Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Tom Sandefur, Assistant City Engineer, tandefur@newportbeachca.gov PHONE: 949-644-3321 TITLE: Civic Center Dog Park Refurbishment (Project No. 22P12) — Notice of Completion for Contract No. 8717-1 ABSTRACT: On February 8, 2022, the City Council awarded Contract No. 8717-1, Civic Center Dog Park Refurbishment, to Western State Builders, Inc. (WSB) of Escondido, California. This project replaced the worn-out synthetic turf, drinking water fountains, and fence screening, repainted fencing and signage, repaired uplifted sidewalk, and added two new shade structures for the small dog park users. The work is now complete and staff requests City Council acceptance and closeout of the contract. RECOMMENDATION: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after Notice of Completion has been recorded in accordance with applicable portions of the Civil Code -land c) Release the Faithful Performance Bond one year after acceptance by the City Council. The contract has been completed to the satisfaction of the Public Works Department and the Recreation and Senior Services Department. A summary of the construction cost is as follows: Original Bid Amount: $ 241,036.26 Actual Cost of Bid Items Constructed: $ 237,036.26 Total Change Orders: $ 3,832.25 Final Contract Cost: $ 240,868.51 The -0.1 % contract cost change is due to a reduced drinking fountain unit cost and two change orders issued for the project. The contractor was able to reuse the existing drinking fountain foundations thereby reducing the concrete and labor costs for this scope. The two change orders issued were for replacing additional concrete panels, polishing benches, replacing broken drinking water fountain valves, and issuing additional working days due to unforeseen field conditions. A summary of the project schedule is as follows: Estimate Start of Construction per Annual Baseline Schedule August 1, 2022 Actual Issuance of Notice to Procure April 11, 2022 Actual Start of Construction per Notice to Proceed October 3, 2022 Actual Substantial Construction Completion Date November 14, 2022 FISCAL IMPACT: The Civic Center Dog Park Refurbishment Project was included within the FY 2021-22 Capital Improvement Program (CIP) Budget. Funds for the construction contract were expended from the following account: Account Description General Fund - CIP ENVIRONMENTAL REVIEW: Account Number 01201929-980000-22 P 12 Total Amount $ 240,868.51 $ 240,868.51 On February 8, 2022, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 Class 1 (maintenance of existing public facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. 5-2 Civic Center Dog Park Refurbishment (Project No. 22P12) — Notice of Completion for Contract No. 8717-1 December 13, 2022 Page 3 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
