To be eligible for FY 2022-23 funding, the City of Newport Beach (City) must submit a resolution documenting the approval of the City's project list to the California Transportation Commission (CTC) by July 1, 2022. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2022-41, A Resolution of the City Council of the City of Newport Beach, California, Adopting a List of Projects for Fiscal Year 2022- 23 Funded by SB 1, The Road Repair and Accountability Act of 2017. DISCUSSION: The City receives transportation funding from the State of California in the form of grants or a direct allocation of Motor Vehicle Fuel Tax (Gas Tax) funds through the Highway Users Tax Account (HUTA). It is estimated that the City will receive approximately $1,901,405 in FY 2022-23 from RMRA funding. To be eligible for this funding, the City must submit a resolution that identifies all proposed projects that may be funded with RMRA funding to the CTC by July 1, 2022. 10-1 Resolution No. 2022-41: Specifying Uses for FY2022-23 RMRA Funding from the Road Repair and Accountability Act of 2017 June 14, 2022 Page 2 RMRA local streets and roads allocations must be used for projects that include, but are not limited to, the following: • Road maintenance and rehabilitation • Safety projects • Railroad grade separations • Traffic control devices • Complete street components, (including active transportation purposes, pedestrian and bicycle safety projects, transit facilities, and drainage and storm - water capture projects in conjunction with any other allowable project) • Match requirement to obtain state or federal funds for eligible projects Staff recommends the use of RMRA funding to partially fund the following projects; 1.
