A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
NEWPORT BEACH RECOMMENDING DENIAL TO THE CITY COUNCIL OF
A GENERAL PLAN LAND USE ELEMENT AMENDMENT, LOCAL COASTAL
PROGRAM LAND USE PLAN AMENDMENT, AN AMENDMENT TO DISTRICTING
MAP #4, A RESUBDIVISION, A SUBDIVISION EXCEPTION AND A COASTAL
RESIDENTIAL DEVELOPMENT PERMIT INVOLVING PROPERTIES AT 3312 -3336
VIA LIDO [GPA 97- 3A/LCP 48 /AMENDMENT 868/RESUBDIVISION 1033 /CRDP 231
WHEREAS, the proposed land use amendments are inconsistent with goals and policies
of the Land Use Element of the General Plan and the Local Coastal Program Land Use Plan, for the
following reasons:
• The proposed amendment would result in the loss of property suitable for visitor -
serving and commercial recreational uses.
• The proposed amendment, by allowing residential development adjacent to
commercial property, would severely limit the ability of the surrounding commercial
properties to provide visitor - serving and commercial recreation uses.
• The proposed land use change from a commercial to a residential land use
designation would limit opportunities to provide lateral and vertical bayfront access
on the subject properties and preclude opportunities to provide bayfront access in the
form of waterfront commercial land uses.
• The proposed residential development allocation of four single family detached
dwelling units on the 3336 Via Lido property would result in the loss of four on-
street parking spaces which conflicts with coastal area policies which requires the
City to maximize on- street parking.
WHEREAS, the proposed project would be detrimental to the health, safety, peace, morals,
comfort, and general welfare of persons residing in the neighborhood and be detrimental to the
general welfare of the City, for the following reasons:
The amendment presents land use conflicts by placing residential uses adjacent to
commercial and institutional land uses which has the potential to subject future
residents to the noise, traffic, parking, odor, visual quality, lighting and glare and
other negative impacts.
The proposed amendment would severely limit the type and character of commercial
land uses that can be conducted on the adjacent commercial and institutional
properties.

• The proposed subdivision of the 3336 Via Lido property of four single family
detached dwelling units on the would result in the loss of four on- street parking
spaces which would negatively impact adjacent commercial properties.
• The proposed subdivision of the 3336 Via Lido property would result in
development which would necessitate that vehicles to back out onto Via Lido. This
condition would result in reduced visibility of pedestrians on the sidewalk and of
traffic on Via Lido and expose vehicles to oncoming traffic for much longer periods
of time.
WHEREAS, the proposed subdivision of the 3336 Via Lido property would create lots
which do not comply with the minimum lot width and lot area requirements specified by Section
20.05.030 of the Zoning Code and Section 19.20.110 (A) of the Subdivision Code and that the
subject property does not process unusual topographic conditions, curved or cul -de -sac streets, nor
any other characteristics that would constitute the special conditions required in order to grant an
exception to these development standards; and
WHEREAS, on February 5, 1998, Planning Commission of the City of Newport Beach
held public hearings regarding General Plan Amendment 97 -3A, Local Coastal Program Amendment 48,
Amendment 868, Resubdivision 1033, and Coastal Residential Development Permit 23; and
WHEREAS, the public was duly noticed of the public hearing; and
WHEREAS, pursuant to the California Environmental Quality Act, it has been determined
that the proposed amendment is categorically exempt under Class 5, minor alterations in land use
limitations.
NOW THEREFORE BE IT RESOLVED, that the Planning Commission of the City of
Newport Beach does hereby recommend that the City Council of the City of Newport Beach deny
General Plan Amendment 97 -3A, Local Coastal Program Amendment 48, Amendment 868, Resubdivision
1033, and Coastal Residential Development Permit 23.
