HomeMy WebLinkAboutPA2023-0086_20230627_ZA Action_Public Notice NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that on or after Tuesday, June 27, 2023, the Zoning Administrator of the City of Newport Beach will consider the following application: Russell Accessory Dwelling Unit – A coastal development permit (CDP) to allow the construction of a new, attached, 800 square-foot accessory dwelling unit (ADU) to an existing single-unit dwelling. The existing 3,821 square foot single-unit residence includes two (2)-stories and an uncovered third floor roof deck. There is an existing covered patio located on the second story of the dwelling that will be enclosed and a portion of the existing second story will be reconfigured to create the ADU. The property is located within one half mile of a transit stop and no additional parking is required or proposed for the ADU. After the enclosure of the patio (an addition of 416 square feet), the structure will total 4,237 square feet, which exceeds the maximum floor area limit for the subject property of 3,875 square feet. However, State Law prohibits the application of floor area limits if it reduces the size of the ADU to less than 800 square feet. The project otherwise complies with all other development standards, including height and setbacks, and no deviations are requested. The project is categorically exempt under Section 15301 under Class 1 (Existing Facilities), of the State CEQA (California Environmental Quality Act) Guidelines. In accordance with Newport Beach Municipal Code (NBMC) Section 21.48.200 (D)(2) (Accessory Dwelling Units), no local public hearing will be held, however, written comments on the proposed development may be submitted. Written comments received will be reviewed by the Zoning Administrator. If you challenge this project in court, you may be limited to raising only those issues you raised in written correspondence delivered to the City, at, or prior to, the Zoning Administrator action. Administrative procedures for appeals are provided in the Newport Beach Municipal Code Chapter 21.64 (Appeals and Calls for Review). A fee is not required to appeal any final action on a coastal development permit to the Planning Commission. The project site is located within the appeal area of the coastal zone; therefore, final action by the City may be appealed to the California Coastal Commission. Project materials may be reviewed at the Community Development Department Permit Center (Bay C- 1st Floor), at 100 Civic Center Drive, Newport Beach, CA 92660. All mail or written communications (including email) from the public, residents, or applicants regarding the item are encouraged to be submitted by 12:00 p.m. on the business day immediately prior to the action date. This allows time for the Zoning Administrator to adequately consider the submitted correspondence.
