The agenda will be posted at least seventy-two (72) hours in advance of each regular meeting and the public will be allowed to comment on agenda items before the Zoning Administrator, as well as items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Zoning Administrator may limit public comments to a reasonable amount of time, generally three (3) minutes per person. Recommended Action 1.Approve and File IV.PUBLIC HEARING ITEMS Cruisers Pizza Bar Grill Coastal Development Permit No. CD2022-016 and Limited Term Permit No. XP2022-002 (PA2022-049) Site Location: 801 East Balboa Boulevard 2. Project Summary A request for a limited term permit and a coastal development permit (CDP) to authorize a 672-square-foot expanded outdoor dining area previously authorized through Emergency Temporary Use Permit No. UP2020-011 and Coastal Development Permit No. CD2020-029 (PA2020-084) for Cruisers Pizza Bar and Grill for up to one year (July 28, 2022, to July 27, 2023). Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 under Class 1 (Existing Facilities) and Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit No. CD2022-016 and Limited Term Permit No. XP2022- 002 . Annual Review of North Newport Center Development Agreement No. DA2007-002 (PA2009-023) Site Location: Fashion Island; Block 100, Block 400, Block 500, Block 600, and Block 800 of Newport Center Drive; and San Joaquin Plaza 3. Project Summary An annual review of Development Agreement No. DA2007-002 for North Newport Center, pursuant to Newport Beach Municipal Code (NBMC) Section 15.45.080 (Periodic Review) and California Government Code Section 65865.1. The Development Agreement executed in 2008 and amended in 2012, vested development rights for regional commercial, office, mixed-use, and residential uses in North Newport Center and required public benefit contributions to the City. The Zoning Administrator will review Irvine Company’s good faith compliance with the July 28, 2022 Page 3 Zoning Administrator Meeting provisions of the Development Agreement between January 2021 and December 2021. North Newport Center includes the following sub-areas: Fashion Island; Block 100, Block 400, Block 500, Block 600, and Block 800 of Newport Center Drive; and San Joaquin Plaza. Recommended Action 1.Conduct a public hearing; 2.Find the review exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15321 (Class 21 - Enforcement Actions by Regulatory Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; 3.Find that the applicant has demonstrated good faith compliance with the terms of the Zoning Implementation and Public Benefit Agreement; and 4.Receive and file the North Newport Center Zoning Implementation and Public Benefit Agreement Annual Report Year 2021. Pigazzi Residential Condominiums Tentative Parcel Map No. NP2022-005 (PA2022-051) Site Location: 507 and 507 ½ Marguerite Avenue 4. Project Summary A request for a tentative parcel map for a two-unit condominium. A single-family residence has been demolished and a new duplex is under construction. No waivers of Title 19 (Subdivisions) are proposed. The Tentative Parcel Map would allow each unit to be sold individually. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15315 under Class 15 (Minor Land Divisions) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Tentative Parcel Map No. NP2022-005. July 28, 2022 Page 4 Zoning Administrator Meeting Smith 507 LLC Residence Coastal Development Permit No. CD2022-023 (PA2022-067) Site Location: 1616 West Ocean Front 5. Project Summary A request for a coastal development permit (CDP) to construct a new, three-story 2,287-square-foot single-family residence and attached 476-square-foot two-car garage on a vacant lot. The project includes appurtenances such as site walls, fences, patios, drainage devices, and landscaping. The design complies with all applicable development standards, including height, setbacks, and floor area limit, and no deviations are requested. Recommended Action Item will be noticed for August 2, 2022, Zoning Administrator meeting. Welsh Residence Coastal Development Permit No. CD2022-021 (PA2022-060) Site Location: 2124 Santiago Drive 6. Project Summary A coastal development permit (CDP) to allow the demolition of an existing single-family residence and the construction of a new two-story, 4,064-square-foot single-family residence with an attached 704-square-foot three-car garage. The project includes additional appurtenances such as a new landscape, driveway approach, and drainage areas within the public right-of-way. The design complies with all applicable development standards, including height, setbacks, and floor area limit, and no deviations are requested. Recommended Action Item will be noticed for August 2, 2022, Zoning Administrator meeting. V.PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers’ time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
