A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF NEWPORT BEACH RECOMMENDING APPROVAL
TO THE CITY COUNCIL OF AN AMENDMENT TO TITLE 20
OF THE MUNICIPAL CODE TO REVISE PROPERTY
DEVELOPMENT REGULATIONS RELATING TO THE
MAXIMUM GROSS FLOOR AREA LIMITS AND OFF - STREET
PARKING REQUIREMENTS IN THE R -1.5 DISTRICT
[AMENDMENT 866]
WHEREAS, the proposed amendment will encourage the development of enclosed parking
on properties in the R -1.5 District; and
WHEREAS, the development of enclosed parking will provide increased security and safety,
and improve the visual quality of properties in the R -1.5 District; and
WHEREAS, on December 4, 1997, Planning Commission of the City of Newport Beach
held public hearings regarding Amendment 866; and
WHEREAS, the public was duly noticed of the public hearing; and
WHEREAS, pursuant to the California Environmental Quality Act, it has been determined
that the proposed amendment is categorically exempt under Class 5, minor alterations in land use
limitations.
NOW THEREFORE BE IT RESOLVED, that the Planning Commission of the City of
Newport Beach does hereby recommend that the City Council of the City of Newport Beach
approve Amendment No. 866 to revise Title 20 of the Municipal Code to read as provided in
Exhibit "A."
BE IT FURTHER RESOLVED, that the Planning Commission of the City of Newport
Beach does hereby recommend that the City Council of the City of Newport Beach revise Title
20 of the Municipal Code to allow minor alterations to structures made nonconforming by this
amendment.

Section 20.03.030:

Parking Space: An unobstructed space or area other than a street or alley that is permanently
reserved, maintained, and accessible for the parking of 1 motor vehicle.
Parking Space, Covered: A building or portion of a building, open or enclosed by walls or doors
on not more than two sides, that is designed or used to shelter a parking space
Parking Space, Enclosed: A building or portion of a building, completely enclosed by walls or
doors on three or more sides, that is designed or used to shelter a parking space.
Parking Space, Tandem: A parking space within a group of 2 or more parking spaces arranged
one behind the other.
Section 20.62.060 (A -3):
3. Covered and =Enclosed Parking. Residential development having less than
the required number of covered or enclosed parking spaces, alteration of
the structure may be permitted only upon the approval of a modification
permit.
Section 20.10.030 (Additional Reeulation M):
(M) R -1, R -1.5, and R -2 Districts. The total gross floor area in all buildings and structures on
a development site shall not exceed the following:
R -1 District: 2 times the buildable area of the site.
R -1.5 District: 1.5 times the buildable area of the site.
R -2 District: 2 times the buildable area of the site.
Exceptions. The following structures shall not be included in the calculation of
the gross floor area:
1. Covered parking spaces which are open on at least 2 sides, or open on one
side and one end and which are not needed to meet off - street parking
requirements for covered parking.
I R -1.5 District. 200 square feet of floor area used for enclosed parking .for
two or more parking spaces.
2-1 25 square feet of storage area adjacent to or a part of a parking space on
a lot less than 32 feet wide; provided that no plumbing is located in said
area, and provided that 3 parking spaces are provided side by side across
one end of the lot.
3. Decks, balconies or patios open on at least 2 sides or open on one side and
uncovered.

Section 20.66.040 (B):
B. General Controls. The following parking controls shall apply in residential
districts:
1. For each dwelling unit there shall be at least I covered parking space.
2. Tandem parking up to a maximum of 2 cars in depth shall be permitted.
3. Parking in side yards shall be permitted; provided, however, that structural
encroachments shall not be permitted, except provided in Section
20.60.030.
4. Parking in front yards shall be permitted on driveways in front of garages
that set back at least 19 feet from the front property line; provided,
however, that structural encroachments shall not be permitted.
5. Covered parking spaces located on the front one -half of a lot shall have
side walls and an operating garage door for access of automobiles.

6. Parking of automobiles on the roof of a building in any residential district
is not allowed.
74. Parking or storage of trailers, campers, boats, motorcycles or motor
vehicles shall not be allowed on vacant lots.
