13) ADJOURNMENT
This Board of Library Trustees is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the Board of Library
Trustees agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on
agenda items before the Board of Library Trustees and items not on the agenda but are within the subject matter jurisdiction of the Board of
Library Trustees. The Board of Library Trustees may limit public comments to a reasonable amount of time, generally three (3) minutes per
person.

The agenda for the Regular Meeting was posted on Thursday, October 3, 2013, at 3:35 p.m. on the
City's website; at 2:47 p.m. on the City Hall Electronic Bulletin Board located in the entrance of the City
Council Chambers at 100 Civic Center Drive; and at 11:46 p.m. in the Meeting Agenda Binder located in
the entrance of the City Council Chambers at 100 Civic Center Drive.

3) PUBLIC COMMENTS ON AGENDA ITEMS
Prior to this meeting Jim Mosher emailed seven pages of type-written remarks on nine agenda items.
He asked that the Consent Calendar agenda item A.1. Customer Comments, be pulled for separate
discussion, and that he be allowed to comment after the agenda item C.5. Update on Library
Services Director Recruitment report has been made.
Chair Johnson-Tucker thanked him for his comments and noted that he would be allowed to comment
as requested.

4) APPROVAL OF MINUTES – October 7, 2013 Regular Meeting.
It was moved, seconded and passed (Trustee Grant/Trustee Prichard) to approve the minutes from
the Monday, October 7, 2013 Board of Library Trustees meeting as amended: Page 3 – Paragraph 2 –
“Currant” should be revised to “Current.” Motion carried by all Board of Library Trustees present.
C. MONTHLY REPORTS
5. Update on Library Services Director Recruitment – Chair Johnson-Tucker moved this item to this
portion of the meeting in order to allow Rebecca Redyk, Human Resources Supervisor time to give
her update so that she would be able to attend another City meeting that also began at 5:00 p.m.
Additional copies of the brochure for this recruitment were made available at this meeting. The
deadline for receiving applications for this recruitment was October 27. A total of 74 applications
were received which included seasoned professionals as well as up and coming professionals.
Recruiter Teri Black has begun to meet with the applicants for screening interviews. As of this
morning 16 community surveys have been received through the Library’s website. The initially
proposed timeline for the recruitment has not changed. Chair Johnson-Tucker asked if the
Foundation and Friends of the Library chairs have been contacted by Teri Black. Trustee Grant
asked if the City Arts Commission will be consulted for their input. Rebecca will check into this with
the recruiter and report back.
Jim Mosher stated that the recruitment for a new Library Services Director should have allowed the
Board to rethink the purpose and future of the Library and that he felt that this opportunity was lost.
He stated that he was surprised that the process has moved so rapidly. He expressed that the last
page of the brochure that was scanned and published online for the October 7 Library Board of
Trustees meeting was difficult to read. He also expressed his concern that the public had lost the
opportunity to be able to provide their input into the selection process if interviews were closed to the
public.
B. ITEMS FOR REVIEW AND POSSIBLE ACTION
3. Arts and Cultural Update – Chair Johnson-Tucker moved this item forward. The City Arts
Commission Chair Rita Goldberg reported that the attendance at the City Arts Commission events
have been the highest ever with over 2,000 attendees at the Concerts in the Park, Shakespeare by
the Sea and the Newport Beach Art Foundation’s Art in the Park event. She attributes this to the new
Civic Center Green venue and hopes to continue holding future events in that location. The outdoor
Sculpture Garden and appointment of a coordinator for this endeavor is forthcoming. City Council
has approved initial funding of $125,000 for this project. The upcoming events for 2014 include the
museum tour to LACMA, the Newport Beach Art Exhibition and Sale juried art exhibit that will be held
at the Civic Center, Shakespeare by the Sea, and summer concerts. The granting process was also
noted in which the Commission allocates funding to various art related organizations. Prior to Rita
exiting the meeting the Board thanked her for her report and work with the City Arts Commission.
5) CURRENT BUSINESS

It was moved, seconded and passed (Trustee King/Trustee Palk) to approve the Consent Calendar
Items as presented with the exception of Customer Comments. Motion carried by all Trustees present.
Melissa Kelly noted that the curbside book drop on Avocado Avenue will be brought back after planned
roadwork is completed by the Public Works Department. The area will include an area for cars to turn
into in order to not impede traffic.
Customer comment 5 regarding the Central Library lobby staircase and ways in which it could be made
safer to help prevent falls, and comment 6 regarding customers viewing graphic images on the public
computers were discussed. Staff explained the current procedures for handling the computer viewing
issue. The Board asked staff to consult with the City Attorney on this topic and report back to the Board
at their December meeting. Staff noted that they would discuss with Public Works and the architects
ways in which to resolve the stair safety issue.
Mr. Mosher noted that he felt that descending the stairs is a problem. He noted that putting comment 6
on the next meeting agenda was good in order to further discuss this subject. He felt that the request on
comment 7 to rotate the DVD collection among the other library locations was a good one, and
suggested doing so with other library materials.
Elizabeth Stahr noted that the library has more computers closer together now and that this may cause
customers to be more aware of what others are doing on the computers.
It was moved, seconded and passed (Trustee Grant/Trustee Prichard) to approve the Customer
Comment Consent Calendar Item with a follow-up on the staircase lighting issue and also from the City
Attorney on viewing graphic images on the public computers. Motion carried by all Trustees present.
B. ITEMS FOR REVIEW AND POSSIBLE ACTION
1. Review of Library Expansion Donor Wall Naming / NBPL Foundation – Executive Director Tracy
Keys noted that the Foundation has received a $100,000 gift for the naming of one of the nine
designated areas in the Central Library expansion areas. Once the new Library Director is appointed
the Foundation will work directly with that individual to meet and confer with potential donors.
Trustee King thanked the Foundation for their efforts in obtaining donations. General events have
been well received and attended. Both fundraising and membership are going well.
2. Library Material Selection – Reference Librarians Steven Short and Melissa Hartson gave an
overview on the policies and practices associated with library material selection. Some of the
subjects covered were the process of selection using borrowing patterns, circulation statistical
reports, and media reviews. Also budget, vendors, ordering criteria, interlibrary loans, downloadable
formats, and criteria for weeding were explained and discussed. Selection is based on merit, the
value it brings to our collection, and in meeting the needs of the community. The Board thanked
them for their reports prior to them leaving this meeting.
Donation and Gift Acceptance Procedure – Tim Hetherton explained that staff wishes to conform
to City Policy in the acceptance of donations and gifts to the Library. The question is whether or not
the Board of Library Trustees wishes to have the gift amount brought to them for approval before

