I. CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Benjamin M. Zdeba, AICP, Zoning Administrator Oscar Orozco, Assistant Planner Jenny Tran, Assistant Planner Liane Schuller, Planning Consultant Alejandro De Loera, Consultant Planner II. REQUEST FOR CONTINUANCES Zoning Administrator Zdeba reported that Item Number 5 is removed from the calendar. He stated that any future hearing on that project would require a new public notice and that there would be no comments taken at this time. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF JUNE 15, 2023 Action: Approved as amended IV. PUBLIC HEARING ITEMS ITEM NO. 2 Bire II LLC Residential Condominiums Tentative Parcel Map and Coastal Development Permit (PA2023-0092) Site Location: 513 Acacia Avenue Council District 6 Due to a lack of public interest in this matter, Zoning Administrator Zdeba decided to forgo a presentation from staff. Liane Schuller, Planning Consultant, confirmed that the applicant had agreed with the proposed conditions of approval, and the draft resolution would be revised to reflect comments from Mr. Mosher. Project representative Rod Jeheber stated that he had reviewed the draft resolution and agrees with all the required conditions. Zoning Administrator Zdeba opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved as amended ITEM NO. 3 Bire II LLC Residential Condominiums Tentative Parcel Map and Coastal Development Permit (PA2023-0091) Site Location: 509 and 509 ½ Carnation Avenue Council District 6 Due to a lack of public interest in this matter, Zoning Administrator Zdeba decided to forgo a presentation from staff. Action: Approved as amended ITEM NO. 4 2322 Pacific, LLC Residential Condominiums Tentative Parcel Map and Coastal Development Permit (PA2023-0033) Site Location: 2320 and 2322 Pacific Drive Council District 6 Due to a lack of public interest on this matter, Zoning Administrator Zdeba decided to forgo a presentation from staff. Oscar Orozco, Assistant Planner, agreed with comments submitted by Mr. Mosher and stated that the lot number in the draft resolution will be revised from "Lot 2” to “Lot 3.” Mr. Orozco added that the applicant has not provided him confirmation on an agreement to the conditions of approval and asked that the applicant be provided the opportunity to comment on the topic of conditions of approval. Project owner Reza Moalej stated that he had reviewed the draft resolution and agrees with all the required conditions. Zoning Administrator Zdeba opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved as amended ITEM NO. 5 Barnard Residence Coastal Development Permit (PA2023-0018) Site Location: 3907 Seashore Drive, Units A & B Council District 1 Action: Removed from Calendar ITEM NO. 6 Mercado Taco Shop Minor Use Permit (PA2022-0243) Site Location: 320 Marine Avenue, Unit B Council District 5 Jenny Tran, Assistant Planner, provided a brief project description stating that the project is for an amendment to a minor use permit for an existing restaurant to allow a Type 47 (On-Sale General – Eating Place) Alcohol Beverage Control (ABC) License and increase the hours of operations. Ms. Tran indicated that the restaurant is currently under construction and the project does not propose any changes to the approved renovations or any additional tenant improvements. She also indicated that, due to the location of the project site to the residential neighborhood across the alley, additional conditions of approval were proposed to minimize the impacts to the neighborhood. Applicant Jose Cerrudo of Mercado Taco Shop stated that he had reviewed the draft resolution and agrees with all the required conditions, including the added conditions of approval. Zoning Administrator Zdeba opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved as amended ITEM NO. 7 Regenerative Institute of Newport Beach Minor Use Permit (PA2023-0062) Site Location: 20341 Birch Street, Unit 200 Council District 3 MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 06/29/2023 Page 3 of 3 Alejandro De Loera, Consultant Planner, provided a brief project description stating that the project is a request to convert an existing professional office use into a medical office use within an existing building located at 20341 Birch Street. Mr. De Loera discussed the General Plan and zoning designations, and specifically mentioned that the project is zoned within the Business Park land use area within the Santa Ana Heights Specific Plan District. He stated that a professional office may be converted to a medical use with the approval of a minor use permit in this zone. The site shares a 172-space surface parking lot with two other office buildings. The 172 provided parking spaces is sufficient to meet the Off-Street Parking Requirements of the Zoning Code, which requires only 171 spaces. The proposed medical office use will be operated separately from a previously approved medical office use (Minor Use Permit No. UP2020-188) within the same multi-tenant building. The existing medical office use specializes in advanced pain-relieving treatments, while the proposed medical office use will specialize in medical injections such as neurotoxins. Applicant Phillip Budovec of Knitter Partners International, on behalf of the Regenerative Institute of Newport Beach, stated that he had reviewed the draft resolution and agrees with all the required conditions. Zoning Administrator Zdeba opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved V. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. VI. ADJOURNMENT The hearing was adjourned at 10:22 a.m. The agenda for the Zoning Administrator Hearing was posted on June 21, 2023, at 4:45 p.m. on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City’s website on June 21, 2023, at 4:52 p.m. Benjamin M.
