Staff has received construction bids for the Balboa Pier Maintenance project, and requests City Council approval to award the construction contract to the low bidder, Jilk Heavy Construction, Inc., of Brea, California. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301_Class 1 (rehabilitation of deteriorated facilities) of the CEQA Guidelines, because this project results in no expansion of an existing use and has no potential to have a significant effect on the environment; b) Approve the project plans and specifications; c) Award Contract No. 9323-1 to Jilk Heavy Construction, Inc., for the total bid price of $182,780 for the Balboa Pier Maintenance project, and authorize the Mayor and City Clerk to execute the contract; and d) Establish a contingency of $27,220 (approximately 15 percent of total bid) to cover the cost of unforeseen work not included in the original contract. DISCUSSION: Balboa Pier was originally built in 1940. The pier receives periodic inspections and repairs in addition to fixing portions of the wooden structure that are damaged during large ocean swells. While the 21-year-old concrete decks are relatively maintenance free, the timber support structures below the decks are continuously impacted by the ocean waves, tides, and the harsh marine environment. 7-1 Balboa Pier Maintenance — Award of Contract No. 9323-1 (241-109) September 12, 2023 Page 2 During a large swell event in May of this year, the Balboa Pier received some damage. Staff identified one missing pile and three damaged cross braces. The work necessary for the completion of the contract consists of underwater and above water/under deck repairs at the Balboa Pier based on inspections by City staff. Staff developed bidding documents and advertised for the pier maintenance project. The project area is shown on the location map (Attachment A). At 10 a.m. on August 22, 2023, the City Clerk opened and read the bids for this project: BIDDER TOTAL BID AMOUNT Low Jilk Heavy Construction, Inc. $182,780 2nd Power Engineering Construction Co. $198,649 The apparent low bidder, Jilk Heavy Construction Inc., possesses a California State Contractor's License Classification "A" as required by the contract documents. A check of Jilk Heavy Construction's references indicates satisfactory completion of similar past projects for the City, including dredging, emergency work, and maintenance work at Newport and Balboa Piers. Jilk Heavy Construction, Inc. was also awarded the San Diego Creek Trash Interceptor project. Pursuant to the contract documents, the contractor will have 25 working days to complete the project. It is anticipated that work would begin this fall. Jilk Heavy Construction's base bid costs came in approximately 9 percent lower than the Engineer's Estimate of $200,000. FISCAL IMPACT: Upon approval, contract costs will be funded from the Tidelands Maintenance fund. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