acceptance of the gift may be made. Currently gifts of $10,000 and under are sent to the City
Manager for approval, and gifts over that amount are sent through City Council for approval.
However, the City Manager can accept gifts up to $30,000 with City Council approving the allocation.
Gifts that do not come through the Friends of the Library or Foundation for $10,000 or under, may be
accepted and approved by the BLT at their next meeting. However, this may postpone the gift if the
next meeting is weeks away. Again, the question is, does the Board wish to approve these gifts prior
to being accepted and sent to the City Manager for approval?
Since the Foundation is a 501(c) 3 organization donors are urged to give directly to the Foundation.
Throughout the year a donor may give funds designated for a particular use. These gifts are
considered restricted donations and must be used for the specified area in which the donor indicates.
Annually, staff prepares wish lists to both the Friends and to the Foundation with funding amounts
specified for use in the Library wherever needed. The wish lists are presented to the Board of Library
Trustees for approval prior to being presented to the support group boards for approval. The funding
for these wish lists is provided through non-specified donations received through the Foundation and
through the Friends of the Library book sales. Staff then prepares a report to be presented to City
Council for final approval and allocation of the wish list funds.
A clearer procedure for identifying, accepting and approving donations and gifts needs to be
identified. Chair Johnson-Tucker asked the Trustees to familiarize themselves with the current Gift
and Donor Policy before the next meeting. The Board asked staff to prepare a report to clarify the
Gift and Donor Policy by amending it to include the approval of diminutive amounts in a timely
manner so as not to cause the donor to wait for approval prior to accepting the gift. This report will
be prepared and presented to the Board at their next December 2, 2013 meeting. Since the current
policy is so simply stated adding one sentence may be all that is needed to further clarify.
Mr. Mosher stated that the Board of Library Trustees has the power to accept gifts and donations,
subject to approval by City Council as outlined in the City Charter.
C. MONTHLY REPORTS
1. Library Services Director Report – Acting Library Services Director Hetherton noted that it has
been rewarding, and an honor and a privilege to serve as Acting Director no matter what the outcome
of the recruitment may be. The Bistro has received rave reviews after being in operation for one full
month. Programming has been successful, with a display of Sid Hoff’s memorabilia that was up for a
month, the Hilbert art collection will be on display until May 2014. SCORE, a nonprofit organization
that helps small businesses become successful gave a presentation on October 23, and they have
scheduled and will be presenting workshops in the Friends Meeting Room through July of 2014.
Many wish list items are being implemented and include new Zinio subscriptions and new online
databases that include Consumer Reports, Grove Art and AskART! IT will be equipping the Sound
Lab in the Media Center, and new book scanners will be installed soon at all 4 Library locations.
Trustee Palk reported that the carts located outside of the bookstore are difficult to get back into the
store over the threshold often taking two volunteers to move the cart. Within a day of Tim knowing
about this he had it fixed so volunteers can move carts back and forth with ease.
2. Friends of the Library Liaison Report – Trustee King attended the October Friends Board meeting
and gave an overview on agenda items that were discussed at their meeting which included the book
sale, the details of pricing, and sales attendance.
3. Library Foundation Liaison Report – Trustee Grant was unable to attend the last meeting. Tracy
sent the minutes from that meeting to keep her informed. She complimented the Foundation for their
dedication and tireless work. Tracy Keys gave an overview of some of the items discussed at the

most recent meeting which included the Media Center signage, outreach to schools, discussion of a
larger auditorium, and other ways to help promote the Library.
4. DSLS Liaison Report – Trustee Palk reported that the Zadie Smith event was well received and
attended. The speakers for the 2014 series include film critic Kenneth Turan, sports writer Rick
Reilly, journalist Frank Bruni, actress and playwright Anna Deavere Smith, and author Jonathan
Franzen. The next DSLS meeting will be held as a retreat. The last 2013 Library Live event will be
this week.

Mr. Mosher suggested the Board may want to revise their By-Laws to keep consistent with the agenda
format that is currently being used at the meetings. The Board should be concerned on the privacy and
the First Amendment. The Board may want to revise the expressive use area to include the area near
the entrance on the second floor.
Chair Johnson-Tucker collected the responses staff received from the Board on alternate meeting date
availability.
Trustee King noted the Concordia University’s Lecture / Reception event scheduled at the Central Library
Friday, November 22, 2013.

Great new addition. The set of new desks at the NE corner is situated directly under the AC vents.
These vents push very cold air directly onto the occupants. Need to assess relocating desks slightly
off the vents,
Melissa Kelly responded via email as follows: Thank you for taking the time to
complete our Library comment form. We are pleased to receive high marks from
you in many areas. Unfortunately the one issue that you brought up regarding the
placement of the new study tables is one that is difficult to remedy. The tables are
placed directly over the electrical outlets and there is not room to move them away
from the vents that were put in the ceiling. We have turned down the volume of
air that is coming from those vents, but since this building and the number of
occupants call for the continual circulation of fresh air, we cannot shut them down
altogether. There are other areas in the older part of the building that you might
find more comfortable. Thank you for using the Library.
Is the NB Library System planning to make Hoopla available to card holders in the near future?

time to contact us regarding Hoopla. We are researching Hoopla and other
services to see if they may be added to our downloadable collection. Please let
me know if I may be of further assistance in any way.
Tim Hetherton responded via email as follows: The Library is prohibited from
selling books from our collection directly to the public. Withdrawn books are sold
through the Friends of the Library book store. For the time being, the Library is
still obligated to make the book available to readers. There are holds on the book
which show that Library patrons are still interested in reading the book. The
Library will continue to review the merit of the work; the value of the work within
the collection; and the needs and interests of the community. The Library believes
that the use of Library materials is an individual and private matter. All patrons
are free to select or reject materials for themselves; they may not restrict the
freedom of others to read or inquire. Thank you.

