HomeMy WebLinkAbout1447 - RECOMMEND APPROVAL OF CA_ DISTRICTING MAP NO. 10_RE-ZONE PROPERTY_R-3 DISTRICT TO R-1 DISTRICTRESOLUTIONNO. 1447 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH RECOMMENDING APPROVAL TO THE CITY COUNCIL AN AMENDMENT AMENDING A PORTION OF DISTRICTINGMAP NO. 10 REZONING THE PROPERTY FROM THE R -3 DISTRICT TO THE R -1 DISTRICT (PLANNING COMMISSION AMENDMENT NO. 857) WHEREAS, as part of the development and implementation of the Newport Beach General Plan the Land Use Element has been prepared; and WHEREAS, Section 20.84.010 of the Municipal Code of the City of Newport Beach provides that Title 20 (the Zoning Code) may be amended by changing the zoning designation of Districts and other provisions whenever the public necessity and convenience and the public welfare require such amendment; and WHEREAS, the Planning Commission has conducted a public hearing on December 5, 1996, at which time this amendment to rezone the property from the R -3 District to the R -1 District and to consider Amendment No. 857 amending a portion of Districting Map 10 were discussed and determined to be in conformance with the proposed changes to the Newport Beach General Plan; and WHEREAS, the Planning Commission has recommended to the City Council the adoption of General Plan Amendment No. 95 -1(E) and Local Coastal Program Amendment No. 40 so to redesignate the subject property from "Governmental, Educational and Institutional Facilities" to "Single Family Residential "; and WHEREAS, land use decisions are legally required to be consistent with the City's General Plan and Zoning; and WHEREAS, the City of Newport Beach has determined that the proposed amendment is exempt under Class 5 (minor changes in land use limitations), from the California Environmental Quality Act (CEQA) and the State CEQA Guidelines; and WHEREAS, the Planning Commission desires to recommend that the City Council approve Amendment No. 857 to Title 20 of the Newport Beach Municipal Code amending Districting Map No. 10. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Newport Beach does hereby recommend that the City Council approve Amendment No. 857, to amend Title 20 to the Newport Beach Municipal Code, rezoning the subject property from the R -3 District to the R -1 District and amending a portion of DistrictingMap No. 10 as follows: That the property located in the 500 Block of West Balboa Boulevard, between 5th Street and 6th Street on the southerly side of West Balboa Boulevard (515 West Balboa Boulevard), more particularly described as, Lots 10 -13 of Block 10 of East Newport Tract be reclassified from the R -3 District to the R -1 District and that portion of Districting Map No. 10 be amended accordingly.
