NOTICE OF PUBLIC HEARING
NOTICEISHEREBYGIVENthatonSeptember12,2023,at4:00p.m.,orsoonthereafterasthemattershallbeheard,apublichearingwillbeconductedintheCityCouncilChambersat100CivicCenterDrive,NewportBeach.TheCityCounciloftheCityofNewportBeachwillconsiderthefollowingapplication:Housing Element Implementation,Noise-RelatedNoise Amendments-Noticeof Intentto Override theAirportLandUseCommissionDeterminationofInconsistency-Pursuantto Public Utilities Code Section21676(b),theCityCouncilwillconsidertheadoptionofaresolutionnotifyingtheOrangeCountyAirportLandUseCommissionandtheCaliforniaDepartmentofTransportationDivisionofAeronauticsoftheirintentiontooverridetheAirportLandUseCommission’sdeterminationthattheAmendmentstoNewportBeachGeneralPlanLandUseandNoiseElements,Title20(Planning andZoning)oftheNewportBeachMunicipal Code(NBMC),NewportPlace PlannedCommunityDevelop-mentStandards(PC-11),andtheNewportAirportVillagePlannedCommunityDevelopmentPlan(PC-60)areinconsis-tentwiththe2008JohnWayneAirportEnvironsLandUsePlan(theAmendments).TheAmendmentsseekthefollowing:
•Adoptingupdatednoisecontours(NoiseElementFiguresN4and N5)toreflectthe noisecontours identified bythe2014JohnWayneAirportSettlementAgreementAmendmentEnvironmentalImpactReportNo.617(EIRNo.617);•UpdatingLand Use andNoiseElementPolicies,LandUseElement Figures LU11,LU22,andLU23,Title20,PC-11,andPC-60tomodifyandincorporate theupdatednoisecontours identified by EIRNo.617andto implementadditionalnoiseattenuationmeasuresforfuturehousingunitsproximatetoJohnWayneAirport;and•Allowingresidential unitsidentifiedbythecertified 2021-2029SixthCycleNewport Beach General PlanHousingElementtobelocatedwithinthe65dBACNELnoisecontourareaasidentifiedintheupdatednoisecontourmapsidentifiedbyEIRNo.617.Parcelsbisectedby the updated65 dBA CNELnoise contour couldsupport futurehousing;whereasparcels locatedwhollywithintheupdated65 dBACNELnoisecontourcouldsupporthousing,ifdeemednecessarytosatisfytheRegionalHousingNeedsAssessment(RHNA)mandate.
NOTICE IS HEREBYFURTHER GIVEN that the City Council finds that isoverriding actionis exempt and not subjecttofurtherenvironmentalreviewundertheCaliforniaEnvironmentalQualityAct(“CEQA”)pursuant to CEQA GuidelinesSection15183becausetheAmendmentswouldnotallowdevelopmentofgreaterintensitythanisallowedunderthe2006GeneralPlan,includingthe NewportAirportVillage Planned Community,asamended.The updatednoise contours,andimpactsassociatedtherewith,werealsofullyanalyzedin the2014 JohnWayneAirportSettlementAgreementAmendmentEnvironmentalImpactReport(EIRNo.617).
NOTICE IS HEREBY FURTHER GIVEN that on August 3,2023,by a vote of 4 ayes and 3 recused,the Planning
CommissionoftheCityofNewportBeachrecommendedthat theCityCouncilapprovetheAmendments.
Allinterestedpartiesmayappearandpresenttestimonyinregardtothisapplication.Ifyouchallengethisprojectincourt,you
maybelimitedtoraisingonlythoseissuesyouraisedatthepublichearingorinwrittencorrespondencedeliveredtotheCity,at,or
priorto,thepublichearing.AdministrativeproceduresforappealsareprovidedintheNewportBeachMunicipalCodeChapter
20.64(Appeals).Therequestmaybecontinuedtoaspecificfuturemeetingdate,andifsuchanactionoccursadditionalpublic
noticeofthecontinuancewillnotbeprovided.Priortothepublichearingtheagenda,staffreport,anddocumentsmaybereviewed
attheCityClerk’sOffice,100CivicCenterDrive,NewportBeach,California,92660orattheCityofNewportBeachwebsiteat
www.newportbeachca.gov.IndividualsnotabletoattendthemeetingmaycontactthePlanningDivisionoraccesstheCity’s
websiteafterthemeetingto reviewtheactiononthisapplication.
