A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF NEWPORT BEACH RECOMMENDING TO
THE CITY COUNCIL APPROVAL OF AN AMENDMENT
TO TITLE 20 OF THE NEWPORT BEACH MUNICIPAL
CODE TO PROHIBIT RESIDENTIAL CONDOMINIUM
PROJECTS AND CONVERSIONS ON BALBOA ISLAND
AND LITTLE BALBOA ISLAND
(PLANNING COMMISSION AMENDMENT NO. 853)
WHEREAS, Title 20, Chapter 20.84, of the Newport Beach Municipal Code
authorizes the City Council to adopt a resolution initiating amendments to the Zoning Ordinance
of the City of Newport Beach; and
WHEREAS, the City has concern that the conversion of existing dwelling units
in the R -1.5 District to condominiums is not consistent with the lot sizes and historic pattern of
development in the district. For the most part, development has consisted of one primary
dwelling unit on a parcel, with the addition of a small apartment unit on some parcels. This
pattern is well suited to the lot sizes in the R -1.5 District, which are smaller than in other areas of
the City. In this environment, the conversion of residential units to condominiums has the
potential to increase the intensity of use in the district by converting units designed for accessory
or occasional use to primary units under separate ownership. This intensity of use is beyond that
which the district can accommodate without adverse impacts. Of particular concern is the ability
to convert properties that do not have the number of parking spaces required for new residential
development under current regulations, and the resulting impact on the surrounding
neighborhood when residential use is intensified through conversion to condominium ownership.
Balboa Island, on which all of the R -1.5 District is located, is an isolated area of the City, which
is unique in its lack of any off - street public parking, and increased parking demand to support
intensified residential use must be addressed by modifying the condominium conversion
regulations; and
WHEREAS, the City Council has initiated an amendment to Chapter 20.83 of Title 20 of
the City of Newport Beach Municipal Code to prohibit condominiums and condominium
conversion projects in the R -1.5 District.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Newport Beach does hereby recommend that the City Council approve Amendment
No. 853, an amendment to Section 20.83.015 of Title 20 of the Newport Beach Municipal Code
to read as follows:
20.83.015 Required Approvals
A. Condominium projects may be permitted in any district in which residential uses
are permitted, including planned communities, except within the R -1.5 District
(Balboa Island). In planned community districts, residential developments,
residential developments, all or part of which have been specifically designated as
condominium projects on the approved planned community development plan,
shall be permitted in accordance with the provisions of said plan.
B. Condominium conversions shall be similarly permitted in any district in which
residential uses are permitted, except within the R -1.5 District (Balboa Island),
subject to securing a modifications permit in accordance with the provisions of
Chapter 20.93.
C. The approval of a tentative and final tract map or parcel map shall be required for
all new condominium projects in accordance with Title 19 of the Municipal Code.
D. The approval of a tentative and final tract map or parcel map shall be required for
all new condominium projects, and for condominium conversion projects
containing 5 or more units in accordance with Title 19, of the Newport Beach
Municipal Code.
E. No persons shall construct a new condominium development, or convert an
existing residential use to a condominium, within the City of Newport Beach
without first complying with the provisions of this chapter. If it is determined

that a parcel map or tentative map and final map is required for a condominium
conversion, the map shall not be required to be filed until a modification permit
has been approved in accordance with the provisions of Section 20.83.015. This
however, shall not preclude the concurrent processing of the map and the
modification permit.
