Brown, City Clerk TITLE: Appointments to the Water Quality/Coastal Tidelands Committee ABSTRACT: A total of three seats on the Water Quality/Coastal Tidelands Committee (Committee) will be available for appointment by the City Council after June 30, 2023. Two of the seats are scheduled vacancies with members reaching their maximum term limits. The third seat is an unscheduled vacancy due to a resignation. City Council Policy A-2 (Boards, Commissions and Committees) states that it is the intent of the City Council that at least two separate individuals be considered for each vacancy; however, there was an insufficient number of applicants to nominate to create a pool of at least two individuals per vacancy unless the City Council considered the two existing members of the Committee who reached their maximum term limit. Both of the members are available and willing to continue to serve on the Committee. Additionally, the Ad Hoc Appointments Committee recommended that the City Council allow the nominations of both members for an additional term. At the June 13, 2023 City Council meeting, the City Council made possible the reappointment of these two members by the adoption of Resolution No. 2023-36, which waived term limits. All vacancies were noticed according to the Maddy Act and City Council Policy A-2. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Appoint Lawrence (Tom) Houston, Craig Hudson, Steve Patterson, Spencer Pirdy, George Robertson, or John Wadsworth to fill the three upcoming vacancies on the Water Quality/Coastal Tidelands Committee for terms ending June 30, 2027. DISCUSSION: The purpose of the Water Quality/Coastal Tidelands Committee is to advise and make recommendations to the City Council on policies, projects and programs that support and strengthen existing regulations to protect water quality and habitat in the bay and ocean. The Committee is comprised of seven members appointed by the City Council and two non -voting Council Members appointed by the Mayor, subject to confirmation by the City Council. 19-1 Appointments to the Water Quality/Coastal Tidelands Committee June 27, 2023 Page 2 The seven members appointed by the City Council serve a four-year term with a limit of two consecutive terms. The two non -voting Council Members serve a one-year term. The Committee is subject to the open meeting laws of the Ralph M. Brown Act. The three seats on the Committee that are scheduled for vacancy on June 30, 2023, are comprised of two scheduled vacancies due to members reaching their maximum term limits, and one unscheduled vacancy due to a member resigning from the Committee prior to the end of their term, June 30, 2023. The two Committee members who have reached their maximum term limits are Lawrence (Tom) Houston and George Robertson. Both members were originally appointed to the current iteration of the Committee on January 22, 2013, and previously reached their term limits on January 22, 2021. However, due to an insufficient number of applicants in 2021, on February 23, 2021, the City Council adopted Resolution No. 2021-11, which waived term limits and extended the terms of all of the existing Committee members. Additionally, Resolution No. 2021-11 staggered the terms of the Committee members such that three members were reappointed for two years and six months, and four members were reappointed for four years and six months. When Resolution 2021-11 was considered by the City Council on February 23, 2021, Council Member Diane Dixon orally revised the resolution to clarify that the end of the terms would expire on June 30 in order to match the end of terms of other committee appointments ending on June 30. Accordingly, Lawrence (Tom) Houston and George Robertson were each reappointed for the shorter, staggered term of only two years and six months, which will expire June 30, 2023. Resolution No. 2023-36, which was adopted on June 13, 2023 (Attachment A), further waives term limits for the citizen members who have reached their maximum term limits to allow them to be considered for appointment. This waiver allows the City Council to consider reappointment of Lawrence (Tom) Houston and George Robertson. The unscheduled vacancy on the Committee was due to the resignation of Louis Denger who resigned in March 2023. Mr. Denger's term was also scheduled to expire on June 30, 2023, because he was the third member that was reappointed under the shorter, staggered term of only two years and six months. Pursuant to City Council Policy A-2, the City Council may appoint an individual to fill the unscheduled vacancy through the remainder of the existing term, June 30, 2023, and additionally, the following four-year term commencing June 30, 2023, and expiring June 30, 2027, because the vacancy occurred within six months of the end of the existing term. On Friday, March 31, 2023, the City Clerk posted the Notice of Vacancies in the City Clerk's Office and on the City Hall bulletin board, placed the Notice of Vacancies on the City's website, and on Saturday, April 8, 2023, the City Clerk published the Notice of Vacancies in the Daily Pilot. The deadline to submit applications was Wednesday, May 10, 2023. At the conclusion of the application period, the City Clerk's Office received seven applications. Pursuant to City Council Policy A-2 (Boards, Commissions and Committees), Mayor Noah Blom established a Council Ad Hoc Appointments Committee comprised of himself, Mayor Pro Tern Will O'Neill, and Council Member Lauren Kleiman which was charged with reviewing the applications and making recommendations to the full City Council. At 19-2 Appointments to the Water Quality/Coastal Tidelands Committee June 27, 2023 Page 3 the conclusion of the application period, the Council Ad Hoc Appointments Committee reviewed the applications, provided their nomination recommendations, and the City Council confirmed the nominations at the June 13, 2023 City Council meeting, as listed in the recommendations above. Copies of the applications are attached hereto as Attachment B. Appointment Process The appointment to the Water Quality/Coastal Tidelands Committee will take place in the following manner: A. The City Council will vote on the appointment using a paper ballot and each member of the City Council will cast three votes on the paper ballot. B. The City Clerk will tabulate and announce the results, including the vote tally. To be appointed, the applicant must receive at least four votes. FISCAL IMPACT: There is no fiscal impact related to this item. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. IA 9CT91:IJil=1L111i.'l Attachment A — Resolution No. 2023-36 Attachment B — Water Quality/Coastal Tidelands Committee Applications 19-3 ATTACHMENT A RESOLUTION NO. 2023-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, WAIVING THE TERM LIMITS ESTABLISHED BY RESOLUTION NOS. 2012-115, 2021-11, AND CITY COUNCIL POLICY A-2, BOARDS, COMMISSIONS AND COMMITTEES WHEREAS, pursuant to the 1978 Beacon Bay Bill, as amended, the City of Newport Beach ("City") acts on behalf of the State of California as the trustee of tidelands located within the City's limits, including Newport Harbor; WHEREAS, the City has a long history of protecting the water quality of Newport Harbor and the ocean through the work of the Water Quality/Coastal Tidelands Committee ("Committee"), which was established by City Council Resolution No. 2012- 115, adopted on November 27, 2012; WHEREAS, City Council Policy A-2, Boards, Commissions and Committees, provides guidelines, rules, and regulations applicable to committees, including a limit on the terms of service; WHEREAS, on February 23, 2021, the City Council adopted Resolution No. 2021- 11, which staggered the service terms for the seven citizen members of the Committee, and, due to an insufficient number of applicants to fill available seats, waived term limits to allow the continued appointment of members who had reached their maximum term limits; and WHEREAS, due to an insufficient number of applicants to fill available seats, the City Council desires to further waive the term limits of the citizen members who have reached their maximum term limits to allow them to be considered for appointment. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council hereby waives the Committee term limits established by Resolution Nos. 2012-115, 2021-11, and City Council Policy A-2, Boards, Commissions and Committees, with respect to those persons who have reached their maximum term limits as of June 30, 2023. This waiver is solely to allow persons who would otherwise be precluded from serving an additional consecutive term to be eligible for appointment and does not permit those persons to serve another consecutive term thereafter. 19-4 Resolution No. 2023-36 Page 2 of 2 Section 2: The City Council hereby repeals all previous resolutions, or portions thereof, related to the Committee to the extent they are in conflict with this resolution. Section 3: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 4: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 5: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
