Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Andy Tran, Senior Civil Engineer, atran@newportbeachca.gov PHONE: 949-644-3315 TITLE: Concrete Replacement Program FY 2022-23 (Project No. 23R06) — Notice of Completion for Contract No. 8921-1 ABSTRACT: On February 14, 2023, the City Council awarded Contract No. 8921-1 for the Concrete Replacement Program project to Towo Enterprise, Inc. The work is now complete and staff requests City Council acceptance and close out of the contract. RECOMMENDATIONS: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of Civil Code; and c) Release Faithful Performance Bond one year after acceptance by the City Council. DISCUSSION: Overall Contract Cost/Time Summary Awarded Contract Final Total Contract Total Contract Percent Contract Amount Amount Change Amount Cost Change $1,096,200.00 $1,202,865.87 +$106,665.87 +9.7% Allowed Contract Time + Approved 72 Actual Time Used (Days) 72 Extensions (Days) _ This project included replacing deteriorated concrete sidewalks, driveway approaches, curbs and gutters, and access ramps and tree removals within the Irvine Terrace, Corona del Mar and Shorecliffs neighborhoods. This project also included the construction of sidewalks at Corona del Mar High School and Ensign Intermediate School through a reimbursement agreement with Newport -Mesa Unified School District (District). 3-1 Concrete Replacement Program FY 2022-23 (Project No. 23R06) — Notice of Completion for Contract No. 8921-1 September 12, 2023 Page 2 The contracted work has been completed to the satisfaction of the Public Works Department. A summary of the construction cost is as follows: Original Bid Amount: $ 1,096,200.00 Actual Cost of Bid Items Constructed: $ 1,067,226.50 Total Change Orders: $ 135,639.37 Final Contract Cost: $ 1,202,865.87 The final total contract amount was $1,202,865.87, which was approximately 9.7 percent higher than the original bid amount. This cost increase was primarily due to additional quantities of concrete driveway and cross gutters that were added to the project to repair damaged areas. There were also six additional large tree removals necessary that were identified by the City Arborist during the course of work. A summary of the project schedule milestones is as follows: Estimated Start of Construction per Annual Baseline Schedule February 27, 2023 Actual Start of Construction Per Notice to Proceed April 3, 2023 Extended Contract Completion Date Inclusive of Extra Work July 18, 2023 Actual Substantial Construction Completion Date July 18, 2023 Additional working days were added to the contract to complete change order work that were not part of the original contract. FISCAL IMPACT: The Concrete Replacement Program was included within the FY 2022-23 Capital Improvement Program (CIP) Budget. Funds for the construction contract were expended from the following accounts: Account Description General Fund Newport -Mesa Unified School District Neighborhood Enhancement Account Number 01201927-980000-23R06 13501-980000-23R06 53601-980000-23R06 Total: Amount $ 947,150.00 $ 100,257.50 $ 155,458.37 $ 1,202,865.87 In accordance with the Reimbursement Agreement for the new sidewalk expansion at Corona del Mar High School and Ensign Intermediate School, the District will reimburse the City the total amount of $104,267.80. This total reimbursement amount includes a four percent administration fee. The Neighborhood Enhancement Fund (536) is used for projects that enhance neighborhood aesthetics and functionality and is funded via surplus general funds. 3-2 Concrete Replacement Program FY 2022-23 (Project No. 23R06) — Notice of Completion for Contract No. 8921-1 September 12, 2023 Page 3 ENVIRONMENTAL REVIEW: On February 14, 2023, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (maintenance of existing public facilities involving negligible or no expansion of use) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
