SUBJECT: ACQUISITION OF TEN FEET OF RIGHT-OF-WAY AT 3430 IRVINE AVENUE AND
TWENTY FEET OF RIGHT -OF -WRY AT 3500 IRVINE AVENUE
RECOMMENDATIONS:
1. Authorize the purchase of a ten -foot -wide strip of land at
3430 Irvine Avenue for street purposes for $13,000.
2. Authorize.the purchase of a twenty -foot -wide strip of land
at 3500 Irvine Avenue for street purposes for $25,000.
3. Accept a grant deed from Phillip A. Stevens and Barbara A.
Stevens for the partial taking of land at 3430 Irvine Avenue.
4. Accept a grant deed from David Magilavy and Rhoda Magilavy
for the partial taking of land at 3500 Irvine Avenue.
DISCUSSION:
The current budget provides funds to widen Irvine Avenue southerly
of Bristol Street to primary roadway standards. The subject two parcels are
needed to widen the roadway. See attached sketch.
The City retained Mr. Richard A. Fuller, MAI, to appraise the ten -
foot strip of land at 3430 Irvine Avenue owned by Mr. and Mrs. Stevens. He
concluded that the fair market value for the partial taking of land was
$13,800 as of May 1, 1982.
The widening of Irvine Avenue will provide improvements to the prop-
erty estimated to cost $800. Mr. and Mrs. Stevens .have been offered and
accepted $13,000 ($800 less than fair market value), subject to the approval
of the purchase by the City Council.
The property located at 3500 Irvine Avenue was not appraised. The
owners, Mr. and Mrs. Magilavy, had applied for a building permit to redevelop
the property. The permit application has been withdrawn. Had the permit
been issued, the owners would have been required to dedicate the twenty feet
of right-of-way needed to widen Irvine Avenue under the provisions of Section
13.05.010 of the Municipal Code. Due to the present economic conditions,
Mr. .Magilavy has decided not to redevelop his property at this time. The
parcel is needed to enable the widening project to proceed. Based on the
proximity of -the appraised parcel at 3430 Irvine Avenue to Mr. Magilavy's
parcel (120± feet), the same cost per square foot was used to value his
parcel. He was offered and accepted $25,000 for the twenty -foot -wide strip of
land, subject to approval of the purchase by the City Council.

The purchase of the two strips of land completes right-of-way ac-
quisition to widen Irvine Avenue to primary roadway standards in this area..
The proposed widening will allow for a left -turn lane and extend the existing
right -turn lane at Bristol Street. The project will be funded from the Circu-
lation and Transportation Fund. The project is scheduled for construction in
October.