Minutes as of tomorrow night. I am currently reading it now and it is checked out by me, the story
broke in LA Times yesterday. It doesn't even show up in the Amazon purchases anymore.

Can't download any information about the books authored by Tracy Chevalier.

Library card at no charge and use our services. We ask that you bring
identification with a photo and current address to any of the Newport Beach
Libraries in order to register for the card. Our Library cards are free to California
residents since we participate in the State's Reciprocal Borrowing program. We
welcome you to the Library.
I own property in Newport Beach (pay taxes etc.) but live in Costa Mesa. Can I join the Library?

you for taking the time to contact us. Are you attempting to locate our holdings of
print material for author Tracy Chevalier or any electronic versions of her books?
We carry her books both in the print and Book of CD formats, and have one title
Fallen Angel available as a downloadable audio book. Please let me know what
you are interested in and I will make sure to assist you further. Customer
responded via email as follows : Check your website for Tracy Chevalier and a
few other authors as to down loading a summary of the story. I repeatedly
received a message stating that 404, information not available in current format.

apologize for the difficulties you experienced with the error message. I was able
to check our catalog and see the basic summaries of the books without an error
so please let me know if you continue to encounter this obstacle. Our records do
not always provide a comprehensive summary but you may utilize our online
databases, Novelist and Literature Resource Center, for more information. You
may access these databases through our "Services" tab on the library home page,
then search by title, author, or other search terms. Novelist also provides a link to
our catalog to check availability of titles. Literature Resource Center provides
summaries, critiques, and reviews of many contemporary and classic books. The

A woman walked aimlessly in the Library with a chihuahua (dog) on a leash. Clearly not a "Service
Dog." What's next?
Tim Hetherton responded via email as follows: According the NBPL Use Policy
“Bringing animals into the facility except service animals such as guide dogs” is
prohibited. Library staff should have informed the customer about our policy
concerning dogs in the Library. From your comment, I am not sure if staff was
aware of the dog. It is also possible that the customer told staff that they were
using a service animal. Under the Americans with Disabilities Act, customers do
not have to show any proof that they are using a service animal, and the animal
does not have to wear a special harness or other identification. The law states:
“When it is not obvious what service an animal provides, only limited inquiries are
allowed. Staff may ask two questions: (1) is the dog a service animal required
because of a disability, and (2) what work or task has the dog been trained to
perform. Staff cannot ask about the person’s disability, require medical
documentation, require a special identification card or training documentation for
the dog, or ask that the dog demonstrate its ability to perform the work or task.”

asking those 2 questions, and I will remind staff about these issues. Please, if you
see animals in the Library, do not hesitate to let staff know.

Lucille Kuehn
Former Mayor, Councilwoman, and Library Trustee Lucille Kuehn passed away last week. Mrs.
Kuehn was a strong supporter of the Library and we are forever indebted to her determined
efforts to benefit the community with a first class Central Library.
Staffing
The Library has hired new staff for some key positions. Leah Duffy began training in her new
role as a part-time clerk on Monday, October 21. Leah has been working as a Page for the last
year. On November 2, Annika Helmuth also joined the Circulation team as a part-time Clerk.
Pages Julie McCarthy and David Kong also started their positions earlier in November. We are
also in the process of recruiting two part-time Library Assistants for the Mariners Branch
Library.
Lynda.com
The Library offers a great service for self-directed learning in the Media Suite called Lynda.com.
Lynda.com is an online training resource that utilizes video tutorials. It allows Library users to
both refresh their skills or learn something new. The databases include 2,263 courses and
more are added every week. The tutorials are conducted by industry experts carefully selected
for their background and expertise. The newest course offerings in Lynda.com include:

