Zdeba, AICP, Zoning Administrator The City of Newport Beach will conduct the Zoning Administrator meeting via Zoom. The agenda will be posted at least seventy-two (72) hours in advance of each regular meeting and the public will be allowed to comment on agenda items before the Zoning Administrator, as well as items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Zoning Administrator may limit public comments to a reasonable amount of time, generally three (3) minutes per person. Recommended Action 1.Approve and File October 26, 2023 Page 2 Zoning Administrator Meeting IV.PUBLIC HEARING(S) Annual Review of North Newport Center Development Agreement (PA2023-0189) Site Location: 1101 Newport Center Drive 2. Project Summary An annual review of Development Agreement No. DA2007-002 for North Newport Center, pursuant to Newport Beach Municipal Code (NBMC) Section 15.45.080 (Periodic Review) and California Government Code Section 65865.1. The Development Agreement executed in 2008 and amended in 2012, vested development rights for regional commercial, office, mixed-use, and residential uses in North Newport Center and required public benefit contributions to the City. The Zoning Administrator will review Irvine Company’s good faith compliance with the provisions of the Development Agreement between January 2022 and December 2022. North Newport Center includes the following sub-areas: Fashion Island; Block 100, Block 400, Block 500, Block 600, and Block 800 of Newport Center Drive; and San Joaquin Plaza. Recommended Action 1.Conduct a public hearing; 2.Find the review exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15321 (Class 21 - Enforcement Actions by Regulatory Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Find that the applicant has demonstrated good faith compliance with the terms of the Zoning Implementation and Public Benefit Agreement; and 4.Receive and file the North Newport Center Zoning Implementation and Public Benefit Agreement Annual Report Year 2022 (Attachment No. ZA 2). GuacAmigos Minor Use Permit (PA2023-0119) Site Location: 2607 West Coast Highway 3. Project Summary A Minor Use Permit to reduce the operating hours of an existing restaurant and allow for live entertainment consisting of a DJ and/or pre-programed amplified music within the interior of the restaurant. The restaurant provides for the sale and service of alcoholic beverages with an existing Type 47 (On-Sale General - Eating Place) Alcoholic Beverage Control (ABC) License. If approved, this Minor Use Permit would supersede conditions previously approved with Use Permits No. 3288 and 3627. Recommended Action October 26, 2023 Page 3 Zoning Administrator Meeting 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 under Class 1 (Existing Facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Minor Use Permit (Attachment No. ZA 1). Nibeel Residence Coastal Development Permit (PA2023-0111) Site Location: 206 and 206 ½ Grand Canal 4. Project Summary A coastal development permit (CDP) to allow the demolition of an existing duplex and construction of a new 2,614 square-foot three (3)-story single-unit dwelling, a 286 square-foot junior accessory dwelling unit (JADU), and an attached 441 square-foot two (2)-car garage. The project also includes landscaping, hardscaping, and site walls. The project complies with all applicable development standards and no deviations are requested. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures)of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving the Coastal Development Permit filed as PA2023-0111 (Attachment No. ZA 1). Irwin Residence Coastal Development Permit (PA2023-0123) Site Location: 7 Beacon Bay 5. Project Summary A coastal development permit to allow the demolition of an existing single-unit residence and the construction of a new, three-story, 3,978-square-foot, 29-foot-tall single-unit residence including a 617-square-foot, 3-car garage. The proposed development includes additional appurtenances such as walls, fences, patios, hardscape, drainage devices, and landscaping. Recommended Action 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of October 26, 2023 Page 4 Zoning Administrator Meeting Small Structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit filed as PA2023-0123 (Attachment No. ZA 1). V.PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers’ time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
