HomeMy WebLinkAbout7.0_Code Update Related to Fractional Homeownership_PA2022-0202CITY OF NEWPORT BEACH PLANNING COMMISSION STAFF REPORT January 5, 2023 Agenda Item No. 7 SUBJECT: Code Update Related to Fractional Homeownership (PA2022-0202) ▪Zoning Code Amendment ▪Local Coastal Program Amendment SITE LOCATION: Citywide APPLICANT: City of Newport Beach PLANNER: Jaime Murillo, AICP, Principal Planner (949) 644-3209, jmurillo@newportbeachca.gov PROJECT SUMMARY Staff will provide the Planning Commission with an update regarding the Fractional Homeownership Ad-Hoc Committee’s efforts reviewing and considering potential code updates pertaining to the regulation of fractional homeownership. RECOMMENDATION 1)Receive a presentation on the status of Fractional Homeownership Ad-Hoc Committee efforts; and 2)Report to the City Council on the progress being made on Fractional Homeownership. DISCUSSION Background On September 27, 2022, the City Council initiated Zoning Code and Local Coastal Program amendments and they directed staff to work expeditiously with the Planning Commission. On October 6, 2022, the Planning Commission conducted a study session. Due to the complexity of the issue, the Commission expressed the desire to form an hoc committee and work closely with staff to formulate appropriate regulations. On October 20, 2022, Planning Commission formed the Ad-Hoc Committee consisting of Commissioners Lee Lowery, Mark Rosene, and former Commissioner Erik Weigand. The anticipation was to have the ad hoc committee meet as necessary to assist staff with the creation of regulations that would then be presented to the Planning Commission at a future public hearing for consideration and recommendation to the City Council. 1 INTENTIONALLY BLANK PAGE2 Fractional Homeownership Update (PA2022-0202) Planning Commission, January 5, 2023 Page 2 On October 25, 2022, the City Council, at the request of Councilmember Diane Dixon, unanimously concurred to direct the Planning Commission to make a recommendation regarding the regulation of fractional homeownership at the January 5, 2023, Planning Commission meeting. The recommendation would then be presented by staff to the City Council for their review and consideration at a subsequent meeting date. Ad-Hoc Committee Efforts and Status of Recommendation The Ad-Hoc Committee has met a total of five times, including meeting with representatives from Pacaso and well as concerned residents. The Ad-Hoc Committee has also consulted with staff from Community Development Department and City Attorney’s Office. Currently, there is no clear consensus on how to best regulate fractional homeownership. To complicate matters further, former Commissioner Erik Weigand has been elected to the City Council and can no longer serve on the Ad-Hoc Committee. Former Chair Lauren Kleiman has also been elected to the City Council, leaving two vacancies on the Planning Commission. The Ad-Hoc Committee is not prepared to provide recommendations for the Planning Commission’s consideration on January 5, 2022. The Ad-Hoc Committee will continue to work through the issue and return to the Planning Commission at a future date.