Branches
October was steadily busy at all locations. Special children’s related programs included
“Monster Madness” at Mariners, a “Spooktacular” event at Balboa and “Not-too-Spooky Crafts”
for the CDM craft club.
Additional shelves were added to the DVD and Children’s kit areas at Balboa which allowed
them to shift and better display those collections. On the personnel side, part-time Library
Assistant Jason Bensley gave his notice and left employment at Mariners on October 29th.
Recruitment to fill Jason and Christine Chapel’s positions will take place in November. In the
meantime, staffing for Mariners to fill scheduling holes has been supplied by Central Adult
Reference and Children’s services staff.
CDM was closed for the day on Thursday, October 17 due to a planned power outage by
Southern California Edison. Staff was deployed to Central and Mariners.
Kristin, the Library Assistant at Balboa, presented a “Groovin with Pete the Cat” program this
month. What made the program unique was the incorporation of iPads as part of the planned
activities. Traditional crafts and book reading were part of the afternoon but the iPads and the
story video they offered added an extra dimension to the event. Youth services staff at the
other branch locations will work with Kristin to help plan future events that incorporate this
technology.
The School Book Fair at Mariners Elementary was held on November 18 – 22 and just
yesterday the PTA presented the library with $3000. This is about four times the amount they
have given the library in the recent past. Heather Hart, Branch Librarian at Mariners will use it
to purchase fiction and non-fiction materials for the Children’s collection.
Youth Services
The Craft Club theme at Central was “Boo Blast Craft Club.” Forty-two adults and children
enjoyed Halloween stories and crafts. On Saturday, October 19, in conjunction with the special
Syd Hoff exhibit, Carol Edmonston, Syd Hoff’s niece, was a special guest at the Family
Storytime. Carol talked about her uncle, his artwork and his legacy of children’s materials,
including Danny and the Dinosaur. After Carol spoke and fielded questions, a costumed
dinosaur made a surprise visit to round out the special event. The children in attendance were
delighted and most posed with the dinosaur to have their pictures taken.
Storytimes at Central continue to attract larger numbers. This may be in response to the room
expansion but we are very happy to welcome the larger crowds. On November 3 well-known
children’s author Cornelia Funke presented visited the library to talk about her writing process,
answer questions and sign books for excited readers and fans. David Shannon, well-known
picture book author (the No David! series and many others), read his latest book Bugs in My
Hair!, made drawings and talked about his process and writings on November 17. This
program was held in the Children’s room and attracted over 160 attendees. Both events were
part of the Making Memories Series that is sponsored by the Library Foundation. Youth
Services staff, with funding from the Friends, hosted a Princess Tea Party on Wednesday,
November 13. Cinderella came in costume to the delight of the 112 people in attendance. She
read her story, sang songs and posed for pictures with adoring fans. Crafts and refreshments
rounded out the special afternoon event.

Teen Services
YAAC met on October 9. In addition to brainstorming about potential programming, special
guests from a local high school spoke to the group about TEDxYouth events. These are
independently organized groups and events, licensed by the TED conference and designed
along the same lines as the annual TED events.
On November 6 the library presented “The Whole Package College Planning Workshop.” This
program was done in conjunction with Kaplan. YAAC met in November to work on Teen
booklists and brainstorm on names that would be appealing to readers. The council members
also spent a large portion of the meeting time in the Media Lab improvising some pictures and
video clips that might possibly be used for advertising. The YAAC members were impressed
with the lab and what it had to offer.

Photographs
The architects were back during the first week of November to take more pictures of the Civic
Center Plaza at various times of the day and night.
HVAC Repairs
The repairs were completed and staff received training on the new monitoring software. So far
everything seems to be working well.
Exterior Lighting
We had a couple of the lights in the Bamboo Courtyard converted over to work on a photocell
rather than a timer. This is help illuminate the area in the morning so staff is not arriving in the
dark. We have one staff member starting work at 6:00am on week days to open the building for
the Bistro staff.
Circulation
In November Annika Helmuth started in the position of Part-Tim Library Clerk at the Central
Library. We also have two new Library Pages, David and Julie. They will be filling open
positions at the Central Library and Mariners.
Literacy
The Literacy program will have the annual Holiday Potluck lunch on Saturday, December 7th at
the Central Library. This is a fun event for the learners, tutors and volunteers in the program.
This is also an annual business meeting for Newport Mesa Pro Literacy. The new officers of
the NMPL Board will be elected and one of the tutors will be honored as “Volunteer of the Year”
for the group. The slate of officers for Newport Mesa Pro Literacy is:

What’s Cooking? Event
Chef Geeta Bansal from Irvine’s Clay Oven restaurant demonstrated classic Indian cooking
techniques and shared samples of her dishes. 70 people enjoyed the program.
Manuscripts Book Discussion Group
40 people attended the book group to discuss NW by Zadie Smith. NW delves into the lives
and challenges of a group of friends from an impoverished section of London.
Sunday Musicale
The Sunday Musicale featured Duo Ondine, consisting of flutist Boglarka Kiss and harpist
Alison Bjorkedal. Recently selected by the Beverly Hills Auditions as one of the top chamber
groups in Los Angeles, the duo played some music by Bach as well as some of early twentieth
century as well as modern selections. Interesting and personable, they spoke about the pieces
they were playing as well as their instruments. One hundred four people enjoyed the afternoon
concert which was free and open to the public and sponsored by the Friends of the Library.

Media Center Update

Sound Lab: The City IT staff has processed a purchase order to acquire the equipment for the Sound
Lab. The estimated arrival time for the equipment is the 2nd week of December.
Media Lab:
The Media Lab hours were modified to add evening hours beginning November 4, 2013.
The current hours are Monday and Wednesday 10:00 AM-2:00 PM and Tuesday and
Thursday 4:00 PM to 8:00 PM.
Beginning in early 2014, the staff will reintroduce the Tuesdays @2 public training
classes, and will utilize the Media Lab equipment for instruction.
Beginning in Spring 2014, the City Recreation Department will offer computer training
classes in the Media Lab, utilizing contract instructors. These classes will be fee-based,
providing interested customers with focused, high-end training on the software.
On November 12, 2013, two staff members hosted the Recreation Department’s
quarterly meeting in the Media Lab and demonstrated Lynda.com and editing software.
At the November 4th 2013 Library Board Meeting, a member of the public questioned the manner in
which Library staff manages customers who view graphic or disturbing images on the public Internet
computers. He suggested that requesting patrons to stop viewing graphic or disruptive images was
indicative of Library staff monitoring or dictating customer’s use of the Internet.
From a staff perspective, viewing graphic or disruptive images is a Library Use policy issue. The Library is
open to all members of the public without restriction. The Library’s primary concern is to make public
areas available on an equitable basis for all customers, for using the services, materials, or facilities for
reading, studying, or obtaining information. The Library Use Policy serves as a guide for customer
behavior that is consistent with these specific purposes.
If customers complain about another customer viewing graphic or disturbing images, or if Library staff
sees a customer viewing graphic or disturbing images, Library staff asks them to stop. Staff states to the
customer that the Library is a public facility for people of all ages and sensibilities, and those customers
who view disturbing or graphic images are disrupting the abilities of other customers to use the Library.
Displaying graphic or disturbing images on computers also creates a hostile workplace environment for
Library staff, thus interfering with their ability to perform their duties. Staff uses this procedure
consistently regardless if the customer is accessing graphic or disturbing images on Library computers or
on their own personal devices. Customers who persist in accessing these images in view of others are
asked to leave the Library.
This is reflected in the Library Use Policy:
“The following behavior will invite a reminder from staff that such conduct is prohibited in the library.
Customers who continue to engage in these activities will be asked to leave the facility:
1. Interfering with other customers’ use of library facilities or staff's ability to perform their duties.”
Newport Beach Public Library’s staff procedure is similar to other local public libraries. In response to
this issue, Newport Beach Public Library staff conducted a survey regarding Internet use and the viewing
of graphic or disturbing images. All the public libraries in Orange County, California, and the Orange
County Public Law Library were contacted to share their procedures, and the methods utilized to

