Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Tom Sandefur, Assistant City Engineer tandefur@newportbeachca.gov PHONE: 949-644-3321 TITLE: Gateway Park Improvements — Award of Contract No. 8791-1 (23L01) ABSTRACT: The City of Newport Beach (City) has received construction bids for the Gateway Park Improvements Project. The project will refresh the two landscape areas that make up Gateway Park at the entrance to the Balboa Peninsula. This work will include replacing turf and landscaping, reconstructing landscape walls, and installing new lighting and new signage. Staff requests City Council approval to award the construction contract to Armstrong Cal Builders, Inc. of Signal Hill, California. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 2 Section 15302(c) (replacement of existing public facilities involving negligible or no expansion of capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment; b) Approve the project plans and specifications; c) Find the bid from Jon Gilmer Construction non -responsive due to lack of specified licensure; c) Award Contract No. 8791-1 to Armstrong Cal Builders, Inc. for the bid price of $540,233.50 for the Gateway Park Landscape Improvement project, and authorize the Mayor and City Clerk to execute the contract; and d) Establish a contingency of $54,000 (approximately 10 percent of total bid) to cover the cost of unforeseen work not included in the original contract. 7-1 Gateway Park Improvement Project — Award of Contract No. 891-1 (231_01) January 10, 2023 Page 2 DISCUSSION: Gateway Park comprises of two areas of landscaping on either side of Newport Boulevard at Via Lido. The park requires significant renovation to repair/replace damaged planter walls and the electrical system, freshen up the landscaping, and update the signage. Based on this scope, staff produced plans, specifications and an estimate for the project. At 10 a.m. on November 17, 2022, the City Clerk opened and read the following bids for this project: BIDDER TOTAL BID AMOUNT Low Jon Gilmer Construction $ 501,383.00 2nd Armstrong Cal Builders, Inc. $ 540,233.50 3rd MMG Engineering, Inc. $ 600,000.00 4th Bitech Construction Co, Inc. $ 623,675.00 5th Klassic Engineering and Construction, Inc. $ 645,590.00 6th California Landscape and Design $ 656,875.00 7th MBC Enterprises, Inc. $ 735,816.20 8th KASA Construction, Inc. $ 799,547.50 9th C.S. Legacy Construction, Inc. $ 802,984.00 The apparent low bidder for this project, Jon Gilmer Construction, submitted a bid that was determined to be "non -responsive" due to the lack of a "C-27" license. The specifications for the project require that the prime contractor or a designated sub -contractor be licensed "C-27" for the landscape work. Jon Gilmer Construction acknowledged it did not have the correct licensure and was not able to obtain the correct license prior to award of the contract. The second low bidder for this project, Armstrong Cal Builders, Inc. submitted a bid eight percent above the Engineer's Estimate of $497,700. Armstrong Cal Builders, Inc. submitted all the necessary forms and possesses a Classification "A" and listed a subcontractor with a "C-27" California State Contractors License as required by the project specifications. A check of the contractor's references indicates satisfactory history of similar projects for other public agencies. The proposed project includes a complete refresh of the landscape at the two park areas. Old and overgrown vegetation will be removed and replaced. New palm trees will be installed along with new groundcover and accent plants. The existing donated trees and palms will be preserved during the reconstruction. In addition, new lighting and replacement signage will be installed along with cleaning and painting of all the walls. A walkway that was previously closed on the north side of the park will be reopened to allow access to Lido Marina Village from Newport Boulevard. Pursuant to the contract specifications, the contractor will have 70 consecutive working days to complete the work. Work is scheduled to begin winter 2023. The project plans and specifications will be available for review at the January 10, 2023 City Council meeting or upon request. 7-2 Gateway Park Improvement Project — Award of Contract No. 891-1 (231-01) January 10, 2023 Page 3 FISCAL IMPACT: Sufficient funding is available from the Fiscal Year 2022-23 Capital Improvement Program budget for completion of this contract. The project funds are expensed from the Landscape Enhancement Program within the Neighborhood Enhancement Fund, which includes funds for the installation or rehabilitation of various citywide landscape projects. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 2 Section 15302 (c) (reconstruction of existing public facilities involving negligible or no expansion of capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
