TITLE: 2022-2023 Citywide Facilities Painting Project — Award of Contract
No. 8940-1 (23F02)
ABSTRACT:
The City of Newport Beach (City) has received construction bids for the 2022-2023
Citywide Facilities Painting Project as part of the Facilities Maintenance Master Plan
(FMMP) for 2022-2023. Staff requests City Council approval to award the construction
contract to Tony Painting of Garden Grove, California. This project involves painting
various City facilities throughout the community.
RECOMMENDATIONS:
a) Find this Project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301 Class 1 (maintenance of existing facilities involving no
expansion or an existing use) of the CEQA Guidelines, California Code of Regulations,
Title 14, Chapter 3, because this project has no potential to have a significant effect
on the environment;
b) Approve the project plans and specifications;
c) Award Contract No. 8940-1 to Tony Painting for the bid price of $377,175 for the
2022-2023 Citywide Facilities Painting Project, and authorize the Mayor and City Clerk
to execute the contract; and
d) Establish a contingency of $56,325 (approximately 15 percent of total bid) to cover the
cost of unforeseen work not included in the original contract.
DISCUSSION:
As part of the FMMP, City buildings are periodically inspected for maintenance and repair
issues. The FMMP evaluation includes electrical panels, ventilation, plumbing, electrical,
interior/exterior finishes, weather protection, and site work. Staff prioritizes the various
capital maintenance needs with an emphasis on items that keep facilities in service.

This project in particular addresses protective coatings on various Fire, Recreational and
Civic Center facilities to protect the various building materials from rust and other modes
of deterioration. This proactive approach will protect the metal, wood and other building
materials from further damage that could result in more costly repair work in the future.
The new paint will provide an additional benefit of a more aesthetically pleasing
appearance of these facilities.
The specific facility exterior painting projects will be: Civic Center parking structure fire
suppression piping painting; Civic Center exterior steel painting; Mariners Library exterior
painting; Fire Station 4 exterior painting; Oasis Senior Center exterior wood re -staining;
Marina Park restroom exterior painting; Newport Theatre Arts Center exterior painting;
and Sunset Ridge Park restroom painting.
At 2 p.m. on January 26, 2023, the City Clerk opened and read the following bids for this
project:

The bid amount submitted by Tony Painting is approximately 31.5 percent below the
Engineer's Estimate of $550,000. Tony Painting submitted all the necessary forms and
possesses a Classification "B" or "C-33" California State Contractors License as required
by the project specifications. A check of the contractor's references indicates satisfactory
completion of similar projects for other public agencies including with the City of Newport
Beach on previous painting projects.
Pursuant to the contract specifications, the contractor will have 120 consecutive working
days to complete the work. Liquidated damages of $500 per calendar day will be
assessed if all work is not substantially completed in that time. Work is scheduled to
begin spring 2023.
The project plans and specifications will be available for review at the February 14, 2023,
City Council meeting or upon request.

FISCAL IMPACT:
Sufficient funding is available from the Fiscal Year 2022-23 Capital Improvement Program
(CIP) budget for completion of this contract. The funds are expensed from the FMMP
(General Funds).

Staff recommends establishing $56,325 (approximately 15 percent) for contingency
purposes to cover the cost of unforeseen conditions associated with construction.
