off-site parking agreement shall be approved by the City Attorney's office and shall be
recorded on the title of both properties (3 12 Buena Vista & 604 W. Bay Avenue). Prior to
the issuance of a building permit for any addition to 312 Buena Vista Blvd. Owners shall
provide proof of recordation of the off -site parking agreement and a title commitment dated
after the date of recordation showing the agreement being recorded prior to any financing on
either property and/or that any existing mortgage has agreed to such subordination.
3. This approval for Off -Site Parking Agreement No. 2001 -001 shall expire unless exercised
within 24 months from the date of approval as specified in Section 20.80.090A of the
Newport Beach Municipal Code.
4. Changes or alterations to the location and type of parking spaces (covered, garage or open)
located on 604 W. Bay Avenue may be authorized by the Planning Director. Said changes
shall meet all applicable Municipal Code requirements and applicable Public Works
Department design standards.