enforce their Use policies with customers. Our procedures are similar to the other Orange County
libraries who responded to the survey:
Buena Park Public Library: The Buena Park Public Library uses a tiered system to manage the
public Internet computers. With this system, the staff is able to view the screen a customer is
viewing if another customer complains so the staff can verify the material. The staff then sends
a message to the customer stating that the material may not be viewed, and allows the
customer to remove the material within 30 seconds. If the customer does not comply within 30
seconds, the staff shuts down the computer and blocks the customer for one week. If the
customer continues to view objectionable material after the one-week block, the staff can
disable the account from 6-12 months up to a lifetime ban. If the customer’s access is
reinstated after 6-12 months, a verbal reminder is given to the customer not to view
objectionable material.
Fullerton Public Library: The staff is instructed to intervene with a customer if another
customer has voiced objections or concerns, unless staff observes patently offensive material or
child pornography. The staff will speak with the customer to explain the objection or concern,
and document the interaction. If a staff member is uncomfortable dealing with the customer, a
manager may be called to intervene. The Library Director and managers review all situations in
which a customer may lose library privileges, and decide on the course of action.
Mission Viejo Public Library: Approximately 10 years ago, the Mission Viejo City Council
decided to filter all City computers, including staff and public library computers. Gambling and
adult content sites are blocked. If a customer does access objectionable material, such as via an
email attachment, the staff will inform the customer that they need to close the material. A
dated note is then placed in the customer’s record to alert other staff of the incident. If a
customer continues to view objectionable material, a 6-month Internet block is placed on the
customer’s record. The customer must speak with the staff to have Internet privileges
reinstated.
Orange Public Library: Customers viewing objectionable material are warned to cease the
activity; if they do not they can lose Internet access for the day and have a note placed on their
record. Customers in some instances may have to speak to the Librarian in Charge to have
Internet privileges reinstated.
Orange County Public Law Library: The staff is empowered to end customer’s sessions only if
pornography is being viewed. The staff discusses the infraction with the customer and gives the
person a chance to stop viewing the material before the session is ended.
Yorba Linda Public Library: The Adult Services Manager has created and added a page in the
employee Operations Handbook addressing enforcing the Internet Use Policy. The staff is
empowered to end a customer’s session after providing a warning, and many opt to involve a
manager in that process.
The member of the public also expressed concern that the Library may also be violating patron privacy
laws. California Government Code § 6267 deals with the confidentiality of Library records (i.e. Library
card accounts and borrowing habits). These laws do not address customer Internet viewing habits or
preferences. Moreover, Library staff does not record Library card account information when requesting
customers to stop viewing graphic or disturbing images. The Library PC management software, CASSIE,
is not configured for staff to monitor customer sessions on the public computers. Library staff does walk
the public areas, including the public computer are, to assist customers. During these sweeps of the
public areas, Library staff will address Use Policy issues, as it is staff’s responsibility to ensure a positive
experience for Library customers.
In summation, staff treats viewing graphic or disturbing images in the Library as a disruptive activity, and
as a violation of the Library Use policy. The Library has policies and practices that balance the
protection of First Amendment rights with the rights of customers and staff. The Newport Beach Public
Library staff addresses these concerns directly with customers. The intent of the procedure is to ensure
a comfortable experience and access to services and resources for all Library customers. Staff
recommends that the Library Board maintain the existing Library Use Policy and the staff procedure
derived from the Use Policy.
The Newport Beach Public Library is open to all members of the public without restriction. Customers
may remain in the library during posted business hours to use the services, material or facilities for
reading, studying or obtaining information. However, customers may be directed to leave the library
with or without advance warning, when their behavior disrupts other customers or staff, or is
inconsistent with library purposes.
A. The following behavior will invite a reminder from staff that such conduct is prohibited in the library.
Customers who continue to engage in these activities will be asked to leave the facility:
1. Smoking;
2. Sleeping;
3. Occupying furniture in a manner that suggests lounging, as evidenced by lying down on the furniture, or
propping feet on chairs, sofas, or tables;
4. Occupying more than one space during peak times of library use;
5. Eating or drinking food or beverages in such a manner that customers or staff are made uncomfortable.
6. Not wearing shoes;
7. Wearing cleats, skates, rollerblades or other items that could damage the facility;
8. Creating an unreasonably loud noise such as loud talking or banging on furniture;
9. Using audible devices without headphones or with headphones set at a volume that disturbs others;
10. Using cell phones, pagers, and other communication devices in a manner that disturbs others. Audible
cell phone and pager ringers must be turned off;
11. Interfering with other customers’ use of library facilities or staff's ability to perform their duties;
12. Soliciting or collecting funds (except for staff's collection of overdue fines, fees, proceeds of book sales,
rentals, and library donations);
13. Bringing animals into the facility except service animals such as guide dogs;
14. Failure to use library computers or other information resources in the manner directed, e.g., use of
computers over the time limit when others are waiting; refusal to provide access to limited reference
materials when others are waiting;
15. Bringing any containers, packages, briefcases, parcels, or bundles into the library which singly or
collectively exceed 24”x18”x6”. All items are subject to inspection;
16. Bringing shopping carts or wheeled conveyances into the building, with the exception of wheelchairs
and baby strollers/carriages used for the actual transport of a person or child or wheeled backpacks and
book carriers not exceeding 24”x15”x12” (excluding handles);
17. Bringing sleeping bags, bed-rolls, or blankets into the building (blankets for small children are
acceptable); and
18. Parking a bicycle, wheeled conveyance, shopping carts or other wheeled cart in any area other than at a
designated bicycle rack.
B. The following behavior is illustrative of conduct which will warrant an immediate order to leave the
facility:

