CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Jaime Murillo, Zoning Administrator David Lee, Associate Planner Joselyn Perez, Assistant Planner II. REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF JULY 28, 2022 Action: Approved ITEM NO. 2 MINUTES OF AUGUST 2, 2022 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 3 Cefalia Residential Condominiums Tentative Parcel Map No. NP2022-006 and Coastal Development Permit No. CD2022-022 (PA2022-061) Site Location: 1027 West Bay Avenue, Units A, and B Council District 1 The Zoning Administrator described the project, which is a parcel map for condominium purposes for a duplex currently under construction. Applicant Jeff Cefalia of Cefalia Development stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved ITEM NO. 4 Moriarty Residence Lot Merger No. LM2022-002 (PA2022-120) Site Location: 20460 and 20462 Birch Street Council District 3 Joselyn Perez, Assistant Planner, provided a brief project description stating that the request is to merge two parcels, under common ownership, to create a single lot and to waive the parcel map requirements. No other waivers or deviations are requested. Ms. Perez described the zoning, historical use, and future use of the properties. She explained that the project ultimately returns the two properties to their 1925 subdivision configuration and creates one compliant property. The Zoning Administrator asked Ms. Perez if before the current ownership 20460 Birch Street had the same owner as 20462 Birch Street. Ms. Perez responded that she did not know who owned the properties before the MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 08/11/2022 Page 2 of 2 current owner. The Zoning Administrator then asked the applicant if they knew who previously owned the properties. The applicant, Jeff Van Voorhis of Brandon Architects, responded that he did not know. The Zoning Administrator asked Mr. Van Voorhis if he had read the draft resolution and conditions of approval. Mr. Van Voorhis stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved ITEM NO. 5 59th & Lex Café Alcohol License Upgrade Minor Use Permit No. UP2022-006 (PA2022- 048) Site Location: 701 Newport Center Drive Council District 5 Joselyn Perez, Assistant Planner, provided a brief project description stating that the request is for a minor use permit to allow an existing café located within the footprint of Bloomingdale’s retail store at Fashion Island to upgrade its existing ABC license from a Type 41 (On Sale Beer and Wine) to a Type 47 (On Sale General). Ms. Perez clarified that the request does not include changes to the floor plan or the hours of operation and is only adding menu options. The project will establish a use permit for the café, as the café was opened at a time when the zoning district of the subject property did not require a use permit. The request was reviewed by the City’s Police Department, and they found no issue with an upgraded license. The recommendations from the Police Department have been incorporated into the resolution as Conditions of Approval. Applicant Grace Yang of Gray Robinson, on behalf of the Owner, stated that she had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved V. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. VI. ADJOURNMENT The hearing was adjourned at 10:15 a.m. The agenda for the Zoning Administrator Hearing was posted on August 4, 2022, at 3:00 p.m. on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City’s website on August 4, 2022, at 3:30 p.m.
