LEGAL DESCRIPTION Lot 12 of Block 1
On November 2, 2022, Zoning Clearance No. PC2022-0252 was approved authorizing the
development of a new 406-square-foot attached Accessory Dwelling Unit (ADU) on the
second floor of an existing single-family residence.
This approval is based on the following standards.
1. The project is for an Accessory Dwelling Unit.
2. The project is located in the Two-Unit Residential, Balboa Island (R-BI) zoning district
and is a permitted use.
3. There is an existing single-unit dwelling on the lot.
4. The project is classified as the construction of a new attached ADU to a single-unit
dwelling.
5. The project complies with all conditions and applicable development standards of
Section 20.48.200 (Accessory Dwelling Units).
6. The project is located in the coastal zone, but exempt because the addition does not
exceed 10 percent in the project’s existing area or height.
7. A deed restriction will be recorded prior to the issuance of a building permit related
to occupancy restrictions (if applicable), prohibition on the separate conveyance, and
restrictions on short-term rentals.