1. Any physical interference with customers or staff;
2. Any illegal activity;
3. Any threatening or abusive language or gesture directed towards customers or staff;
4. The lack of personal hygiene or use of perfume or fragrance which produces odors that interfere with
other customers’ use of library facilities or materials or interfere with staff's ability to perform their
duties; and
5. The failure to comply with any warning or request to change or stop conduct.

By charter, the Board of Library Trustees will accept money, personal property or real estate donated to
the City for library purposes, subject to the approval of the City Council.
Staff recommends the following procedures to put in place to support this policy and ensure the timely
acceptance of gifts and donations:
A gift or donation of $10,000 or less which is coming from one of the Library support groups,
Newport Beach Public Library Foundation or The Friends of the Newport Beach Public Library,
be accepted on their behalf by the Library Director. The gift will be reported to the Board of
Library Trustees on a quarterly basis in the financial expenditure reports. Gifts or donations
over $10,000 will be brought to the Board of Library Trustees for approval of acceptance and
designation of use before being forwarded to City Council for their approval.
The Library Director may accept funds of $10,000 or less from the Newport/Mesa Pro Literacy
Board to cover the Library Literacy division’s operating expenditures. These funds will be
reported to the Board of Library Trustees on a regular basis. Funds over $10,000 will be brought
to the Board of Library Trustees for approval of acceptance and designation of use before being
forwarded to City Council for their approval.
The Library Director may accept donations of materials and/or funds for the purchase of
materials on behalf of the Library Board of Trustees in the amount of $500 or less. These
donations will meet the criteria outlined in City Council Policy I-3 (Newport Beach Public Library
Collection Development Policy).
These procedures are similar to the City’s policy in regards to the acceptance of gifts or donations by the
City Manager and the City Council.
Excerpt from Council Policy F-3
The City Manager may accept grants or donations of up to $30,000 on behalf of the City.
However, if a new or additional appropriation is required, the City Manager’s authority to
create new appropriations is limited to $10,000 as stated above. The City Council will be
formally notified of such actions on a quarterly basis by way of the City Manager newsletter
to the City Council.
