The Board of Library Trustees meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act
requires that the Board of Library Trustees agenda be posted at least seventy-two (72) hours in advance of each regular
meeting and that the public be allowed to comment on agenda items before the Commission and items not on the
agenda but are within the subject matter jurisdiction of the Board of Library Trustees. The Chair may limit public
comments to a reasonable amount of time, generally three (3) minutes per person.
The public can submit questions and comments in writing for the Board of Library Trustees to consider. Please send
them by email to the Library Services Department at LibraryBoard@newportbeachca.gov by Sunday, December 18, at 4:00
p.m. to give the Board of Library Trustees time to consider your comments. All emails will be made part of the record.

A.Consent Calendar Items
1.Minutes of the October 17, 2022 Board of Library Trustees (BLT) Meeting
Chair Watkins introduced the Consent Calendar and confirmed that the other Trustees did
not wish to discuss and/or did not wish to remove items from the Consent Calendar. He
then called for the public comment but heard none and noted that he had several
comments.
2. Patron Comments
Monthly review of evaluations of library services through suggestions and requests
received from patrons.

Monthly update of library events, services, and statistics.

Chair Watkins noted that one-third of the way into the Fiscal Year (FY) they had expended
32% of the budget. They remain approximately 1% underbudget.
5. Board of Library Trustees Monitoring List
List of agenda items and dates for monthly review of projects by the BLT.
Chair Watkins called for a Motion on the minutes and noted that Trustee Kumra would be
abstaining because of his prior absence.
Motion made by Trustee Glabman, seconded by Secretary Coulter, and carried (4-0-0-1)
to approve the Consent Calendar with the minutes as presented.

A. Items for Review
6. Resolution Honoring Library Facilities Specialist Eddie Flores
The BLT will honor Eddie Flores for his 40 years of service to the City of Newport
Beach.
Chair Watkins read a resolution in honor of Eddie Flores’ 40 years with the City of Newport
Beach.
7. Media Lab Use Policy (NBPL 6)
Staff recommends that the BLT review Library Policy NBPL 6, Media Lab Use, and
requests the Board approve changes.
Library Services Director Hartson reported that the Media Lab Use policy served its
purpose, and the lab was available to the public with reservations. Staff did not
recommend any major changes to the policy. Staff recommended a minor change to the
format as the Library no longer sold CDs.
Chair Watkins called for BLT discussion and the public comment but heard none.
Motion made by Secretary Coulter, seconded by Trustee Kumra, and carried (4-0-0-1) to
approve the changes to Library Policy NBPL 6, Media Lab Use, as presented.

8. Sound Lab Use Policy (NBPL 7)
Staff recommends that the BLT review Library Policy NBPL 7, Sound Lab Use,
and requests the Board approve changes.
Chair Watkins stated that NBPL 7 had the same changes as NBPL 6.
Library Services Director Hartson indicated that the exact same line was changed in both
policies as the Library no longer sold CDs.
Chair Watkins confirmed that the policies were similar.
Library Services Director Hartson agreed that was true.
Chair Watkins called for BLT or public comment.
Rhonda Watkins, Newport Beach resident, inquired about the cost of flash drives sold to
patrons.
Adult Services Coordinator/Acting Library Services Manager Lightfoot said they were
market price and the discount provided fluctuated. Currently they were $4 each and the
Library did not profit from them.
Motion made by Secretary Coulter, seconded by Trustee Kumra, and carried (4-0-0-1) to
approve the changes to Library Policy NBPL 7, Sound Lab Use, as presented.

9. Grant Acceptance from California State Library
Staff recommends the BLT approve the acceptance of a grant from the California
State Library Literacy Services to support the Newport Beach Public Library’s
Project Adult Literacy (PAL) Program.
Chair Watkins stated that the grant was from the California State Library in the amount of
$43,022.
Library Services Director Hartson explained that the City applied for State Grants for
Literacy Services every year. The grant amount was awarded based on the number of
learners and tutors in the program as well as other factors. The $43,022 grant was the first
of a two part grant. A smaller amount would come through in Spring 2023. The grant was
to support staffing of Literacy Services programming.
Chair Watkins confirmed that a thank you letter would be sent.

