A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, ESTABLISHING
THE CITIZENS' RESIDENTIAL CRIME AND BURGLARY
ADVISORY COMMITTEE
WHEREAS, the City Council establishes various committees from time to time for
the purpose of advising the City Council on matters of importance;
WHEREAS, the City Council recognizes the importance of residential safety and
security, and the value of educating the public on preventative measures that may be
taken to protect residences from crime and burglaries;
WHEREAS, the City Council desires to respond to rising concerns of residential
crime and burglaries within the community by considering the addition or modification of
programs, policies, or procedures to prevent and deter residential crime and burglaries;
WHEREAS, the City Council recognizes that its residents have a wide diversity of
backgrounds, including but not limited to, experience and expertise in public safety and
criminal justice, which is a valuable resource that can be utilized to provide advice and
recommendations to prevent and protect against residential crime and burglaries; and
WHEREAS, the City Council desires to establish an ad hoc citizens' advisory
committee comprised of residents with backgrounds in public safety and criminal justice
to provide input on community education, preventative measures, deterrence and the
adoption or modification of programs, policies, or procedures to address residential crime
and burglaries.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows..
Section 1: The City Council hereby creates the Citizens' Residential Crime and
Burglary Advisory Committee ("Committee") to provide input and make recommendations
to the entire City Council on community education, preventative measures, deterrence,
and the adoption or modification of programs, policies, or procedures to address
residential crime and burglaries.

Section 2: The Committee shall be an ad hoc advisory committee and shall be
subject to the Brown Act. The term, qualification of appointees, selection of appointees,
appointment process, membership, and responsibilities shall be done in conformance
with this resolution and Exhibit "A", which is incorporated herein by reference.
Section 3: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 4: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 5: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.

Section 6: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.

EXHIBIT A
CITIZENS' RESIDENTIAL CRIME AND BURGLARY
ADVISORY COMMITTEE
AUTHORIZATION: Established by Resolution No. 2022- adopted on
October 25, 2022.
MEMBERSHIP: Three (3) residents appointed by the Mayor and
confirmed by the City Council.
MEMBERSHIP TERM: The Committee shall expire on June 30, 2023, unless
terminated sooner by action of the City Council.
MEETINGS: The Committee shall meet regularly, with the schedule
determined by the Committee.
QUALIFICATIONS OF Appointed Committee Members shall:
APPOINTED MEMBERS:
A. Be a resident of the City of Newport Beach ("City");
B. Be a registered voter in the City;
C. Have a background in public safety or criminal justice;
D. Be appointed by the Mayor; and
E. Be Confirmed by the City Council.
COMMITTEE The Committee shall have a Chairperson and a Vice
ORGANIZATION: Chairperson appointed by the Mayor.
SELECTION OF Selection of Committee Members shall be done as
APPOINTED MEMBERS: follows:
A. The City Clerk shall prepare a notice letting members
of the public know of the opportunity to serve on the
Committee and the application process. The notice shall
include, but not be limited to, details regarding what
information is necessary to be considered for
appointment, where to apply, and the application
deadline.
B. The application notice shall be published at least once
in a newspaper of general circulation in the City and
posted in the City's normal posting location for agendas,
as well as the Newport Beach Public Library located at
1000 Avocado Avenue.
C. The deadline to submit applications for the Committee
shall be one (1) week after the application notice is
published in a newspaper of general circulation in the
City.
D. The Mayor shall review the applications, the
applicants' answers to any questions, and conduct any
necessary interviews.
E. After the applications have been reviewed and any
necessary interviews conducted, the Mayor shall inform
the City Clerk of the names of the members to be
appointed to the Committee and the City Clerk will submit
the names of the appointees to the City Council, at an
open and noticed meeting, to be considered for
confirmation by the City Council.
F. Except as otherwise required by law, the process for
selecting, appointing, and confirming members to the
Committee shall follow the process set forth herein.
PURPOSE & A. Provide recommendations to the City Council
RESPONSIBILITIES regarding educating the public on steps that can be taken
to prevent and deter residential crime and burglary;
B. Provide recommendations to the City Council
regarding the addition, modification, or elimination of
programs, policies, or procedures to prevent and deter
residential crime and burglary;
C. Provide recommendations to the City Council
regarding the availability of non-profit and community -
based programs, policies, or procedures to prevent and
deter residential crime and burglary;
D. Provide recommendations to the City Council
regarding the availability and allocation of funding for
programs, policies, or procedures to prevent and deter
residential crime and burglary; and
E. Such other matters as directed by the City Council.

whole number of members of the City Council is seven; the foregoing resolution, being Resolution
No. 2022-74 was duly introduced before and adopted by the City Council of said City at a regular meeting
of said Council held on the 25'h day of October, 2022; and the same was so passed and adopted by the
following vote, to wit:
