The following documentation is required to complete the application: 1. Project Description Current project description describes the application as 1) an upgrade to the ABC license and 2) an increase in hours of operation. There is no description of the permanent outdoor dining area expansion (expanded area currently authorized under Emergency Temporary Use Permit no. UP2020-174 (PA2020-107) and scheduled to expire on September 6, 2021). The project description shall be revised to incorporate all proposed changes including: a. State the change in hours i.e. originally authorized until 9p.m., requesting 10p.m. closing time. b. The requested increase in outdoor dining area i.e. from 156 square feet to 516 square feet. c. Operational characteristics of the patio and any mitigation (i.e. no alcohol on the patio beyond 9p.m., etc.) to shield adjacent residential uses from noise. d. Any other proposed changes not authorized by Amendment No. 1 to Use Permit no. UP2008-056. 2. Project Plans a) The project plans do not call out indoor net public area or outdoor net public area. Please add both items to floor plan and hatching to depict what is being included in net public area. Page 2 b) The project plans do not show the tables or chairs on the floor plan. Please add the seating arrangement to both the indoor net public area and outdoor dining area. c) Please provide a trash enclosure as required by 20.30.120 Solid Waste and Recyclable Materials Storage. d) Parking Summary Tabulation Please add a parking summary table to the plan set i.e. 1 space required per 40 square feet of net public area (625 + 516 = 1,141 sq. ft.), X amount of on-site parking spaces required, and Y amount of on-site parking spaces provided 3. Off Site Parking The expanded outdoor dining area exceeds 25% of the interior net public and therefore must be parked. Per our zoom meeting, Wild Taco proposes to utilize off-site at 409-413 31st Street. Please provide more information describing the adjacent site i.e. how many parking spaces are provided, what businesses operate at 409-413 31st Street and their hours of operation. This information can be added to the project description. A site plan showing 409-413 31st Street should be included in the resubmittal. 4. Additional Application Required The off-site parking agreement can only be approved through a Conditional Use Permit. Furthermore, the expanded outdoor dining area provides additional seating and is an intensification in use. The property is located within the Coastal Zone and a Coastal Development Permit (CDP) is required for the intensification in use. Additional fees will be required to amend the application from a MUP to a CUP and to process the CDP. Public noticing materials will need to be updated to satisfy the CDP requirements. Please see the attached sheets for more information. 5. Miscellaneous A Project Review Request has been routed to the Code Enforcement division for feedback. It will be provided to you upon its completion. Upon verification of completion, the application will be processed and scheduled for a Planning Commission Hearing. Please be advised that the items are required to be no older than 6 months utilizing names and addresses from the last equalized assessment roll and utilizing the most recent assessor’s maps or alternatively, from such other records that contain more recent information. Mailing Labels For Applications that do not include a Coastal Development Permit 2 (two) sets and 1 (one) copy of Mailing Labels shall be printed on Avery 5160 address labels (or equivalent to) and contain the parcel numbers, names, and mailing addresses for all owners of property located within a 300-foot radius, excluding intervening right-of-ways and waterways, of the exterior boundaries of the subject parcel. For Applications that include a Coastal Development Permit 2 (two) sets and 1 (one) copy of Mailing Labels shall be printed on Avery 5160 address labels (or equivalent to) and contain the parcel numbers, names, and mailing addresses for all property owners (residential and nonresidential) and occupants (residential only) of property located within a 300-foot radius, excluding intervening right-of-ways and waterways, of the exterior boundaries of the subject parcel. The radius line and subject property shall be indicated on the map. See Attachment B (Radius Map Example). Fee A fee is required at the time of filing to partially defray the cost of processing and other expenses. The Planning Department will advise you of said fee.
