Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Antony Brine, City Traffic Engineer, tbrine@newportbeachca.gov PHONE: 949-644-3329 TITLE: Ordinance No. 2022-24: Designating Portions of Fernleaf Avenue, Goldenrod Avenue and Dahlia Avenue in Corona del Mar as One -Way Streets ABSTRACT: At the November 15, 2022 City Council meeting, the City Council introduced Ordinance No. 2022-24, An Ordinance of the City Council of the City of Newport Beach, California, Amending Section 12.52.040 (Corona del Mar) of the Newport Beach Municipal Code to Designate Portions of Streets as One -Way Traffic Only and passed the ordinance to a second reading on November 29, 2022. The Ordinance adds three street segments in Corona del Mar to Municipal Code Section 12.52.040. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Conduct second reading and adopt Ordinance No. 2022-24, An Ordinance of the City Council of the City of Newport Beach, California, Amending Section 12.52.040 (Corona del Mar) of the Newport Beach Municipal Code to Designate Portions of Streets as One -Way Traffic Only. DISCUSSION: At the November 15, 2022 City Council meeting, the City Council introduced Ordinance No. 2022-24, and passed the ordinance to a second reading on November 29, 2022. 4-1 Ordinance No. 2022-24: Designating Portions of Fernleaf Avenue, Goldenrod Avenue and Dahlia Avenue in Corona del Mar as One -Way Streets November 29, 2022 Page 2 Ordinance No. 2022-24 amends Section 12.52.040 of the Newport Beach Municipal Code by adding streets in Corona del Mar as one-way streets: 1. Dahlia Avenue from Ocean Boulevard to Seaview Avenue. Northbound traffic only. 2. Fernleaf Avenue from Seaview Avenue to Ocean Boulevard. Southbound traffic only. 3. Goldenrod Avenue from Ocean Boulevard to Seaview Avenue. Northbound traffic only. Staff recommends that the City Council conduct a second reading and adopt Ordinance No. 2022-24. FISCAL IMPACT: The adopted budget includes sufficient funding for the installation of the necessary traffic signs and markings. It will be expensed to the account in the Public Works Department, General Fund operating budget. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). NOW THEREFORE, the City Council of the City of Newport Beach ordains as follows: Section 1: Section 12.52.040 (Corona del Mar) of the NBMC is amended and replaced in its entirety with the following: 12.52.040 Corona del Mar. The following streets and alleys shall be one-way streets and alleys in the direction indicated: First alley southerly of and parallel to East Coast Highway between Marguerite Avenue and Marigold Avenue. Eastbound traffic only. Avocado Avenue between Waterfront Drive and Pacific Drive. Northeast bound traffic only. Dahlia Avenue from Ocean Boulevard to Seaview Avenue. Northbound traffic only. Fernleaf Avenue from Seaview Avenue to Ocean Boulevard. Southbound traffic only. Goldenrod Avenue from Ocean Boulevard to Seaview Avenue. Northbound traffic only. Hazel Drive from East Coast Highway southerly to Poppy Avenue. Southbound traffic only. Hazel Drive from Poppy Avenue to the alley north of East Coast Highway. Southbound traffic only. Pacific Drive between Acacia Avenue and Avocado Avenue. Northwest bound traffic only. 4-5 Ordinance No. 2022- Page 3 of 4 Section 2: The recitals provided in this ordinance are true and correct and are incorporated into the substantive portion of this ordinance. Section 3: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the introduction and adoption of this ordinance is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 5: Except as expressly modified in this ordinance, all other sections, subsections, terms, clauses and phrases set forth in the Newport Beach Municipal Code shall remain unchanged and shall be in full force and effect. Uno Ordinance No. 2022- Page 4 of 4 Section 6: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the ordinance, or a summary thereof, to be published pursuant to City Charter Section 414. This ordinance shall be effective thirty (30) calendar days after its adoption.
