RESOLUTION NO. 96- 1432
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF NEWPORT BEACH RECOMMENDING TO THE
CITY COUNCIL THE APPROVAL OF GENERAL PLAN
AMENDMENTNO. 96- 1 (C) AMENDING THE LAND USE MAP
OF THE NEWPORT BEACH GENERAL PLAN SO AS TO ALTER
THE BOUNDARY BETWEEN THE "RETAIL AND SERVICE COMMERCIAL"
USE AND THE " SINGLE- FAMILYDETACHED" RESIDENTIAL USE.
[GPA No. 96 -1(C)]
WHEREAS, as part of the development and implementation of the City's General Plan, the
Land Use Element has been prepared; and
WHEREAS, said element of the General Plan sets forth objectives and supporting policies
which serve as a guide for future development of the City of Newport Beach; and
WHEREAS, the Land Use Map designates the general distribution and general location
and extent of the uses of land and building intensities in a number of ways, including residential
land use categories and population projections, commercial floor area limitations, and the floor
area ratio ordinances; and
WHEREAS, pursuant to Section 707 of the Charter of the City of Newport Beach, the
Planning Commission has held a duly noticed public hearing to consider a certain amendment to
the above referenced Newport Beach General Plan Land Use Map; and
WHEREAS, in conjunction with the consideration of the above referenced amendment to
the Land Use Map of the General Plan, the project has been determined to be Categorically Exempt
from the provisions of the California Environmental Quality Act (CEQA) under Class 5 (Minor
Alteration in Land Use), inasmuch as the proposed changes are consistent with the exchange of
land made in conjunction with the approval of Resubdivision No. 1019 and also requires an
adjustment of the zoning district boundary.
NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of
Newport Beach that General Plan Amendment No. 96 -1(C) is recommended to the City Council for
approval as follows:
That the properties located at 3901 East Coast Highway and 352 Hazel Drive, more
particularly described as Parcels No. 1, 2 and 3 of Parcel Map No. 95 -178
( Resubdivision No. 1019), located on the northeasterly comer of East Coast
Highway and Hazel Drive, the boundary is to altered between the "RETAIL AND
SERVICE COMMERCIAL" use and the "SINGLE- FAMILY DETACHED"
residential use.
