Budget Amendment Allocating Public, Educational and Governmental Access Support (PEG) Fees to Replace Light Fixtures Within the City Council Chambers ABSTRACT: The Public Works Department requests a budget amendment to utilize Public, Educational and Governmental Access Support (PEG) fees for the replacement of the hi - voltage halogen light fixtures in the City Council Chambers with high efficiency low - voltage Light Emitting Diodes (LED) lights compliant with new California Energy Commission Title 14 Energy Efficiency Standards. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Approve Budget Amendment No. 24-019 appropriating $90,000 in increased expenditures in Account No. 16820201-911005 from the PEG Fund unappropriated fund balance. DISCUSSION: The Public Works Department is responsible for the maintenance, repair and upkeep of City of Newport Beach (City) facilities, including the City Council Chambers. The overhead interior lights in the Council Chambers utilize approximately 150 hi -voltage halogen light fixtures mounted to a custom track system, divided into multiple zones and connected to a central controller interfaced with a building management system. The system was installed in 2013 when the building was first constructed. The hi -voltage lamps have a limited service life and routinely require replacement. However, new regulations, established by the California Energy Commission Title 14 Energy Efficiency Standards, require the phasing out of existing lighting components such as incandescent, fluorescent and halogen bulbs. 15-1 Budget Amendment Allocating Public, Educational and Governmental Access Support (PEG) Fees to Replace Light Fixtures Within the City Council Chambers September 12, 2023 Page 2 Since the current halogen bulbs and fixtures no longer meet state efficiency standards and have been discontinued for sale in California, staff will need to replace the existing overhead interior lights, as well as lighting in the audio/visual control room and the connecting hallways with new LED bulbs and fixtures as the current system is not compatible with LED technology. The replacement of the existing hardware, LED bulbs and fixtures will also require replacing the central controller/dimmer control units as they are also not compatible with these new LED fixture processors. Staff estimates the project will cost approximately $90,000 to complete. Once all needed supplies and materials are sourced and on -site, staff will conduct a site walk with contractors to develop a schedule with minimal impact on the City Council Chambers' operations. FISCAL IMPACT: Upon approval of the budget amendment, sufficient funding will be available for the lighting changeout project within the PEG Equipment account in the PEG Fund, 16820201-911005. There is approximately $3 million available in PEG Fund unappropriated fund balance. PEG fees are received from cable providers and are used for support of Public, Education, and Government access programming only. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
