The City of Newport Beach will conduct the Zoning Administrator meeting via Zoom. As a member of the public, if you

The agenda will be posted at least seventy-two (72) hours in advance of each regular meeting and the public will be
allowed to comment on agenda items before the Zoning Administrator, as well as items not on the agenda but are
within the subject matter jurisdiction of the Zoning Administrator. The Zoning Administrator may limit public comments
to a reasonable amount of time, generally three (3) minutes per person.

Please Note: All mail or written communications (including email) from the public, residents, or applicants regarding an
agenda item must be submitted by 12:00 p.m. on the business day immediately prior to the meeting. This allows time for
the Zoning Administrator to adequately consider the submitted correspondence. Comments can be emailed to
CDD@newportbeachca.gov, and all emails will be made part of the record.

APPEAL PERIOD: An appeal may be filed with the Director of Community Development or City Clerk, as applicable, within
fourteen (14) days following the date the action or decision was rendered unless a different period of time is specified
by the Municipal Code (e.g., Title 19 allows ten (10) day appeal period for tentative parcel and tract maps, lot line

Annual Review of Hoag Memorial Hospital Presbyterian Development
Agreement No. 5 (PA2009-064)
Site Location: 1 Hoag Drive

Project Summary
Pursuant to Section 15.45.080 of the Municipal Code and Section 65865.1 of the
California Government Code, the City is conducting a review of the amended
Development Agreement between the City and Hoag Memorial Hospital
Presbyterian (“Hoag Hospital”). The City and Hoag Hospital entered into a
Development Agreement in 1994, which was amended in 2008, 2019, and 2020, for
the purpose of ensuring the orderly expansion of Hoag Hospital. The review will
examine Hoag Hospital’s good faith compliance with the provisions of the
Development Agreement, the Planned Community Development Plan District
Regulations, the Municipal Code, and applicable environmental mitigation
measures. Hoag Hospital is located at 1 Hoag Drive, which is south of Hospital
Road, west of Newport Boulevard, north of Coast Highway, and generally south and
east of two residential communities (Villa Balboa and Versailles).
Recommended Action
1.Conduct a public hearing;
2.Find the annual review is exempt from the California Environmental Quality Act
(“CEQA”) pursuant to Section 15321, Class 21 (Enforcement Actions by
Regulatory Agencies) of the CEQA Guidelines, California Code of Regulations,
Title 14, Chapter 3 because it has no potential to have a significant effect on the
environment;
3.Receive and file the Annual Report of Development Agreement for Hoag
Memorial Hospital Presbyterian (Attachment No. ZA 2); and
4.Find that the applicant has demonstrated good faith compliance with the terms of
Development Agreement No. 5.
Annual Review of Uptown Newport Development Agreement No.
DA2012-003 (PA2014-039)
Site Location: 4311-4321 Jamboree Road

Project Summary
Pursuant to Section 15.45.080 of the Municipal Code and Section 65865.1 of the
California Government Code, the City is conducting a review of Development
Agreement No. DA2012-003 for the Uptown Newport project. The Development
Agreement was executed in 2013, and it ensures the orderly construction of the
Uptown Newport Planned Community, a 25-acre, mixed-use residential project
consisting of 1,244 residential units, two one-acre public parks and 11,500 square
feet of retail uses. The Zoning Administrator will review Uptown Newport’s good faith

compliance with the provisions of the Development Agreement.
Recommended Action
1.Conduct a public hearing;
2.Find the annual review is exempt from the California Environmental Quality Act
(“CEQA”) pursuant to Section 15321, Class 21 (Enforcement Actions by
Regulatory Agencies) of the CEQA Guidelines, California Code of Regulations,
Title 14, Division 6, Chapter 3 because it has no potential to have a significant
effect on the environment;
3.Find that the applicant has demonstrated good faith compliance with the terms of
Development Agreement No. DA2012-003; and
4.Receive and file the Annual Report of Development Agreement for Uptown
Newport Planned Community (Attachment No. ZA 2).
Friedman Residence Coastal Development Permit (PA2022-0186)
Site Location: 7106 West Ocean Front

Project Summary
A coastal development permit (CDP) to allow the demolition of an existing
single-family residence and the construction of a new 2,637-square-foot, three-story,
single-family residence with an attached 382-square-foot, two-car garage. The
proposed development also includes additional appurtenances such as walls,
fences, patios, hardscape, drainage devices, and landscaping. The project complies
with all development standards and no deviations from the Municipal Code are
requested.
Recommended Action
1.Conduct a public hearing;
2.Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15303 under Class 3 (New Construction or Conversion of
Small Structures) of the CEQA Guidelines, California Code of Regulations, Title
14, Division 6, Chapter 3, because it has no potential to have a significant effect
on the environment; and
3.Adopt Draft Zoning Administrator Resolution No. _ approving Coastal
Development Permit (Attachment No. ZA 1).
DISH Wireless Coastal Development Permit (PA2021-301)
Site Location: 2865 and 2867 (CS) East Coast Highway

Project Summary
A request for a coastal development permit (CDP) to allow the collocation of a new
Class 1 (Stealth/Screened) wireless telecommunications facility on the rooftop of an
existing commercial building. The project includes the installation of up to six (6)
antennas, 12 remote radio units, related support equipment, and two (2)

fiber-reinforced plastic (FRP) screens. The height of the new FRP screening will
match the height of the existing FRP screening around the other rooftop antenna
arrays by other carriers.
Recommended Action
1.Conduct a public hearing;
2.Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301 under Class 1 (Existing Facilities), and Section 15303
under Class 3 (New Construction or Conversion of Small Structures) of the
CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter
3, because it has no potential to have a significant effect on the environment and
that the exceptions to the Class 3 exemption do not apply; and
3.Adopt Draft Zoning Administrator Resolution No. _ approving the Coastal
Development Permit (Attachment No. ZA 1).
V.PUBLIC COMMENTS ON NON-AGENDA ITEMS
Public comments are invited on agenda and non-agenda items generally considered to be
within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit
comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your
name for the record. The Zoning Administrator has the discretion to extend or shorten the
speakers’ time limit on agenda or non-agenda items, provided the time limit adjustment is
applied equally to all speakers. As a courtesy, please turn cell phones off or set them in the
silent mode.