Library Services Director Hartson indicated that she would follow up on that.
Trustee Glabman asked who the grant writer was.
Library Services Director Hartson explained that the grant was part of the program and
was an annual report submitted by the Literacy Coordinator.
Trustee Glabman suggested that person send the thank you letter.
Jerry Kappel, Newport Beach Public Library Foundation (NBPLF), explained that a report
was provided to the State annually. There was not really anyone to thank as the grant
went through a panel. He suggested thanking the local state legislators.
Chair Watkins confirmed there was no further BLT discussion and no public comment.
Motion made by Secretary Coulter, seconded by Trustee Glabman, and carried (4-0-0-1)
to accept the grant from the California State Library Literacy Services to support the
Newport Beach Public Library’s PAL Program.

10. Lecture Hall Update
Trustee Ray will report on activities related to the Library Lecture Hall project.
Library Services Director Hartson reported that City Council approved the remaining
naming rights with the Stahr Courtyard and Louise and Roy Woolsey Memorial Lobby.
The Beyond Books Campaign was live on the website as they had moved into the public
portion of the campaign.
Chair Watkins inquired about the fund matching program.
Mr. Kappel said that they were at a 40% match of $500,000. He also noted that the
amendment to the Memorandum of Understanding (MOU) was approved. That included
the potential naming right for the auditorium.
Chair Watkins thought fundraising was going well.
Mr. Kappel stated they met the initial threshold.

11. Balboa Branch Replacement Update
Trustee Ray will report on activities related to the Balboa Branch Replacement
project.

Library Services Director Hartson reported that the bids had closed. Public Works was
reviewing the submissions and the award would go out in 2023. Once the consultant was
picked the BLT would have input.
Chair Watkins confirmed that Library Services Director Hartson was speaking about an
architect.
Library Services Director Hartson said that they would know in the new year who won the
bid.
Chair Watkins called for BLT or public comments and heard none, so he received and
filed the report.
12. Library Services
Report of Library issues regarding services, patrons, and staff.
Library Services Director Hartson noted that the BLT met the new Literacy Coordinator
earlier in the evening. She read from the meeting packet a list of employees with milestone
service years. The PAL Holiday Party was scheduled for Saturday, December 3, 2022, at
10:00 a.m. and RSVPs were accepted through the website.
Chair Watkins called for BLT or public comment, but there was none. He received and
filed the report.
B. Monthly Reports
13. Library Foundation Liaison Reports
A. Library Foundation Board – Report on the most recently attended meeting.
Library Services Director Hartson reported that the Board met and approved a fundraising
event in January. They were also rolling out a Giving Tuesday campaign focused on
technology for the Library.
Mr. Kappel explained that Giving Tuesday was the Tuesday following Thanksgiving and
was a national day of giving. Last year’s campaign was for children’s books at the
Mariner’s Branch. This year they intended to upgrade tech toys and purchase audio
enabled books for children. They were publicizing the drive with an email to their 15,000
followers.
Chair Watkins called for BLT and public comment, but there was none so he received and
filed the report.
B. Library Live Lectures Committee – Report on the most recently attended
meeting.
Trustee Kumra stated that the last event was well attended.
Chair Watkins said that 160 people attended.

Trustee Kumra said that the author was excellent. The Library Live Committee was looking
to expand the types of authors and subjects in 2023. The goal was to make future events
as successful as possible.
Chair Watkins noted that the focus of the Library Live Lectures had been on fiction.
Trustee Kumra believed the intent was to still discuss fiction, but to open it up to more
types of fiction.
Trustee Glabman asked if they were looking for authors that would be bigger draws.
Trustee Kumra said that there was discussion about hosting big names versus up-and-
coming authors. In order to bring more known authors, the budget would have to increase
and that was a Board level decision.
Mr. Kappel commended the Chair for his introduction of the speaker. The last speaker of
the year, Min Jin Lee, was expected to sell out and had already sold 100 seats. They
extended invitations to the learners from PAL in order to encourage them to read.
Chair Watkins confirmed there was no further discussion and received and filed the report.
C. Witte Lectures Committee – Report on the most recently attended meeting.
Chair Watkins said that the Committee was impressive and that he had enjoyed watching
them discuss the upcoming season. He announced Anne Applebaum had sold 83 tickets
for February 10 and 70 tickets for February 11. Dr. Arthur Caplan sold 69 tickets for March
3 and 65 tickets for March 4. Cristina Mittermeir sold 71 tickets for March 31 and 67 tickets
for April 1. Dr. Jill Lepore sold 77 tickets for April 28 and 75 tickets for April 29. With 300
fixed seats in the new library lecture hall, they would need to increase attendance to justify
the size of the facility. He called for BLT or public comment, but there was none. He
indicated the BLT received and filed the report.
14. Friends of the Library Liaison Report
Trustee update on the most recently attended Friends of the Library Board
meeting.
Secretary Coulter reported that the Friends of the Library did not meet in November. They
had a volunteer lunch attended by 61 people that was lovely. In June they hold a member
luncheon. The volunteer luncheon honored people that had served anywhere from 5 to 25
years. The income for October 2022 was $23,867 which was up from $19,618 in October
2021. The next sale was scheduled for January 13 and 14 with January 13 being only
open to members. The Friends hoped to have 600 boxes of books by that date. The
Friends were a great organization, and he was honored to represent the BLT before them.
Trustee Glabman stated that the Friends funded wonderful programming.
Chair Watkins called for BLT and public comment. Hearing none he received and filed the
report.
15. Literacy Services Liaison Report

Trustee update on the most recently attended Project Adult Literacy (PAL)
Advisory Board meeting.
Trustee Glabman stated that the BLT had met Literacy Coordinator Claudia Lavenant.
There were currently 60 active tutors, with 12 waiting and 94 active learners, with 17
waiting. $43,022 was received from the California Library Literacy Services Grant. Classes
were currently full, with a waiting list, and she listed the courses for the BLT. A new course
was proposed called News Bias and she thought that had the potential to be opened to
the entire Library community. The annual report was in progress and a solicitation letter
went out earlier in the week. California placed a value of $33.61/hour on volunteers and
that translated to $14,822 in volunteer hours for September 2022. PAL was losing Board
Members and any recommendations for people should be directed to the PAL office. She
was impressed with the caliber of the people who served.
Chair Watkins called for further comment or questions from both the BLT and the public.
Hearing none he received and filed the report.

Chair Watkins announced that the next BLT meeting was scheduled for December 19. He
also mentioned the Corona del Mar branch’s Holiday Open House on December 3.
Branch and Youth Services Coordinator Annika Helmuth explained that there would be
crafts, children’s activities, performances by local high school students, and refreshments.

No pressure if this is not possible, but I was just wondering. The discarded audiobooks from your library will find a great home in my room. I listen to a variety every night. I prefer the old-fashioned way of popping CDs into my player. I'm just not used to the style of ebooks or playaways. If you also discard MP3 CDs, I would like those as well. My favorite audiobook companies are Recorded Books and Midwest Tape. If you have any audiobooks discarded by these 2 companies, I would like all of them please.Thank you for reaching out to us. Library Journal’s Star Library Ratings
Newport Beach Public Library was awarded 4 Stars in a national ranking compiled by Library Journal. The
2022 Library Journal Index of Public Library Service and Star ratings are based on FY 2019-20 datasets.
Statistics from the Institute of Museum and Library Services (IMLS) Public Library Survey (PLS) are
compared among spending peers ($5M-$9.9M expenditure range) in eight areas: physical circulation,
circulation of electronic materials, library visits, program attendance, public internet computer usage, Wi-
Fi sessions, electronic content retrievals, and library website visits. This is the first time library website
visits is included in the calculations. Newport Beach Public Library is the only Star Library recognized in
Orange County and one of twelve in California. The Library is one of ten libraries nationwide to move
from 3 to 4 stars this year and has received Star-status thirteen out of fifteen years.

ANNIKA HELMUTH, BRANCH AND YOUTH SERVICES COORDINATOR
Branches
Storytimes remain popular at Corona del Mar as do monthly drop-in crafts. Programming at CdM totaled
405 total participants for the month. Test proctoring saw an increase to 12 tests in November. Monthly
book displays also remain popular.
Balboa’s November craft program, Autumn in the Forest, hosted 26 participants for painting fun. Staff
continued with routine weeding of the Adult and Children’s Nonfiction collections.
At Mariners, storytimes resumed indoors and a Be Thankful craft program was popular with patrons. Sully
Jacome joined the Mariners branch as a Library Page. With this staff assignment, the Mariners’ circulation
team is once again fully staffed.

Youth Services
The Youth Services team at Central is also once again fully staffed with part-time Library Assistant, Victoria
Freshwater joining the team in late October and Children’s Librarian II, Christine Lefter joining the team
in November. We are excited to have both Victoria and Christine on board.
Central hosted three first-grade class field trips this month with 180 students, teachers, and parents from
Eastbluff Elementary, Newport Heights Elementary, and Our Lady Queen of Angels enjoying a storytime
and tour of the Children’s Room. A special behind-the-scenes walk through the circulation department
was a crowd favorite.
Eastbluff’ s Reflections, a student art program, was on display in the Central Library Children’s Room early
in the month. This year’s theme, Show Your Voice, invited Eastbluff Elementary students to show their
creativity and voice through art and literature.
Two monthly on-going programs, LEGO Saturdays and Crafternoons, remain popular with 51 and 58
participants respectively. Central also hosted STEM: The Science of Toys, a special program for families to
explore the science behind classic toys. Forty-four participants used the basic concepts of energy and
force to create their own wind-up toys, climbing toys and spinning tops. Parents and caregivers shared
that the design challenges were fun and engaging for their children.
All locations took part in the always popular In-N-Out Cover to Cover Club reading challenge. The program,
which started in October, challenged children to read five books and earn a gift certificate for a free
cheeseburger or hamburger. The program ended on November 12 with a total of 608 participants.
Teen Services
The November Young Adult Advisory Council (YAAC) meeting was a fun one as teens helped to create Cozy
Winter Wonderland decorations for the Children’s Room. The teens also played musical chairs for an ice
breaker and shared their Thanksgiving traditions. It was a welcomed creative break for the teens as
studying for final exams loomed in the coming days.

Staffing
Part-time Library Clerk Janet Campbell started at the Central Library on November 8, filling the last
remaining Library Clerk vacancy. There is an open Library Page recruitment to fill five vacancies
throughout the system.
Passport Services
Passport acceptance agents at the Central Library are in the process of completing their annual
recertification.

Programming
In November, the Library held the final Storytellers Writing Workshop series for 2022. The writing series
will be offered again in early 2023.
November’s Sunday Musicale, held on November 20, featured The Madeleine Trio. They were well-
received with 161 in attendance.

Personnel
Mariners will welcome a new Librarian I at the end of December, Leah Duffy. Leah currently works for the
City of Newport Beach. She has previously worked for the Library as a Page, Clerk, and Library Assistant
while earning her master’s degree.

RECOMMENDATION:
Staff requests the Board of Library Trustees review and approve the revisions to Library Policy NBPL 12,
Circulation Policy.
DISCUSSION:
The purpose of the Circulation Policy is to present guidelines for maintaining accurate, efficient, and
consistent service procedures throughout the Newport Beach Public Libraries. The Board of Library
Trustees last updated this policy June 2022 to correct minor grammatical revisions.
Staff now recommend updating the confidentiality of records portion of the policy to reflect that CA
Government Code $6267 will be repealed as of January 1, 2023 and replaced with CA Government Code
$7927.105.
NOTICING:
This agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the Board of Library Trustees considers the item).

Circulation Policy
1.0 Library Patron Cards
Individual Library patron cards are issued to all residents of Newport Beach upon presentation of
proper identification. All applicants under the age of 18 will be required to have a parent/guardian
signature to obtain a library card. Guest cards will not be issued to anyone under the age of 18.
1.01 Under the State Universal Borrowing Agreement, individual Library patron cards will be issued
to persons who do not reside in Newport Beach, but who are residents of the State of California,
utilizing the same criteria as above.
1.02 A family borrower's card will be issued to a non-California resident upon payment of a $10.00
annual fee.
1.03 A replacement for a lost card will be issued upon proof of identification.
1.04 A “computer use only” Library card with no material borrowing privileges may be issued to
persons who wish to use the Library’s public computer workstations and on-line databases. Proof
of identification is necessary.
1.05 Lifetime cards may be issued at the discretion of the Board of Library Trustees.
2.0 Definitions
Library materials are defined as indicated.
2.01 Reference Materials - Materials for use only within the Library facility, including newspapers
and current issues of periodicals.

day periods if the item has not been reserved.

