Home My WebLink AboutSS3 - HOA Security Camera Discussion - PowerPointProposed Pilot Program: HOA Installation of Security Cameras Within the Public Right -of -Way April 25, 2023 Item No. SS3 �z c`1-`�j CITY OF NEWPORT BEACH APRIL 25, 2023 STUDY SESSION Background Council Policy A-1 Request: At the March 14, 2023 City Council meeting, Mayor Pro Tern O'Neill introduced an "A-1 Item" to: "Consider directing staff to develop a pilot program that allows Newport Beach Community Homeowners Associations, that represent at least 50 homeowners, to install solar powered security cameras, signs and other related improvements in the public right-of-way" City Council Policy L-6 Council Policy L-6 - "Encroachments in Public Rights -of -Way" provides direction and guidance for use of the City's public rights -of -way. General Rule: The general rule is that the public right-of-way is reserved for public uses and should not be diminished by the installation of private improvements. Private Cameras: No direct policy regarding private cameras. Exception: Can obtain a waiver for structures such as fences, parkway resurfacing, raised planters etc. by complying with procedures in policy and getting any required encroachment permit/agreement. Considerations for Pilot Program Who approves? Permitted through City Council (on case -by case basis) or modify Council Policy L-6? Do we charge a permit fee? Need City Review: traffic safety, line of sight issues Considerations for Pilot Program Do we require a license agreement? Term/length of pilot program Compensation for use of right of way (CPI adjustments) Responsible for damage to City property Utility costs (if City power used) Insurance/Indemnity Bonding Requirement to remove improvements at end of term Relocation/removal at discretion of City for road improvements, etc. Considerations for Pilot Program Community Aesthetics —Visual Impact Standard approved design/location in public right-of-way? Allow to be mounted on light poles / street signs? Only allow wireless/solar powered cameras? Require signs? Privacy Concerns Limit what cameras can view (not directed at private residences)? What can cameras record (vehicle License plates, types of vehicles, people, facial recognition)? Limit type of camera (rotating or telescoping cameras)? Limit use of recorded images? Considerations for Pilot Program Security of Data Require HOA to ensure data is secure Limit access — HOA can provide to City if there is an incident Limit how long HOA can store data (30 days)? Ad Hoc Residential Crime and Burglary Advisory Committee Established by City Council in October 2022 to provide input and make recommendations on: Educating Public on steps to prevent and deter crime. Changes to programs, policies, procedures to prevent and deter crime. Availability and allocation of funding for programs, policies and procedures. Committee is reviewing use of cameras, City owned and privately owned, to prevent and deter residential crime and burglaries. Recommendations to City Council are anticipated in July.
