As directed by Resolution No. 2022-59, the General Plan Update Steering Committee (GPUSC) reviewed applications for appointment to fill the unscheduled vacancy on the GPAC, and recommends the appointment of an applicant to fill the vacant seat. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Confirm the General Plan Update Steering Committee's recommended appointment of Ritch LeGrand to fill the unscheduled vacancy on the General Plan Advisory Committee. DISCUSSION: On April 25, 2023, the City Council confirmed the GPUSC's recommended appointment of Charles Fancher to fill an unscheduled vacancy on the GPAC. On May 1, 2023, Charles Fancher declined his appointment to the GPAC. Accordingly, there is now one unscheduled vacancy on this committee. The term of the appointment is indefinite, pending the City Council's adoption of the General Plan Update. Pursuant to City Council Policy A-2, Boards, Commissions and Committees, the City Council's new appointee to the GPAC will serve the balance of the unexpired term. The City Clerk prepared and posted a Notice of Vacancy on Wednesday, May 3, 2023, in the City Clerk's Office, on the bulletin board in the City Council Chambers, and on the City's website, and published it in the Daily Pilot on Saturday, May 6, 2023. As provided in the notice, applications were accepted by the City Clerk's Office until noon on Wednesday, May 10, 2023. At the conclusion of the application period, the applications were forwarded to the GPUSC for review. Confirmation of Appointments to the General Plan Advisory Committee July 11, 2023 Page 2 Appointment Process As authorized by Resolution No. 2022-59, the GPUSC is assigned to review the applications. GPUSC held a duly noticed public meeting on Monday, June 26, 2023, and reviewed the applications. The GPUSC was not required to comply with procedural or timing requirements set forth in City Council Policy A-2. After consideration of the applications and deliberation at the meeting, the GPUSC recommends that Ritch LeGrand be appointed to the GPAC. Copies of the application are attached hereto as Attachment A. FISCAL IMPACT: There is no fiscal impact related to this item. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. (continued) Legal matters: *I have given depositions and provided expert witness testimony in over 100 real estate -related cases in various Federal courts, state District courts, condemnation commissions, and assessment review boards. Urban design or architecture: * I served as Chairman of the Employment and Economic Growth Work Group on the Sioux City, IA Vision 2020 Task Force. This was an 18 month project to develop community goals and objectives, including an updated strategic plan for urban design. Task force activities included primary research with a six mernber national consulting team, a town meeting speak -out, design imagin.eering, media presentations, likelihood surveys, opportunity forums, and community reviews. *I served on the Executive Committee of the Sioux City Design Works. This was a project to create urban design guidelines to guide future development and redevelopment for the designers and builders who use them. The Design Guidelines identified the existing patterns that shape the unique character of Sioux City and then provided the principles by which future buildings would relate to the existing streets, neighborhoods, and public open spaces.
