I. CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Jaime Murillo, Zoning Administrator Patrick Achis, Assistant Planner Melinda Whelan, Assistant Planner II. REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF APRIL 14, 2022 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 2 Ravera Residential Condominiums Tentative Parcel Map No. NP2022-003 (PA2022-013) Site Location: 709 Marigold Avenue Council District 6 Jaime Murillo, Zoning Administrator provided a brief project description stating that this request for a tentative parcel map for two-unit condominium purposes. A duplex has been demolished and a new duplex is under construction. No waivers of Title 19 (Subdivisions) are proposed. The Tentative Parcel Map would allow each unit to be sold individually. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved ITEM NO. 3 Joey's Restaurant Lot Line Adjustment No. LA2021-001 (PA2021-302) Site Location: 451, 453 and 455 Newport Center Drive Council District 5 Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a lot line adjustment to accommodate the approved outdoor dining patio for Joey’s restaurant. The subject property is developed as a three-restaurant pad and the proposed lot line adjustment will also true-up the lot lines around the entire building. Assistant Planner Whelan added that there was a typographical error with a missing clause under the Decision section of the Resolution that was inadvertently left out and has been inserted. Applicant Brandon Mucha of the Irvine Company stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved as Amended MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 04/28/2022 Page 2 of 2 ITEM NO. 4 Mochinut Minor Use Permit No. UP2021-007 and Coastal Development Permit No. CD2021-009 (PA2021-031) Site Location: 200 Main Street and 804 East Balboa Boulevard Council District 1 Patrick Achis, Assistant Planner, provided a brief project description stating that the request is a minor use permit and coastal development permit to allow the operation of a 784-square-foot restaurant with 300 square feet of customer area (food service, no late hours). Alcohol service and/or late hours (after 11:00 p.m.) are not proposed. The project requires no additional parking pursuant to Newport Beach Municipal Code (NBMC) Sections 20.28.030 and 21.28.030 (Parking Management [PM] Overlay District). The project compiles with the General Plan, Zoning, and development standards, and no deviations are requested. The project does not inhibit coastal public access, nor does it interfere with public coastal views. The Zoning Administrator clarified the project’s compliance with the parking management overlay. The resolution makes the findings that there is adequate parking based on the Nelson Nygaard study prepared in May 2012. The Zoning Administrator directed that Fact in Support of Finding B.4 be revised to state that the restaurant is expected to generate a significant amount of walk-in traffic from residents and visitors already in the area during the peak summer months. Mr. Achis clarified the hours of operation will be 9 a.m. to 10 p.m. and acknowledged a scrivener's’ error in the staff report. Applicant Phylicia Bayona, on behalf of the Optima Group, stated that she had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Mr. Achis noted that a comment was received by a member of the public Robert Duff. Staff clarified that Mr. Duff’s comments would be addressed by the project to the extent that there is no outdoor music, patio music, no seating or chair on the sidewalk and no excess outside lighting. Action: Approved as Amended V. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. VI. ADJOURNMENT The hearing was adjourned at 10:12 a.m. The agenda for the Zoning Administrator Hearing was posted on April 22, 2022, at 10:40 a.m. on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City’s website on April 22, 2022, at 10:30 a.m. Jaime Murillo Zoning Administrator
