AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AMENDING
SECTION 12.52.040 (CORONA DEL MAR) OF THE
NEWPORT BEACH MUNICIPAL CODE TO DESIGNATE
PORTIONS OF STREETS AS ONE-WAY TRAFFIC ONLY
WHEREAS, Section 200 of the City of Newport Beach ("City") Charter vests the
City Council with the authority to make and enforce all laws, rules, and regulations with
respect to municipal affairs subject only to the restrictions and limitations contained in
the Charter and the State Constitution, and the power to exercise, or act pursuant to
any and all rights, powers and privileges, or procedures granted or prescribed by any
law of the State of California;
WHEREAS, Section 12.52.010 (Placement of Appropriate Signs) of the Newport
Beach Municipal Code ("NBMC") establishes that an ordinance or resolution of the City
may designate any one-way street or alley, and that the City Traffic Engineer shall place
and maintain signs giving notice thereof;
WHEREAS, Section 12.52.040 (Corona del Mar) of the NBMC designates one-
way streets and alleys in Corona del Mar;
WHEREAS, on April 12, 2022, the City Council approved a trial one-way
designation of Fernleaf Avenue between Seaview Avenue and Ocean Boulevard for a
six-month trial observation period;
WHEREAS, traffic data has been collected and observations indicate that
Fernleaf Avenue can effectively operate as a one-way street;
WHEREAS, the residents of Fernleaf Avenue have requested that the segment
of Fernleaf Avenue between Seaview Avenue and Ocean Boulevard be permanently
designated as a one-way street in the southbound direction, as shown in Exhibit "A",
attached hereto and incorporated herein;
WHEREAS, the traffic data collected during the trial period indicates that the trial
one-way street designation of Fernleaf Avenue caused a diversion of traffic volumes to
the adjacent parallel segments of Goldenrod Avenue and Dahlia Avenue;
WHEREAS, the residents of Goldenrod Avenue and Dahlia Avenue have
requested that Goldenrod Avenue and Dahlia Avenue between Ocean Boulevard and
Seaview Avenue be designated as one-way streets in the northbound direction, as

shown in Exhibit "A", to address their safety concerns and to improve access/egress to
and from the Corona del Mar beach area; and
WHEREAS, Hazel Drive from Poppy Avenue to East Coast Highway southbound
is one-way for only a portion that segment and Section 12.52.040 should be amended
accordingly.
NOW THEREFORE, the City Council of the City of Newport Beach ordains as
follows:
Section 1: Section 12.52.040 (Corona del Mar) of the NBMC is amended and
replaced in its entirety with the following:
12.52.040 Corona del Mar.
The following streets and alleys shall be one-way streets and alleys in the direction
indicated:
First alley southerly of and parallel to East Coast Highway between Marguerite Avenue
and Marigold Avenue. Eastbound traffic only.
Avocado Avenue between Waterfront Drive and Pacific Drive. Northeast bound traffic
only.
Dahlia Avenue from Ocean Boulevard to Seaview Avenue. Northbound traffic only.
Fernleaf Avenue from Seaview Avenue to Ocean Boulevard. Southbound traffic only.
Goldenrod Avenue from Ocean Boulevard to Seaview Avenue. Northbound traffic only.
Hazel Drive from East Coast Highway southerly to Poppy Avenue. Southbound traffic
only.
Hazel Drive from Poppy Avenue to the alley north of East Coast Highway. Southbound
traffic only.
Pacific Drive between Acacia Avenue and Avocado Avenue. Northwest bound traffic
only.

Section 2: The recitals provided in this ordinance are true and correct and are
incorporated into the substantive portion of this ordinance.
Section 3: If any section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this ordinance. The
City Council hereby declares that it would have passed this ordinance and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 4: The City Council finds the introduction and adoption of this
ordinance is not subject to the California Environmental Quality Act ("CEQA") pursuant
to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a
project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in
physical change to the environment, directly or indirectly.
Section 5: Except as expressly modified in this ordinance, all other sections,
subsections, terms, clauses and phrases set forth in the Newport Beach Municipal Code
shall remain unchanged and shall be in full force and effect.

Section 6: The Mayor shall sign and the City Clerk shall attest to the passage
of this ordinance. The City Clerk shall cause the ordinance, or a summary thereof, to be
published pursuant to City Charter Section 414. This ordinance shall be effective thirty
(30) calendar days after its adoption.
This ordinance was introduced at a regular meeting of the City Council of the City
of Newport Beach held on the 15th day of November, 2022, and adopted on the 29tn
day of November, 2022, by the following vote, to -wit:
