The property is not located within a Planned Unit Development or an overlay district. For the abutting properties to the north, the Zoning District is Single-Unit Residential (R-1) and the General Plan land use designation is Single Unit Residential Detached (RS-D). For the abutting properties to the south, the Zoning District is Planned Community - Balboa Bay Club (PC45) and the General Plan land use designation is Visitor Serving Commercial (CV). For the abutting properties to the east and the west, the Zoning District is Commercial General (CG) and the General Plan land use designation is General Commercial (CG). At the time the building permits were finaled, the building and parking requirements were in substantial conformance with the development standards of the City of Newport Beach Municipal Code. If the subject property does not comply with the current regulations, it is considered to be nonconforming and is subject to Chapter 20.38 (Nonconforming Uses and Structures) of the Newport Beach Municipal Code. Discretionary approvals for the subject property are available at the following link: https://nbgis.newportbeachca.gov/gispub/CommunityDevelopment/PlanningCase sList/default.aspx?UNIQUE_TAG=26331%20H4C_100 The following discretionary approvals were acquired from the City of Newport Beach Planning Division: 1200 West Coast Highway • PA2015-056 (CA2015-005) – approved on June 26, 2015 to amend the Zoning Code for consistency after the adoption of comprehensive update created some unintended changes in zoning regulations. • Use Permit No. UP3429, 3429A – approved with conditions on October 24, 1991 to permit a hand carwash, auto detail, and boutique with request to exceed height limit. An amendment was approved on March 19, 1992 to permit gasoline sales, in addition to the previously approved carwash, detail, and boutique uses. • Variance Permit No. VA1107 – denied by Planning Commission on December 8, 1983 but overruled by City Council (variance deemed not necessary) to establish one building site and eliminate interior lot lines where four lots currently exist to allow alterations to an existing automobile sales facility. The decision upheld UP1987. • Use Permit No. UP1987, 1987A – approved on April 23, 1981 to permit the sales and service of automobiles along with iron fencing and gates across property frontage. An amendment was approved on December 8, 1983 to expand the existing auto sales facility and establish a separate automobile service facility with a waiver for a portion of off-street parking. • Use Permit No. UP1813 – approved on January 20, 1977 to permit the establishment of a boat sales facility in the C-1-H District. • Use Permit No. UP1333 – approved with conditions on January 18, 1968 to permit operation of an automobile sales showroom for new or used cars and repair shops within a building. • Use Permit No. UP0983 – approved with conditions on September 19, 1963 to permit boat sales and related marine service and repairs. • Use Permit No. UP0159 – approved with conditions on November 18, 1954 to permit construction and operation of an automobile sales showroom for new or used cars and repair shops within a building as UP0133 was not exercised. The subject property does not have any active complaints on record.