4.0 Fines and Fees
Library patrons are responsible for returning borrowed materials by the end of the loan
period. Library materials are considered in circulation until checked-in at a Newport Beach Public
Library.
4.01 Overdue fines are charged for materials returned after the due date. The fine schedule is
established by the Board of Library Trustees and reviewed on a biennial basis.
4.02 Library patrons are responsible for the replacement cost of lost materials, plus a processing
charge.
4.03 Overdue fines are not charged to patrons registered in the homebound program.
5.0 Library Privileges
The Library reserves the right to refuse borrowing privileges to patrons who abuse Library
privileges. Such patrons may be identified as delinquent. Delinquent may be defined by the
following circumstances:
5.01 A patron whose record shows unpaid fines and fees of $5.00 or more.
5.02 A patron who has ten overdue items outstanding.
5.03 A patron who has moved without notifying the Library of the current correct address.
6.0 Placing of Reserves
Library patrons are permitted to place reserves on General Materials, New Books, Paperbacks,
Compact Discs, eBooks, Tech Toys, Non-rental DVDs/Blu-rays and Video Games in the
collection. Reserves may also be placed for these materials, which are “on order”.
7.0 Confidentiality of Patron Records
All patron use records of any library which is in whole or in part supported by public funds shall
remain confidential and shall not be disclosed by a public agency, or private actor that maintains or
stores patron use records on behalf of a public agency, to any person, local agency, or state agency
except as follows:
(a)By a person acting within the scope of his or her duties within the administration of the library.
(b)By a person authorized, in writing, by the individual to whom the records pertain, to inspect the
records.
(c)By order of the appropriate superior court.

Circulation Policy
1.0 Library Patron Cards
Individual Library patron cards are issued to all residents of Newport Beach upon presentation of
proper identification. All applicants under the age of 18 will be required to have a parent/guardian
signature to obtain a library card. Guest cards will not be issued to anyone under the age of 18.
1.01 Under the State Universal Borrowing Agreement, individual Library patron cards will be issued
to persons who do not reside in Newport Beach, but who are residents of the State of California,
utilizing the same criteria as above.
1.02 A family borrower's card will be issued to a non-California resident upon payment of a $10.00
annual fee.
1.03 A replacement for a lost card will be issued upon proof of identification.
1.04 A “computer use only” Library card with no material borrowing privileges may be issued to
persons who wish to use the Library’s public computer workstations and on-line databases. Proof
of identification is necessary.

2.12 Streaming Video – Circulating digital video content transmitted through an Internet connection.
Content may be viewed on a personal computer, mobile device, or via a digital media player.

2.13 Databases - Electronic databases to which the Library subscribes. Many of these databases
may be used remotely.
2.14 Internet - Many additional resources are available on the Internet and can be reached through
library equipment.
2.15 Interlibrary Loan (abbreviated “ILL”) - Service whereby a user of one library may borrow books
or receive photocopies of documents that are owned by another library. Users request materials,
and the Library, acting as an intermediary, identifies owners of the desired item, places the request,
receives the item, makes it available to the user, and arranges for its return.
2.16 Laptops– Circulating computers that may be used in the Library.
2.17 Tech Toys – Circulating media and technology equipment such as a GoPro camera or USB
enabled turntable.
3.0 Loan Periods
Loan periods and renewals for materials vary as stated below. Eligible items will automatically
renew for four additional loan periods if the item has not been reserved.
3.01 Reference Materials, including newspapers and the current issues of periodicals, may not be
checked out.
3.02 The loan period for General Materials is 21 days and may be renewed for four additional 21-
day periods if the item has not been reserved.
3.03 The loan period for Paperbacks is 21 days and may be renewed for four additional 21-day
periods if the item has not been reserved.
3.04 The loan period for circulating Periodicals is 21 days and may be renewed for two additional
21-day periods. Current issues and bound volumes of Periodicals may not be checked out.
3.05 The loan period for New Books is 21 days and may be renewed for four additional 21-day
periods if the item has not been reserved.
3.06 The loan period for Lucky Day Books is 7 days and may not be renewed.
3.07 The loan period for Rental DVDs/Blu-rays is 1 day and may not be renewed.
3.08 The loan period for Compact Discs is 21 days and may be renewed for four additional 21-day
periods if the item has not been reserved.
3.09 The loan period for Non-rental DVDs/Blu-rays is 7 days and may be renewed for four additional
7-day periods if the item has not been reserved.
3.10 The loan period for Video Games is 7 days and may be renewed for four additional 7-day
periods if the item has not been reserved.
3.11 The loan period for eBooks is 7, 14, or 21 days.
3.12 The loan period for streaming video is 3, 5, or 7 days.
3.13 The loan period for Laptops is 1 hour and may be renewed for 20-minute increments as long as
there is not a waiting list. These devices are for use within the Library building only. See the LAPTOP
USE policy for more details.

