TITLE: Resolution No. 2022-87: Adoption of the City Emergency Operations
Plan (EOP)
ABSTRACT:
The City of Newport Beach's (City's) existing Emergency Operation Plan (EOP) was
adopted by the City Council in 2012 and has been amended to include new and
accelerated challenges brought forth as a result of climate change, drought, wildfires, and
the COVID-19 pandemic. These events have resulted in a number of legislative changes
as well as significant updates to the Standardized Emergency Management System
(SEMS) and the National Incident Management System (NIMS), both of which the City
has adopted and implemented in its operations. The proposed 2022 Emergency
Operations Plan not only contains a comprehensive update to the content within the plan
(i.e. EOC Operations, preparedness programs, etc.) but also reflects restructuring of the
format and how the plan is written.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2022-87, A Resolution of the City Council of the City of Newport
Beach, California, Rescinding the Former Emergency Operations Plan Adopted by
Resolution No. 2011-93, Adopting the 2022 City of Newport Beach Emergency
Operations Plan, and Authorizing Submittal of the 2022 Emergency Operations Plan
to the California Office of Emergency Services.
DISCUSSION:
Over the last 10 years, there have been numerous policy and industry changes which
impact the way the City responds to disasters. To address these changes, the City
entered into an agreement with Atlas Planning Solutions to assist with the development
of a new City Emergency Operations Plan.

The proposed EOP provides an overview of the City's systems, frameworks and
processes involved in disaster preparedness, response and recovery efforts. It was
prepared with input from all City departments and details not only how the City will
respond to localized emergencies, but also explains how the response will align with other
local, state and federal agencies involved in much larger disasters through the use of the
SEMS and NIMS.
The intent of the EOP is to assist staff assigned to the City's dedicated Emergency
Operations Center (EOC). The plan is detailed enough to provide for an effective
response yet is flexible enough to be used in any emergency response situation. This
plan does not address ordinary day-to-day emergencies or the established departmental
procedures used to cope with such incidents. Rather, this multi -hazard plan concentrates
on management, concepts and response procedures relative to large-scale disasters.
Such disasters pose major threats to life, the environment and property and can impact
the well-being of a large number of people.
The Police Department will be responsible for the ongoing maintenance of the EOP to
reflect any applicable changes that are made, including EOC staff assignment changes.
All changes to the EOP will be documented in the record of revisions table and will be
distributed to all City departments and agencies shown on the distribution list. The plan
will come to the City Council for approval and adoption by proclamation every five years.
FISCAL IMPACT:
There is no financial impact to the City of Newport Beach by adopting the resolution
approving the 2022 Emergency Operations Plan. However, the failure to adopt this
resolution and provide the City with an approved EOP that aligns with SEMS and NIMS
could result in future impacts to the General Fund by making the City ineligible for state
and federal grant programs as well as disaster recovery Public Assistance.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, RESCINDING THE
FORMER EMERGENCY OPERATIONS PLAN ADOPTED
BY RESOLUTION NO. 2011-93, ADOPTING THE 2022
CITY OF NEWPORT BEACH EMERGENCY
OPERATIONS PLAN, AND AUTHORIZING SUBMITTAL
OF THE 2022 EMERGENCY OPERATIONS PLAN TO
THE CALIFORNIA OFFICE OF EMERGENCY SERVICES
WHEREAS, the 2022 City of Newport Beach Emergency Operations Plan ("2022
EOP"), as shown in Attachment "A," attached hereto and incorporated herein, is an
updated and revised emergency operations plan that sets forth the policy and procedures
for the City of Newport Beach ("City") to manage and respond to major emergency
incidents, including implementation of an Incident Command System ("ICS") consisting
of executive leadership staff, establishing clear designations of distinct functions which
must be conducted during a disaster, assigning distinct functions to specific City
departments, and providing guidelines for performance of the functions of the Emergency
Operations Center;
WHEREAS, the 2022 EOP meets all federal and state criteria, as described in the
Federal Emergency Management Agency Comprehensive Preparedness Guide 101, the
National Incident Management System ("NIMS"), and Standardized Emergency
Management System ("SEMS");
WHEREAS, the 2022 EOP addresses how the City will perform evacuations, care
and sheltering operations, emergency alerts and notifications, and provides a framework
for recovery operations;
WHEREAS, the 2022 EOP sets forth strategies and programs for implementation
to better prepare the public for natural and human caused disasters;
WHEREAS, the 2022 EOP establishes the procedure for requesting mutual aid
and resources from the County of Orange, the State of California, and the Federal
Government when needed; and
WHEREAS, the 2022 EOP was developed with input from all City departments
and has been reviewed and approved by all City department directors.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows..

Section 1: The City Council does hereby rescind Resolution No. 2011-93,
adopted by City Council on September 27, 2011.
Section 2: The City Council does hereby adopt the 2022 City of Newport Beach
Emergency Operations Plan, attached hereto as Exhibit "A" and incorporated herein by
reference.
Section 3: The City Council does hereby authorize the Emergency Services
Coordinator to submit the 2022 City of Newport Beach Emergency Operations Plan to the
California Office of Emergency Services.
Section 4: The recitals provided in this resolution are true and correct are
incorporated into the operative part of this resolution.
Section 5: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 6: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.

Section 7: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
