HomeMy WebLinkAboutPA2022-0275_20221121_Outdoor dining permit extension letter requestNovember 21, 2022 Newport Beach Community Development Department Planning Division Jaime Murillo, Zoning Administrator 1 Civic Center Drive, Newport Beach CA, 92660 RE: Extension Request for Limited Term Permit No. XP2021-009 and Coastal Development Permit No. 2021-038 (PA2021-187) for and outdoor dining area located at Chihuahua Brewing Company located at 3107 Newport Boulevard Dear Zoning Administrator Murillo: On November 10, 2021, you, acting in your role as Newport Beach Zoning Administrator, approved a limited term permit and coastal development permit to allow a temporary outdoor dining area for Chihuahua Brewing Company located in The Landing Shopping Center. The limited term permit is effective from January 1, 2022, to December 31, 2022. Pursuant to condition of approval No. 2 and Municipal Code Sections 20.52.040(J) (Extension of Limited Term Permit) and 21.54.060 (Time Limits and Extensions), Chihuahua Brewing Company is requesting a 12-month extension of the approved permits with a new expiration date of December 31, 2023. If approved, the operation of the temporary outdoor dining area will continue pursuant to the conditions of approval contained in Zoning Administrator Resolution No. ZA2021-065. We believe this extension is justified and that facts in support of the required findings for the original approval remain valid. Additionally, the ongoing adherence to the conditions of approval will ensure continued compatibility with the surrounding land uses. Notably, the hours operation limitations ensure the outdoor dining area is not used past 9:00 p.m. on Sunday through Thursday, and 10:00 p.m. on Friday and Saturday, accessible paths of travel and exiting requirements are provided and adequate barriers are in place to separate the outdoor dining area from vehicles using the parking lot. The temporary outdoor dining area also complies with all applicable Local Coastal Program (LCP) development standards and maintains an area consistent with the existing pattern of development on the Balboa Peninsula. Furthermore, Council Policy D-9 recognizes the need to balance economic development objectives with protection of the environment and the health and safety of the community. As stated in Zoning Administrator Staff Report, the City continues to move forward with potential parking requirement amendments that include an analysis of parking rates for food service and outdoor dining uses. If ultimately approved, Chihuahua Brewing Company ownership will have a clear understanding of the parking requirements when considering the economic feasibility of a permanent outdoor dining area design at this location or expansion of the existing permanent outdoor dining area.
