HomeMy WebLinkAbout10 - Amendment to Municipal Code Chapter 14.16, Water Conservation and Water Supply Shortage Program - Public HearingA�� r s ^ti,r�p,N+� CITY OF NEWPORT BEACH NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that on Tuesday, May 24, 2022, at 4:00 p.m., or soon thereafter as the matter shall be heard, a public hearing will be conducted in the City Council Chambers at 100 Civic Center Drive, Newport Beach. The City Council of the City of Newport Beach will consider the following application: UPDATED MUNICIPAL CODE 14.16 WATER CONSERVATION ORDINANCE — The City is in the process of updating the water conservation ordinance as originally planned. Initial feedback was received at the November 30, 2021 City Council Study Session. The new ordinance is recommended to be titled as the Water Conservation and Water Supply Shortage Program. The updated ordinance meets state requirements detailed in the adopted Water Shortage Contingency Plan and Urban Water Management Plan which was adopted on June 8, 2021. Updates to the ordinance include: new permanent restriction of no landscaping watering between 9:00 a.m. and 5:00 p.m.; six water supply shortage levels; removing 2013 as the baseline water use year; and updating the procedure for determination, declaration, notification and implementation for a water supply shortage. We encourage our customers and residents to review the draft ordinance. The draft Municipal Code 14.16 Water Conservation Ordinance and Water Supply Shortage Program will be available for public review with the agenda packet on the evening of Thursday, May 19, 2022. NOTICE IS HEREBY FURTHER GIVEN that this action is not subject to the California Environmental Quality Act ("CEQA") pursuant to Section 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. All interested parties may appear and present testimony in regard to the report. Prior to the public hearing, the agenda staff report, may be reviewed at the City Clerk's Office, at 100 Civic Center Drive, Newport Beach, California, 92660 or at the City of Newport Beach website at www.newportbeachca.gov. Individuals not able to attend the meeting may contact the Utilities Division or access the City's website after the meeting to review the action on this item.