3.14 Loans of certain materials are made to teachers for classroom use and to the homebound, with
a loan period of 4 weeks.
3.15 The loan period for ILL items is determined by the lending library.
3.17 The loan period for Tech Toys is 7 days and may not be renewed.
4.0 Fines and Fees
Library patrons are responsible for returning borrowed materials by the end of the loan
period. Library materials are considered in circulation until checked-in at a Newport Beach Public
Library.
4.01 Overdue fines are charged for materials returned after the due date. The fine schedule is
established by the Board of Library Trustees and reviewed on a biennial basis.
4.02 Library patrons are responsible for the replacement cost of lost materials, plus a processing
charge.
4.03 Overdue fines are not charged to patrons registered in the homebound program.
5.0 Library Privileges
The Library reserves the right to refuse borrowing privileges to patrons who abuse Library
privileges. Such patrons may be identified as delinquent. Delinquent may be defined by the
following circumstances:
5.01 A patron whose record shows unpaid fines and fees of $5.00 or more.
5.02 A patron who has ten overdue items outstanding.
5.03 A patron who has moved without notifying the Library of the current correct address.
6.0 Placing of Reserves
Library patrons are permitted to place reserves on General Materials, New Books, Paperbacks,
Compact Discs, eBooks, Tech Toys, Non-rental DVDs/Blu-rays and Video Games in the
collection. Reserves may also be placed for these materials, which are “on order”.
7.0 Confidentiality of Patron Records
Library employees must refer all court-ordered requests to the Library Services Director.
The Library shall, at all times, abide by California Government Code § 7927.105, which provides as
follows:
California Government Code § 7927.105
(a) As used in this section, the term “patron use records” includes both of the following:
(1) Any written or electronic record that is used to identify a library patron and is provided by the
patron to become eligible to borrow or use books and other materials. This includes, but is not
limited to, a patron’s name, address, telephone number, or email address.
(2) Any written record or electronic transaction that identifies a patron’s borrowing information
or use of library information resources. This includes, but is not limited to, database search

records, borrowing records, class records, and any other personally identifiable uses of library
resources, information requests, or inquiries.
(b) This section does not apply to either of the following:
(1) Statistical reports of patron use.
(2) Records of fines collected by a library.
(c) All patron use records of a library that is in whole or in part supported by public funds shall
remain confidential. A public agency, or a private actor that maintains or stores patron use records
on behalf of a public agency, shall not disclose those records to any person, local agency, or state
agency, except as follows:
(1) By a person acting within the scope of the person’s duties within the administration of the
library.
(2) By a person authorized in writing to inspect the records. The authorization shall be from the
individual to whom the records pertain.
(3) By order of the appropriate superior court.

8.0 Special Conditions
8.01 Fees for Use.
Use fees are charged for the Rental DVD/Blu-ray collections. These fees are established by the Board
of Library Trustees and reviewed on a biennial basis.
8.02 Patrons must be 18 years of age or older to checkout DVDs/Blu-rays, Video Games and Tech
Toys.
8.03 A fee is charged for Interlibrary Loan (ILL) service.
9.0 Circulation Policies Schedule of Fines/Fees.
