This policy does not describe the content of dedication plaques; therefore, staff is proposing to amend Council Policy B-9 to include guidelines for the content and layout of plaques for the dedication and rededication of City buildings and facilities. RECOMMENDATION a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2022-72, A Resolution of the City Council of the City of Newport Beach, California, Amending and Re -Titling City Council Policy B-9 (Naming of City Parks & Facilities). DISCUSSION: The City of Newport Beach has a long -held custom of placing a plaque in City -owned buildings and facilities at the time of their dedication or rededication. Over the years, the content of the plaques has varied, resulting in little consistency as to the language contained on the plaques. If approved, the proposed amendments to Council Policy B-9 would provide guidelines as to the content and layout of future dedication or rededication plaques. The proposed policy reads as follows: Plaques for City facilities shall include the City seal in a prominent position and the following information in the specific order given: Facility name 15-1 Resolution No. 2022-72: Amending and Re -Titling City Council Policy B-9 to Provide Guidelines for City Dedication Plaques October 11, 2022 Page 2 2. Date of dedication (opening) or rededication 3. City Council Members currently in office. The names and titles of the mayor and mayor pro tem shall be first, followed by the names of the remaining council members in alphabetical order. For large, multi -year projects, include the names of council members who were in office at time of project award. 4. If applicable, the names of the appropriate, current Board or Commission members. 5. Current City Manager 6. The name of the appropriate, current Department Director (the director whose department is most closely affiliated with the use of the facility) at the time of dedication or rededication. 7. If applicable, names of key project partners, i.e., other government entities or funding entities. 8. Optional: Names of the firms of the City's construction partners, e.g., architect, general contractor, construction manager. The City Manager will be responsible for determining what, if any, Board or Commission names are listed on a plaque and if any key project partners should be included. The City Manager, in consultation with the Public Works Director, will determine if the names of the City's construction partners should be included. In cases of dedications of a major remodeling project or facility expansion, the existing plaques shall continue to be displayed. Attachment A is a redline of the proposed changed to Council Policy B-9. A clean version of the proposed changes is included as Exhibit A to Resolution No. 2022-72 (Attachment B). FISCAL IMPACT: There is no fiscal impact related to this item ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. 15-2 Resolution No. 2022-72: Amending and Re -Titling City Council Policy B-9 to Provide Guidelines for City Dedication Plaques October 11, 2022 Page 3 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). It is desirable that appropriate names be selected for future parks and public '-eer-ea ion facilities. The following guidelines shall serve as policy on this matter. A. Suggestions for naming new or existing parks or public facilities shall be reviewed by the Parks, Beaches and Recreation Commission with a recommendation being transmitted to the City Council for approval. B. New or existing park or public facilities names can be chosen from, but not limited to, the following categories: 1. Streets or schools bordering park 2. Topography 3. Theme 4. Common names already in place for the area 5. Persons that have been deceased for at least fifteen (15) years C. Facility rooms or site amenities may be dedicated in honor of persons if done as part of a capital/fundraising campaign and with the approval of the City Council. D. Plaques for City facilities shall include the City seal in a prominent position and the following information in the specific order given: 1. Council -approved facility name 2. Date of dedication (opening) or rededication 3. City Council Members currently in office. The names and titles of the mayor and mayor pro tem shall be first, followed by the names of the remaining 15-4 council members in alphabetical order. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby amend and re -title Council Policy B-9 as set forth in Exhibit A, which is incorporated herein by this reference. Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. 15-6 Resolution No. 2022- Page 2 of 2 Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
