Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov Theresa Schweitzer, Public Works Finance/Administrative Manager, tchweitzer@newportbeachca.gov 949-644-3335 Resolution No. 2023-63: Certifying Funding Listed in the Federal Transportation Improvement Program (FTIP) The Federal Transportation Improvement Program (FTIP) is a listing of all transportation projects over a six -year period that have federal funding. The list is updated every two years. The 2025 FTIP covers federal Fiscal Years 2024-25 through 2029-30. Local agencies are required to adopt a resolution certifying that the agency has the resources to fund its projects listed in the FTIP. The City of Newport Beach currently has one project listed in the FTIP, which is the Newport Beach Bicycle and Pedestrian Bridge project. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2023-63, A Resolution of the City Council of the City of Newport Beach, California, Certifying that the City of Newport Beach has the Resources to Fund the Projects in the Federal Transportation Improvement Program for Federal Fiscal Years 2024125 to 2029130 and Affirming its Commitment to Implement All Projects in the Program. DISCUSSION: The FTIP is a listing of all capital transportation projects proposed over a six -year period that include federal funding. Projects include highway improvements, transit, rail and bus facilities, high occupancy vehicle lanes, signal synchronization, intersection improvements, freeway ramps, bike facilities, etc. The Orange County Transportation Authority (OCTA) FTIP database also includes projects that are deemed regionally significant, regardless of the funding source, and allows local agencies access to view and amend their projects. 5-1 Resolution No. 2023-63: Certifying Funding Listed in the Federal Transportation Improvement Program (FTIP) November 14, 2023 Page 2 As part of the 2025 FTIP update, OCTA requires local jurisdictions to adopt a resolution affirming the agencies' intent to allocate resources to fund and implement their federally funded projects. Currently, the City has one approved improvement project listed in the FTIP. OCTA approved the Newport Beach Bicycle and Pedestrian Bridge project through the Bicycle Corridor Improvement Program (BCIP) with a 20% minimum City match. This project, also known as the Superior Avenue Pedestrian/Bicycle Bridge and Parking Lot Project (15T09), will provide bicycle and pedestrian access across Superior Avenue to and from Sunset Ridge Park. The table below shows the estimated construction cost for the Superior Avenue pedestrian/bicycle bridge only and does not include the cost of the parking lot, which does not involve any federal funding. Expenditures related to the grant are paid for out of the Contributions Fund CIP Expense Account, 13501-980000-15T09. City match is provided through the Facilities Financial Plan Parks and Community Centers Fund CIP Expense Account, 56201-980000-15T09. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). /_A i f_Ta:IM MI N IF Attachment A — Resolution No. 2023-63 5-2 ATTACHMENT A RESOLUTION NO. 2023- 63 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, CERTIFYING THAT THE CITY OF NEWPORT BEACH HAS THE RESOURCES TO FUND THE PROJECTS IN THE FEDERAL TRANSPORTATION IMPROVEMENT PROGRAM FOR FEDERAL FISCAL YEARS 2024/25 TO 2029/30 AND AFFIRMING ITS COMMITMENT TO IMPLEMENT ALL CITY PROJECTS IN THE PROGRAM WHEREAS, the City of Newport Beach ("City") is located within the metropolitan planning boundaries of the Southern California Association of Governments; WHEREAS, the City Council has authorized projects for submittal to the Orange County Transportation Authority's ("OCTA") Federal Transportation Improvement Program for federal fiscal years 2024-25 to 2029/30 ("FTIP"); WHEREAS, by adopting this resolution the City Council intends to certify that the City has the resources to fund the projects in the FTIP, affirm its commitment to implement the projects in the FTIP, and authorize the submittals of future projects for inclusion in the FTIP; WHEREAS, the City is the lead agency for projects submitted by the City in the FTIP and will comply with applicable local, state, and federal provisions for the projects, including but not limited to the FTIP, California Environmental Quality Act, National Environmental Policy Act, Americans with Disabilities Act, and Build America Buy America; and WHEREAS, the City agrees to construct "Transportation Control Measures" for its projects in the FTIP, as amended, in a timely manner, or to assist with finding a substitute project. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby certify that the City has the resources to fund the projects in the FTIP, affirm its commitment to implement the projects in the FTIP, and authorize the submittals of future projects for inclusion in the FTIP. Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. 5-3 Resolution No. 2023- Page 2 of 2 Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
