CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Benjamin M. Zdeba, AICP, Zoning Administrator Melinda Whelan, Assistant Planner Alejandro De Loera, Consultant Planner II. REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF JUNE 29, 2023 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 2 Linos Residential Condominiums Tentative Parcel Map and Coastal Development Permit (PA2023-0074) Site Location: 430 and 430 ½ Fernleaf Avenue Council District 6 Alejandro De Loera, Consultant Planner, provided a brief project description stating that the project is a request for a tentative parcel map and coastal development permit for a two (2)-unit residential condominium. A single- unit residence was previously demolished, and a new duplex is under construction. The Tentative Parcel Map will allow each unit to be sold individually. A coastal development permit (CDP) is required because this property is in the coastal zone. The property is in the R-2 (Two-Unit Residential) Zoning District. The R-2 District is intended to provide areas appropriate for residential development of up to two units (i.e., a duplex) on a single legal lot. The new duplex under construction conforms to all applicable development standards and has been issued permits by the required departments. The project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15315 under Class 15 (Minor Land Divisions) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment. Property owner, Michael Linos, stated that he had reviewed the draft resolution and agrees with all the required conditions. Zoning Administrator Zdeba opened the public hearing. One member of the public, Mr. Mosher, spoke and stated his concern regarding the manner in which separate applications (i.e., for a coastal development permit and for a tentative parcel map) were being presented as a single application with only one application and file number. This comment was applicable to, but not specific to Item No. 2, however it was given during the public hearing for the item. Zoning Administrator Zdeba closed the public hearing. MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 07/13/2023 Page 2 of 2 Zoning Administrator Zdeba addressed Mr. Mosher’s comments and stated that although multiple application types are reviewed under a single file number, each application is considered individually and that the single number was simply a matter of file management. Action: Approved ITEM NO. 3 20 Balboa Coves LLC Residence Coastal Development Permit (PA2023-0077) Site Location: 20 Balboa Coves Council District 1 Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a coastal development permit (CDP) to allow the demolition of an existing single-family residence and to construct a 4,232-square-foot, three (3)-story, single-unit residence including an attached 477-square-foot, two (2)-car garage. The project includes landscape, hardscape, and subsurface drainage facilities all within the confines of private property. The project also includes a reinforced bulkhead with a cap for coastal hazards protection. The project complies with all applicable development standards and no deviations are requested. She noted a change to Fact in Support Finding No. B (2) to state the private community was developed and established in the 1950s. Applicant Craig Hampton, Architect on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with all the required conditions. He had one question on a typographical error in the conditions that staff addressed and fixed. Zoning Administrator Zdeba opened the public hearing. One member of the public, Jim Mosher, spoke and asked for clarification on the parking requirements for the new development. Mr. Mosher also asked that the planning activity or “PA” number be added to the approval section of the resolution. Zoning Administrator Zdeba closed the public hearing. The Zoning Administrator explained the parking requirement and directed staff to add the PA number for the project in the decision section of the resolution. Action: Approved as amended V. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. VI. ADJOURNMENT The hearing was adjourned at 10:18 a.m. The agenda for the Zoning Administrator Hearing was posted on July 6, 2023, at 8:30 a.m. on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City’s website on July 6, 2023, at 8:16 a.m.
